The purpose of this non-experimental quantitative case study was to compare the academic success of community college students over three academic years (2016-17 through 2018-19) before the onset of COVID-19 based on final grades and the influence of student factors, class size, and faculty characteristics using archival data from selected online and on-ground classes at a Middle Tennessee community college. Student factors reviewed include gender, full-time or part-time status, and age (traditional or non-traditional status). This legal qualitative content analysis described how special education due process hearing officers applied the Individuals with Disabilities Education Improvement Act (IDEIA) child find provision since the 2016 federal citations. The study found that districts often violated child find by not evaluating each disability condition, either known or previously suspected. The hearing officer decisions were most often focused on: (a) timely referral and evaluation, (b) comprehensive evaluation, and (c) having a reason to suspect that the student has a disability in need of special education. Working with Latinx students, a semester long study was conducted in the Spring of 2021 to better understand student’s perception of Culturally Responsive Teaching Practices (CRTP) at Mountain State University (MSU). The course sections selected are a part of a larger first year, non-remedial, terminal mathematics courses designed to provide students with smaller teacher to student ratios as well as opportunities to earn credit towards graduation. Instructors in two of the sections received special training around CRTP, while instructors in the other two sections did not receive this training. The policies adopted by the Exceptional Children’s Education Act (2016) enabled disproportionality within LEAs by overlooking undocumented classroom removal practices, underestimating the monitoring and reporting criteria, and overlooking non-dominant cultural and linguistic groups within the Colorado community.
