Comments: Transfusion-Associated Acquired Immunodeficiency Syndrome (Aids): Blood Bank Liability?, David A. Roling
University of Baltimore Law Review
The Acquired Immunodeficiency Syndrome (AIDS) can be contracted via a blood transfusion. A legal question of growing importance in Maryland and across the country is whether a blood bank which supplies AIDS-tainted blood should be liable to a blood transfusee for the contraction of AIDS. Inherent in that question is a balancing of society's need to protect blood banks from liability and the individual's right of recovery. This comment examines that question. The author begins with a historical review of blood bank liability for blood tainted with viruses other than AIDS and then discusses various theories of liability under which …

Book Chapters
A book by Glanville Williams, The Sanctity of Lift and the Criminal Law, 1 once again brought to the fore the controversial topic of euthanasia, more popularly known as 'mercy-killing'. In keeping with the trend of the euthanasia movement over the past generation, \Villiams concentrates his efforts for reform on the voluntary type of euthanasia, for example the cancer victim begging for death, as opposed to the involuntary variety-that is, the case of the congenital idiot, the permanently insane or the senile.
When a legal scholar of Williams's stature joins the ranks of such formidable law thinkers as America's Herbert …

Take-Or-Pay Provisions: Major Problems For The Natural Gas Industry Comment., David L. Roland
St. Mary's Law Journal
A prompt solution to the take-or-pay problem is vital to the survival of the natural gas industry. Due to the increasingly turbulent and unpredictable natural gas market, most natural gas producers include a take-or-pay provision in their gas purchase contracts. Take-or-pay provisions require a pipeline company to either take an amount of natural gas from the producer or the company must pay for the specified amount. The market, however, has changed and the demand for natural gas declined. The demand can be partly attributed to the energy crisis of a decade ago. As a result of the crisis, consumers are …
