Tropical Forest Conservation Legislation And Policy: A Global Perspective, Robert M. Hardaway, Karen D. Dacres, Judy Swearingen

Sturm College of Law: Faculty Scholarship

This article reviews tropical rainforest legislation and policy of countries around the world. It documents the alarming erosion of rainforest resources and preserves, and evaluates the effectiveness of law and policies promulgated to arrest that erosion. The problems associated with rainforest depletion are treated in the context of the world's exploding population, as well as the economic needs of the developing countries. The need for population control policies, and family planning, are considered along with effective controls and regulation of rainforest exploitation.

This report focuses on the realm of environmental policy under a state's jurisdiction and addreses ways in which universities can best support a state's formulation of environmental policy. Making policy involves bringing forward an issue for a decision, issuing laws, rules, regulations or decision about specific matters, and evaluating and adjusting the policy after its enactment. Environmental policy is foremost within the jurisdiction of state and local governments, although governance over certain resources has been assumed by the federal government. The Case Against Intermediate Owner Liability Under Cercla For Passive Migration Of Hazardous Waste, Robert L. Bronston

This Note argues that Congress intended disposal to have an active meaning and therefore that courts should not hold prior intermediate owners liable for the passive migration of hazardous waste under section 107(a)(2). Part I examines CERCLA's definition of disposal. This Part concludes that the language of the definition, though somewhat ambiguous, supports the active defuiition. Part II considers the history of both CERCLA and the Resource Conservation and Recovery Act (RCRA), which CERCLA amended, in order to determine whether Congress intended to require affirmative conduct on the part of intermediate owners as a prerequisite to liability. Nafta & The Environmental Side Agreement: Fusing Economic Development With Ecological Responsibility, Reid A. Middleton

San Diego Law Review

This Comment presents a substantive analysis of the North American Free Trade Agreement and its Environmental Side Agreement. It addresses the environmental questions surrounding the agreement and recognized the agreement's capacity to provide both economic and ecological enrichment in the U.S.- Mexican environment. The Comment analyzes the environmental criticisms of NAFTA, and illustrates why these criticisms are inaccurate. Through examination of the enforcement mechanisms of the Environmental Side Agreement, this Comment illustrates how Mexico's capacity and desire to fulfill its own environmental obligations, coupled with the necessary financing, will allow Mexico to independently put an end to decades of ecological …

For hundreds of years, this continent's Indians shared a spiritual belief that they must respect and protect their Mother Earth above all else. Today, however, many tribes no longer view the environment as a bank of natural resources that they must shield and shelter at any cost. Instead, the economic pressures of the twentieth century-particularly underdevelopment, unemployment, and poverty -are forcing a growing number of Indian tribes to exchange the spiritual view of their once pristine environment for a commercial one. Environmental Policy And Federal Structure: A Comparison Of The United States And Germany, Susan Rose-Acherman

Vanderbilt Law Review

The assignment of tasks to the appropriate level of government is an important aspect of environmental policy design. Because the costs and benefits of pollution control policies are closely tied to geography, political solutions should reflect the underlying spatial structure of environmental problems. These solutions should not only incorporate the long-distance effects of air and water pollution, but also account for the mobility of economic actors and the resource base of governments.

There are three general types of environmental problems. Global issues have no complex geographical component. Regional problems arise when political boundaries do not coincide with the pollution's geographical …
