Privatization Of Prisons: An Analysis Of The State Action Requirement Of The Fourteenth Amendment And 42 U.S.C. § 1983, Ira Robbins Jan 1988

Privatization Of Prisons: An Analysis Of The State Action Requirement Of The Fourteenth Amendment And 42 U.S.C. § 1983, Ira Robbins

Scholarly Articles in Law Reviews & Journals

Introduction: The privatization of prisons raises important issues with respect to liability in suits brought by inmates. If a private company operates the prison, the state likely will be directly involved in some aspects of prison life, such as using force when necessary or making quasi-judicial decisions, but it may not be directly involved in the day-to-day operation of the institution. This dichotomy of involvement may lead to con- fusion over responsibility and accountability when a violation of rights is alleged to have occurred. When a private party, as opposed to a government employee, is charged with abridging rights guaranteed …

Lawyers And The Rule Of Law In The Western Hemisphere, Claudio Grossman, Frederick Anderson Jan 1988

Lawyers And The Rule Of Law In The Western Hemisphere, Claudio Grossman, Frederick Anderson

Scholarly Articles in Law Reviews & Journals

Relations between the United States and Latin America are once again entering a historic phase. How the nations of the Americas handle issues such as the rule of law and the role of judges and lawyers in human rights, trade, immigration, narcotics traffic, security, and natural resources development will shape the future of nations in this hemisphere. Because all of these issues have strong legal content, attorneys in the United States and Latin America have a particular responsibility to address them cooperatively. A history of conflict between north and south, widely varying intellectual and cultural traditions, and numerous differences between …

Who Cares Who Wrote "Shakespeare"?, Peter Jaszi Jan 1988

Who Cares Who Wrote "Shakespeare"?, Peter Jaszi

Scholarly Articles in Law Reviews & Journals

Obviously, a great many people, on both (or all) sides of the "authorship question," and they care a lot. The real question is why. Proponents of various authorship claimants compete in their protestations of admiration for the plays and poems in controversy. But if these works are in fact so universally and inexhaustibly fertile of significance, why should any admirer of them waste precious time, which might better be devoted to the study of the texts themselves, arguing about an ultimately irresoluble historical puzzle? And why is so much of the discussion conducted at such a relatively high pitch of …

Estimating The Residual Demand Curve Facing A Single Firm, Jonathan Baker, Timothy Bresnahan Jan 1988

Estimating The Residual Demand Curve Facing A Single Firm, Jonathan Baker, Timothy Bresnahan

Scholarly Articles in Law Reviews & Journals

This paper presents an econometric technique for estimating the single firm residual demand curve that does not require the estimation of demand cross-elasticities. The technique is particularly suited for the estimation of firm market power in product differentiated industries, where cross-elasticities are notoriously difficult to measure. One estimated parameter is directly related to a firm's markup of price over marginal cost when product differentiation is extensive, when an industry consists of a dominant firm and a price-taking fringe, when a Consistent Conjectures Equilibrium is the correct oligopoly solution concept, when firms are Stackelberg leaders relative to their environment, or when …

Permanent Counterinsurgency In Guatemala, Kenneth Anderson, Jean-Marie Simon Sep 1987

Permanent Counterinsurgency In Guatemala, Kenneth Anderson, Jean-Marie Simon

Scholarly Articles in Law Reviews & Journals

This 1987 article in the critical theory journal Telos examined the counterinsurgency carried out in Guatemala during the late 1970s and 1980s by the Guatemalan army and security forces, and the country's transition to civilian democracy in 1986 under the presidency of Vinicio Cerezo. The article, as an exercise in radical sociology of the Left, argues sharply that the transition is little more than the appearance of democracy, while beneath lies a "permanent counterinsurgency" and authoritarian control by the army. Based on extensive interviews by the authors with many actors in Guatemala, including leading military officers, it offers an inside …

Judicial Sabbaticals, Ira Robbins Jan 1987

Judicial Sabbaticals, Ira Robbins

Books

Sabbatical leaves have proven to be a useful concept for providing extended periods of time away from the job for individuals to pursue other needs or interests. The concept has spread from academic and religious institutions to business and industry, law firms, and government.

After surveying these analogies, this staff paper reviews the limited ways in which the concept has been applied to the judiciary. It then discusses the desirability and feasibility of extending judicial sabbaticals further, particularly to the federal judiciary. The principal virtues of such sabbaticals are that they have the potential to improve efficiency and productivity, enhance …
