Cities, E-Commerce & Public Health: 3 Legal Pathways To Limiting Freight Vehicle Emissions, Amy E. Turner
Cities, E-Commerce & Public Health: 3 Legal Pathways To Limiting Freight Vehicle Emissions, Amy E. Turner
Sabin Center for Climate Change Law
In recent years, cities have become increasingly defined by e-commerce – the sprawling network of goods delivery from central warehouses to neighborhood distribution centers to residents’ front doors. This growing network of warehouses and the freight vehicles that serve them contribute significantly to a community’s greenhouse gas emissions and exposure to harmful pollutants like nitrogen oxides (NOx), carbon monoxide and particulate matter. Moreover, so-called last-mile delivery warehouses (or distribution centers) are proliferating, largely in low-income communities and communities of color, where residents are exposed to increasing traffic, pollution, and harmful health impacts.
While a handful of cities have pursued approaches …

Climate Litigation In The Global South: Mapping Report, Maria Antonia Tigre
Sabin Center for Climate Change Law
In recent years, climate litigation has undergone a notable transformation globally, witnessing a surge in cases across diverse jurisdictions. While scholarly interest has predominantly focused on cases from the Global North, attention to litigation originating in the Global South has been more limited. Nonetheless, understanding the distinct legal grounds, remedies sought, and objectives of plaintiffs in the Global South is crucial. This report addresses this gap by providing a comprehensive insight into the current landscape of climate litigation in the Global South.
The report utilizes data from the Sabin Center’s Global Climate Change Litigation databases, which has seen an influx …

Speaking Authorship: Honoring Indigenous Language Sovereignty In Joint Authorship Doctrines, Nancy Fu
Cardozo Law Review
In 2022, the Standing Rock Sioux Tribal Council unanimously voted to banish the Lakota Language Consortium (LLC) and its two European founders from the reservation. The LLC began working with the Tribe in the early 2000s to document the Lakota language and created numerous recordings of Lakota elders, a Lakota dictionary, and many other educational materials. However, the LLC registered those works’ copyrights solely under its own name, so Tribe members must now seek the LLC’s permission to use or access them, which may require payment and may not be granted at all, even for recordings of the requestor’s own …

Military Climate Emissions, Nadia B. Ahmad
Nevada Law Journal
On the third anniversary of the World Health Organization’s declaration of a global pandemic, Gen Z’s first congressional representative, Maxwell Alejandro Frost, advocated for a reduction in the Pentagon’s budget to better serve local communities. This perspective underscores the economic and moral rationale for reallocating national defense funds to communities. The call for defunding the police has gained momentum, paralleling the advocacy for demilitarization. This Article emphasizes the overlooked impact of U.S. military carbon emissions on climate change and advocates for its inclusion in national carbon accounting systems globally. The U.S. Department of Defense has not been transparent about its …
Sacrifice Zones, Jonathan Rosenbloom
Sacrifice Zones, Jonathan Rosenbloom
Nevada Law Journal
Thousands of acres of land have been lost to climate change. Additional thousands, if not millions, of acres will become uninhabitable because of floods, droughts, heatwaves, wildfires, and a host of other known and unknown climate impacts. Yet people continue to build in such areas, adding homes, businesses, infrastructure, and so on, guaranteeing that state and local governments will be perpetually engaged in emergency management and salvage operations into the indefinite future. From a climate change perspective, such construction reduces our resiliency while it increases our vulnerability to the demands of climate change. To prevent this extremely dangerous and expensive …
Climate Reparations, Benoit Mayer
Climate Reparations, Benoit Mayer
Nevada Law Journal
Anthropogenic greenhouse gas (“GHG”) emissions have caused unprecedented change in planetary systems, resulting in tremendous social and ecological impacts. The most vulnerable individuals, communities, and countries are disproportionately affected, even though they are often least responsible for, and benefit less from, these emissions. Some of these countries have claimed reparations for the impacts of climate change impacts for over three decades, but they have achieved little success. Recently, however, these claims have gained some ground. In 2022, the Parties to the Paris Agreement decided to establish “new funding arrangements” to assist developing countries in “responding to loss and damage.” In …

Transitioning To Regenerative Agriculture One French Fry At A Time, Alexia Brunet Marks
Nevada Law Journal
Regenerative agriculture—a farming practice that sequesters atmospheric carbon dioxide (CO2) into the soil—has potential to turn into big business in this climate crisis. If farmers can accurately measure the amount of trapped carbon in their soil, they can sell that stored carbon as a “carbon credit,” a tradeable certificate representing the right to emit one metric ton of carbon dioxide (CO2) or the equivalent amount of another greenhouse gas. As more than seventy countries race to cut greenhouse gas emissions by 2050 in order to meet Paris Agreement1 goals, carbon credits are becoming the “new currency” to meet or exceed …

Sustainability And The Sunlight Of Disclosure: Esg Disclosure In Three Asian Financial Centres, Rachel Phang, Yaru Chia
Research Collection Yong Pung How School Of Law
The prevailing paradigm of sustainable finance places great importance on environmental, social and governance (ESG) information and, therefore, on the mechanism of reporting and disclosure. This article presents, analyses and compares the approaches to ESG disclosure in three Asian financial centres: Singapore, Hong Kong and Shanghai. The article uncovers commonalities and divergences in the drivers, dynamics, content and trends of ESG disclosure in the selected jurisdictions. In doing so, it looks forwards, seeking to anticipate and shape the development of ESG disclosure in Asia. At the same time, it looks beyond ESG disclosure, remaining mindful that the mechanism itself is …
Green Gold: The Akkoub’S Settler Ecologies, Irus Braverman
Green Gold: The Akkoub’S Settler Ecologies, Irus Braverman
Journal Articles
The akkoub (Gundelia tournefortii) is a thistle-like plant so precious in Palestinian cuisine that it is often referred to as “green gold.” The risks, as well as the mystique, surrounding the akkoub have only intensified since the state of Israel designated this plant as protected under the Nature and Parks Protection Act. The story of the akkoub as depicted in this article illustrates the three tenets of “settler ecologies”: the regime of environmental protections enacted by the settler state that furthers its domination of the natural landscape and its dispossession of local and Indigenous communities. The first and …

6ppd-Q, Tires, And Salmon, Oh My: Policies And Remedies For Tribes In The Acute Mortality Of Coho Salmon In The Puget Sound Region., Meralina Morales
American Indian Law Journal
The pervasive reliance on automobiles within society exacerbates environmental degradation in low-income and communities of color, notably in Native and tribal communities. The leaching of Tread Wear Particles (TWP), including the detrimental 6PPD-quinone (“6PPD-q”), into waterways, significantly impacts aquatic ecosystems. This issue is especially impactful for endangered species, like the coho salmon, that hold profound cultural significance for indigenous tribes in the Pacific Northwest, for example, the Nez Perce Tribe believes that the fate of the salmon and people are linked.[1]
The scientific foundations of 6PPD-q's impact on salmon through bioaccumulation and biomagnification highlights its environmental justice implications. This …

Evaluating Climate Migration Through Discourse Analysis Of International Policy Framework And “El Progreso” Community Blog, Olusola Akanni
Evaluating Climate Migration Through Discourse Analysis Of International Policy Framework And “El Progreso” Community Blog, Olusola Akanni
Master's Theses
ABSTRACT
Environmental changes are driven by global warming, such as rising temperatures, melting ice, and increased natural disasters which directly affect the living conditions of huma thereby driving migration. This study highlights the inadequacies of current migration management policies as the United States is seeing a significant influx of migrants from Central America. The focus of this discourse analysis is on the role of inadequate policies and the failure of international efforts like the Paris Climate Agreement in addressing the issue of climate-induced migration effectively. Despite the goals set by such international agreements to mitigate the effects of climate change …

Esg Implementation In Emerging & Frontier Markets: Lessons Cultivated From Sri Lanka And Beyond, Ahmed Qaisi
University of Miami Business Law Review
Crippling debt accrued within emerging and frontier market nations forces developing governments to enact policies contrary to the well-being of their overall economies. The influence of credit rating agencies as well as organizations like the World Bank and the International Monetary Fund (“IMF”) have handcuffed governments into implementing Environmental, Social, and Governance (“ESG”) policies that are unrealistic and unfeasible and have therefore caused detrimental societal impacts. This note examines how the application of ESG policies and governmental corruption resulted in Sri Lanka’s devastating economic collapse. Also scrutinized are those countries which have taken on debt but have managed well throughout …

When It Rains, It Pours: Weather Modification Law In The United States And A Proposal For Federal Control, Brendan Woodruff
Pace Environmental Law Review
Though weather modification has been used as a strategy to address issues such as drought throughout history, there continues to be a lack of federal regulation addressing weather modification. This Note surveys state regulations on weather modification and examines the current status of how the federal government addresses weather modification. Ultimately, this Note makes the case for why the Department of the Interior should take on the federal regulation of weather modification.
