Providing Protection To Programmers' Works: Disregard The Merger Doctrine And Adopt The Application Approach, Akshay Jain Jan 2018

Providing Protection To Programmers' Works: Disregard The Merger Doctrine And Adopt The Application Approach, Akshay Jain

Catholic University Journal of Law and Technology

In today’s technological landscape, computer programs are one of the most highly complex and popular inventions. However, they still receive little or sometimes no legal protection. As a consequence, programmers are reluctant to create new programs, discouraging innovation and preventing the public to benefit from using these inventions. If the court does afford them copyright protection, they may still not receive legal damages for copyright infringement because the court would not consider their program registered under the Copyright Act of 1976.

This Comment argues for greater copyright protection for programs by disregarding the merger doctrine, which does not provide protection …

Consuming Digital Debris In The Plasticene, Stephen R. Parks Jan 2018

Consuming Digital Debris In The Plasticene, Stephen R. Parks

Theses and Dissertations

Claims of customization and control by socio-technical industries are altering the role of consumer and producer. These narratives are often misleading attempts to engage consumers with new forms of technology. By addressing capitalist intent, material, and the reproduction limits of 3-D printed objects’, I observe the aspirational promise of becoming a producer of my own belongings through new networks of production. I am interested in gaining a better understanding of the data consumed that perpetuates hyper-consumptive tendencies for new technological apparatuses. My role as a designer focuses on the resolution of not only the surface of the object through 3-D …

Breadcrumbs: Privacy as a Privilege Abstract

By: Prachi Bhardwaj

In 2017, the world saw more data breaches than in any year prior. The count was more than the all-time high record in 2016, which was 40 percent more than the year before that.

That’s because consumer data is incredibly valuable today. In the last three decades, data storage has gone from being stored physically to being stored almost entirely digitally, which means consumer data is more accessible and applicable to business strategies. As a result, companies are gathering data in ways previously unknown to the average consumer, and hackers are …

How Useful Is Gsv As An Environmental Observation Tool? An Analysis Of The Evidence So Far., Katherine Nesse, Leah Airt

SPU Works

Researchers in many disciplines have turned to Google Street View to replace pedestrian- or carbased in-person observation of streetscapes. It is most prevalent within the research literature on the relationship between neighborhood environments and public health but has been used as diverse as disaster recovery, ecology and wildlife habitat, and urban design. Evaluations of the tool have found that the results of GSV-based observation are similar to the results from in-person observation although the similarity depends on the type of characteristic being observed. Larger, permanent and discrete features showed more consistency between the two methods and smaller, transient and judgmental …

Understanding Deleted File Decay On Removable Media Using Differential Analysis, James H. Jones Jr, Anurag Srivastava, Josh Mosier, Connor Anderson, Seth Buenafe May 2017

Understanding Deleted File Decay On Removable Media Using Differential Analysis, James H. Jones Jr, Anurag Srivastava, Josh Mosier, Connor Anderson, Seth Buenafe

Annual ADFSL Conference on Digital Forensics, Security and Law

Digital content created by picture recording devices is often stored internally on the source device, on either embedded or removable media. Such storage media is typically limited in capacity and meant primarily for interim storage of the most recent image files, and these devices are frequently configured to delete older files as necessary to make room for new files. When investigations involve such devices and media, it is sometimes these older deleted files that would be of interest. It is an established fact that deleted file content may persist in part or in its entirety after deletion, and identifying the …

Harnessing Predictive Models For Assisting Network Forensic Investigations Of Dns Tunnels, Irvin Homem, Panagiotis Papapetrou

Annual ADFSL Conference on Digital Forensics, Security and Law

In recent times, DNS tunneling techniques have been used for malicious purposes, however network security mechanisms struggle to detect them. Network forensic analysis has been proven effective, but is slow and effort intensive as Network Forensics Analysis Tools struggle to deal with undocumented or new network tunneling techniques. In this paper, we present a machine learning approach, based on feature subsets of network traffic evidence, to aid forensic analysis through automating the inference of protocols carried within DNS tunneling techniques. We explore four network protocols, namely, HTTP, HTTPS, FTP, and POP3. Three features are extracted from the DNS tunneled traffic: …

Compression Of Virtual-Machine Memory In Dynamic Malware Analysis, James E. Fowler Ph.D. Mar 2017

Compression Of Virtual-Machine Memory In Dynamic Malware Analysis, James E. Fowler Ph.D.

Journal of Digital Forensics, Security and Law

Lossless compression of memory dumps from virtual machines that run malware samples is considered with the goal of significantly reducing archival costs in dynamic-malware-analysis applications. Given that, in such dynamic-analysis scenarios, malware samples are typically run in virtual machines just long enough to activate any self-decryption or other detection- avoidance maneuvers, the virtual-machine memory typically changes little from that of the baseline state, with the difference being attributable in large degree to the loading of additional executables and libraries. Consequently, delta coding is proposed to compress the current virtual-machine memory dump by coding its differences with respect to a predicted …

Blown To Bits Project, David Schmidt

Informatics Open Educational Resources

The book, Blown to Bits, uncovers the many ways that the new digital world has changed and is changing our whole environment. Some changes are incremental but others are more revolutionary. Some of the changes that we welcome are slowly eroding our privacy and are changing the rules of ownership. This book illuminates the complexities of these changes. I have attempted to capture the central points in selected chapters, and in some cases I have added new material or new examples to replace dated material. I picked chapters to summarize that address the following topics (and more). There are many …

The Impact Of Md5 File Hash Collisions On Digital Forensic Imaging, Gary C. Kessler Dec 2016

The Impact Of Md5 File Hash Collisions On Digital Forensic Imaging, Gary C. Kessler

Journal of Digital Forensics, Security and Law

The Message Digest 5 (MD5) hash is commonly used as for integrity verification in the forensic imaging process. The ability to force MD5 hash collisions has been a reality for more than a decade, although there is a general consensus that hash collisions are of minimal impact to the practice of computer forensics. This paper describes an experiment to determine the results of imaging two disks that are identical except for one file, the two versions of which have different content but otherwise occupy the same byte positions on the disk, are the same size, and have the same hash …

A New Distributed Chinese Wall Security Policy Model, Saad Fehis, Omar Nouali, Mohand-Tahar Kechadi

Journal of Digital Forensics, Security and Law

The application of the Chinese wall security policy model (CWSPM) to control the information flows between two or more competing and/or conflicting companies in cloud computing (Multi-tenancy) or in the social network, is a very interesting solution. The main goal of the Chinese Wall Security Policy is to build a wall between the datasets of competing companies, and among the system subjects. This is done by the applying to the subjects mandatory rules, in order to control the information flow caused between them. This problem is one of the hottest topics in the area of cloud computing (as a distributed …

Bloom Filters Optimized Wu-Manber For Intrusion Detection, Monther Aldwairi, Koloud Al-Khamaiseh, Fatima Alharbi, Babar Shah

Journal of Digital Forensics, Security and Law

With increasing number and severity of attacks, monitoring ingress and egress network traffic is becoming essential everyday task. Intrusion detection systems are the main tools for capturing and searching network traffic for potential harm. Signature-based intrusion detection systems are the most widely used, and they simply use a pattern matching algorithms to locate attack signatures in intercepted network traffic. Pattern matching algorithms are very expensive in terms of running time and memory usage, leaving intrusion detection systems unable to detect attacks in real-time. We propose a Bloom filters optimized Wu-Manber pattern matching algorithm to speed up intrusion detection. The Bloom …

The Results Of Deliberation, Maggie Wittlin Nov 2016

The Results Of Deliberation, Maggie Wittlin

The University of New Hampshire Law Review

When evaluating whether to sue, prosecute, settle, or plead, trial lawyers must predict the future—they need to estimate how likely they are to win a given case in a given jurisdiction. Social scientists have used mock juror studies to produce a vast body of literature showing how different variables influence juror decision making. But few of these studies account for jury deliberation, so they present an impoverished picture of how these effects play out in trials and are of limited usefulness.

This Article helps lawyers better predict the future by presenting a novel computer model that extrapolates findings about jurors …

Unconventional Methods For A Traditional Setting: The Use Of Virtual Reality To Reduce Implicit Racial Bias In The Courtroom, Natalie Salmanowitz Nov 2016

Unconventional Methods For A Traditional Setting: The Use Of Virtual Reality To Reduce Implicit Racial Bias In The Courtroom, Natalie Salmanowitz

The University of New Hampshire Law Review

The presumption of innocence and the right to a fair trial lie at the core of the United States justice system. While existing rules and practices serve to uphold these principles, the administration of justice is significantly compromised by a covert but influential factor: namely, implicit racial biases. These biases can lead to automatic associations between race and guilt, as well as impact the way in which judges and jurors interpret information throughout a trial. Despite the well-documented presence of implicit racial biases, few steps have been taken to ameliorate the problem in the courtroom setting. This Article discusses the …

Network Forensic Investigation Of Internal Misuse/Crime In Saudi Arabia: A Hacking Case, Abdulrazaq Al-Murjan, Konstantinos Xynos Oct 2016

Network Forensic Investigation Of Internal Misuse/Crime In Saudi Arabia: A Hacking Case, Abdulrazaq Al-Murjan, Konstantinos Xynos

Annual ADFSL Conference on Digital Forensics, Security and Law

There are ad-hoc guidelines and a limited policy on computer incident response that does not include computer forensic preparation procedures (e.g. logging incidents). In addition, these guidelines do not consider the requirement of Islamic law for admissible evidence at an organisational level in Saudi Arabia. Network forensic investigation might breach the Saudi law if they follow ad-hoc or international digital forensic standards such as Association of Chief Police Officers (ACPO) guidelines. This might put the organisation in a costly situation when a malicious employee sues an Islamic court. This is because the law of Saudi Arabia is complying with Islamic …
