The Bremen, Cogsa And The Problem Of Conflicting Interpretation, Charles L. Black, Jr. Jan 1973

The Bremen, Cogsa And The Problem Of Conflicting Interpretation, Charles L. Black, Jr.

Vanderbilt Journal of Transnational Law

All aspects of the important Bremen decision will be explored in these Comments and elsewhere. I propose to present just two ideas, without needless connective verbal tissue between them: I. The Bremen case has nothing to do with the Carriage of Goods by Sea Act (COGSA); both choice-of-forum and choice-of-law clauses should continue to be invalidated in bills of lading subject to that Act. II. The best solution for international conflicts of interpretation as to COGSA (and doubtless as to other statutes based on international conventions) would be an international court of appeals, exercising a discretionary jurisdiction, but empowered to …

The Nature And Extent Of Executive Power To Espouse The International Claims Of United States Nationals, Jesse W. Hill, Steven M. Lucas Jan 1973

The Nature And Extent Of Executive Power To Espouse The International Claims Of United States Nationals, Jesse W. Hill, Steven M. Lucas

Vanderbilt Journal of Transnational Law

International law is generally considered to be law that governs the conduct of sovereign states only. While individual private persons, both natural and juridical, undoubtedly are third-party beneficiaries of the rights and duties created by international law, those rights and duties, in the classical analysis, run only among sovereigns. Because rules of international law and treaties constitute obligations among or between sovereign states, a violation of international law imposes international responsibility not to the private parties who are injured by the violation but to the sovereign states of which they are members. Private parties, therefore, generally have no standing to …

Industrial Property Rights In Ethiopia, Peter Winship Jan 1973

Industrial Property Rights In Ethiopia, Peter Winship

Faculty Journal Articles and Book Chapters

Although the Commercial Code of 1960 contemplates the promulgation of a special law governing industrial property rights, the Imperial Ethiopian Government has neither promulgated this law nor, with the exception of a draft trademark law, prepared the appropriate draft legislation. The lack of a comprehensive law has not been disastrous: until recently the number of trademarks and industrial inventions used or created in Ethiopia was very small. A number, of different legal theories, moreover, have been or could be used to protect some persons' trade marks or industrial inventions. 2 However, with the growing number of court cases related to …

The law of the United Nations Charter is not now quite the same as it was before the Declaration on Friendly Relations was adopted. Although not a formal enactment, it gives more flesh and bone to key articles, such as article 2(4).

Soviet Policy On The Sea-Bed And The Ocean Floor, Sevinc Carlson Oct 1972

Soviet Policy On The Sea-Bed And The Ocean Floor, Sevinc Carlson

Syracuse Journal of International Law and Commerce

The growth and development of a modern navy has been a somewhat recent phenomenon for the USSR, occurring most significantly in the last decade. Soviet policy towards law of the sea matters, then, is naturally influenced by these factors. The push towards an ever-expanding role in the world's oceans, engendered primarily in the national interest, clearly colors the Soviet views, as expressed in current international discussions.

"Impact Reports" : A Domestic Law Analogy For International Legislation, L.F.E. Goldie Oct 1972

"Impact Reports" : A Domestic Law Analogy For International Legislation, L.F.E. Goldie

Syracuse Journal of International Law and Commerce

Proposals submitted to the Seabeds Committee of the United Nations General Assembly and by the Report of the President's Commission on Marine Science, Engineering and Resources contain blueprints for the establishment of international agencies with respect to seabed exploitation, the duration and extent of licenses of seabed areas, the quantum of the interest granted, the conditions of forfeiture and the destination of revenues. They do not, however, offer concrete proposals for combatting the pollution effects of deep sea mining and merely, at best, make some pious reference to the need for taking environmental issues and interests into account. In the …

Rich And Poor Countries And The Limits Of Ideology -- An Introduction To The Day's Proceedings, L.F.E. Goldie

Syracuse Journal of International Law and Commerce

This is the eighth annual Regional Meeting of the American Society of International Law here at Syracuse. Our topic for this meeting is "The United Nations and the Resources of the Deep-Ocean Floor." The problems which this theme signals are becoming cute as the world's population increasingly presses on our diminishing resources and as our environment is threatened with major and possibly irreversible degradation.

The United States Draft United Nations Convention On The International Sea-Bed Area And The Accomodation Of Ocean Uses, William Palmer Oct 1972

The United States Draft United Nations Convention On The International Sea-Bed Area And The Accomodation Of Ocean Uses, William Palmer

Syracuse Journal of International Law and Commerce

The United States Draft Sea-Bed Convention is a dynamic application of the principle of true accommodation in the broadest sense. It addresses the need to regulate in a fair and orderly fashion the exploitation of sea-bed resources while meeting the needs of other ocean uses by means of mutual accommodation provisions.

Panel Discussion Oct 1972

Panel Discussion

Syracuse Journal of International Law and Commerce

The Chairman requested comments from the panel on the current state of discussions on the development of international machinery to regulate the uses of the deep seabed and the ocean floor. Noting that the Soviet Union has shown little interest in international controls, he asked if there was any ground for optimism for a global agreement.
