Moving the West's Water to New Uses: Winners and Losers (Summer Conference, June 6-8)
Conference organizers and/or faculty included University of Colorado Law School professors Lawrence J. MacDonnell and Mark Squillace.
Moving the West's Water to New Uses: Winners and Losers will be the theme for this year's water conference, June 6-8 at the Law School in Boulder. The conference will consider the changing demands for water in the West and the need to reallocate a portion of the existing uses of water to new uses.
The first day will provide the background by looking at the most likely sources of water to meet these demands, including agriculture, federal water projects, interstate transfers, and …

Using Management Techniques To Solve Environmental Problems, Patrick D. Kelly
RISK: Health, Safety & Environment (1990-2002)
Arguing that little effective progress is being made in solving problems of varying urgency, this paper suggests a leadership role for science and engineering societies. It proposes that such societies attempt to prioritize problems and attempt to focus public awareness (and calls to action) in a more systematic way.

Sources Of Inconsistency In Societal Responses To Health Risks, W. Kip Viscusi
Vanderbilt Law School Faculty Publications
Society has until recently devoted insufficient attention to the long-run environmental problems that we face, including acid rain and the greenhouse effect. Our inaction with respect to these risks can hardly be characterized as a rational response or an overreaction to risk. There are three possible explanations of such diverse phenomena. First, one could simply dismiss this behavior as being the result of inconsistent and irrational behavior. Second, one could devise ad hoc explanations of why individuals underreact in some instances and overreact in others. A third possibility is to reconcile this seemingly inconsistent behavior with a consistent theoretical framework. …

Acid Rain And Ozone Layer Depletion: International Law And Regulation, Kernaghan Webb
Acid Rain And Ozone Layer Depletion: International Law And Regulation, Kernaghan Webb
Dalhousie Law Journal
Although international customary and conventional law have addressed aspects of transfrontier pollution problems for decades,' the regional and global environmental degradations which have come to the forefront in the 1980s and 1990s - acid rain, ozone depletion, and global warming, to name but three - represent new challenges to existing international law institutions and concepts. In a sense, the world has over the past two centuries gone through a period of what could be called "technological adolescence", as individuals and corporations, largely from industrialized nations, exploited the earth's resources with little if any concern for the immediate and long-term implications …

Underground Storage Tanks: A Lawyer's Guide To Recent Federal And North Carolina Legislation, Thurman A. Gardner Jr.
Campbell Law Review
This Comment focuses on what is already a common problem facing attorneys and their clients who own underground storage tanks (USTSs). That problem, from the client's perspective, is, "What am I supposed to do?" There are a multitude of USTs in the United States. Many of these underground tanks contain petroleum. Often these tanks are located at "mom and pop" gas stations. This Comment focuses on the requirements a commercial gas station owner must follow in the operation of underground storage tanks. This Comment also provides sample lease provisions for the owner of an UST who leases the premises to …
