Why Price Correlations Don't Define Antitrust Markets: On Econometric Algorithms For Market Definition, Jonathan Baker Jan 1987

Why Price Correlations Don't Define Antitrust Markets: On Econometric Algorithms For Market Definition, Jonathan Baker

Working Papers

This paper compares two econometric methods that have been proposed for market definition: price correlations and residual demand curve estimation. Econometric theory is used to demonstrate that price correlations among firms will likely contain little or no information relevant to defining antitrust markets, under the assumption that a hypothetical cartel facing a downward sloping residual demand curve constitutes an antitrust market (defined according to the DOJ Guidelines). Hence price correlation analyses are likely to have little value for antitrust market definition. In terms of the literature on empirical techniques for market definition, this paper shows that if the econometric market …

Women's Banks And Women's Access To Credit: Competition Between Marketplace And Regulatory Solutions To Gender Discrimination, Kenneth Anderson

Scholarly Articles in Law Reviews & Journals

During the 1970's, as more women entered the work force as managers, laborers and entrepreneurs, women's credit and financing needs intensified. Yet banks and other financial institutions persisted in discriminating against women in extending credit. This discrimination reflected a view that women were bad credit risks because they generally had no independent source or control of income. Without access to credit, women could not develop independent sources of income, build an asset base or develop their own credit histories. This in turn precluded future extensions of credit to women. Denial of access to credit for women was a cause as …

Attempting The Impossible: The Emerging Consensus, Ira Robbins Jan 1986

Attempting The Impossible: The Emerging Consensus, Ira Robbins

Scholarly Articles in Law Reviews & Journals

Impossible attempts are situations in which an actor fails to consummate a substantive crime because he is mistaken about attendant circumstances. Professor Robbins divides mistakes regarding circumstances into three categories: mistakes of fact, mistakes of law, and mistakes of mixed fact and law. Courts and commentators disagree primarily over the identification and treatment of mixed fact law cases. Professor Robbins surveys each category of mistake. He then examines the objective, subjective, and hybrid approaches to dealing with the mixed fact/law category. The objective approach requires an objective manifestation of the actor's intent before conviction is allowed. The subjective approach permits …

A Framework For The Examination Of States Of Emergency Under The American Convention On Human Rights, Claudio Grossman Jan 1986

A Framework For The Examination Of States Of Emergency Under The American Convention On Human Rights, Claudio Grossman

Scholarly Articles in Law Reviews & Journals

The role that the law can play in the regulation of states of emergency is of enormous consequence to the Western hemisphere. The importance of these emergency situations, also referred to as states of exception or states of siege, lies in both the frequency with which American states resort to them and in the dangers that they pose to the exercise of human rights. Because serious human rights violations ordinarily accompany emergency situations, the declaration of a state of siege has come to be a warning signal for those who seek to protect those human rights. Such protection often depends …

Remedying Underinclusive Statutes, Candace Kovacic-Fleischer

INTRODUCTION: A California employer who does not want to comply with California's mandatory unpaid pregnancy leave statute has reached the United States Supreme Court. The employer seeks to have the statute invalidated, claiming it is preempted by the Pregnancy Discrimination Act of Title VII of the Civil Rights Act of 1964. The employer is arguing that the California pregnancy leave act is fatally underinclusive because it does not provide similar employment protection for workers with short-term disabilities. The district court agreed with the employer; the court of appeals did not.

The Gains From Merger Or Collusion In Product Differentiated Industries, Jonathan Baker, Timothy Bresnahan Jun 1985

The Gains From Merger Or Collusion In Product Differentiated Industries, Jonathan Baker, Timothy Bresnahan

Scholarly Articles in Law Reviews & Journals

A merger in an industry with differentiated products increases the market power of the merging firms to the extent that their products are close substitutes and that other firms produce only more distant substitutes.' Such a merger makes the residual demand curve of each partner steeper, by shifting each in the direction of the industry demand curve. The extent of this increase in market power depends upon the own-elasticity of demand for each merging firm's product, as well as the cross-elasticity of demand for each with all other firms' products. As a result, evaluating the effect of a merger between …
