In 1890, Congress passed the Sherman Antitrust Act to protect competition in the marketplace. Federal antitrust law has developed to prevent businesses from exerting unfair power on their employees and customers. Specifically, the Sherman Act prevents competitors from reaching unreasonable agreements amongst themselves and from monopolizing markets. However, not all industries have these protections.

Historically, federal antitrust law has not governed the “Business of Baseball.” The Supreme Court had the opportunity to apply antitrust law to baseball in Federal Baseball Club, Incorporated v. Early American corporations -- centralized manufacturing hubs with journeymen and apprentices laboring under one roof -- were seldom prepared for the transformations that scientific management and structural reorganization would bring to social relations. This holistic case study with embedded units was conducted to understand and describe the perceptions of female workplace mediators and if they encounter stereotypes, bias, and other challenges as mediators in the state of Texas. Ten female workplace mediators in Texas participated with in-depth, semistructured interviews and an open-ended survey response describing a unique experience they had while mediating workplace disputes. A cross-case synthesis analysis of the results was then conducted with journal notes, literature on gender inequality, mediation, alternative dispute resolution, and Goffman’s theory of stigma. Women are one of the solutions to alleviating the pending pilot shortage. Becoming a pilot needs to appeal to women. Resilience plays an important role in determining whether women in male-dominated career fields will pursue or abandon their careers. The pilot profession is dominated by masculine beliefs, values and perceptions creating an organizational culture adverse and challenging to women.

The study objective was to explore the influence of adversity on female pilots and its effect on resiliency. In our sample of 1,499 female pilots, we found lower resiliency levels as compared to a general U.S. sample. Additionally, statistically significant differences …

Experiences with UNM’s parental leave policy C215 have been evaluated using the ADVANCE 2018 Main Campus Faculty Climate Survey, a series of junior faculty interviews, and concerns brought to the ADVANCE leadership. Key findings are:

  • Women and STEM faculty are more hesitant to use family-leave policies, and perceive greater disadvantage in using them than men and non-STEM faculty
  • Sharing of information about, and implementation of, parental leave varies significantly between units
  • The attitude of the department chair and senior faculty strongly influence the experience of faculty who use parental leave

The Equal Pay Act (EPA) purports to prohibit employers from paying female employees less than male employees with similar qualifications; however, the affirmative defenses provided in the EPA are loopholes that perpetuate the gender pay gap. In particular, the fourth affirmative defense allows for wage differentials based on a “factor other than sex.” Many federal circuits have read this defense broadly to include wage differentials based on salary history. Two of the largest challenges public organizations face in motivating their workforces are the aging workforce and the strong union influence (Lavigna, 2014). On June 27, 2018, the United States Supreme Court ruled in Janus vs. AFSCME to abolish agency fees, and gave public service employees in bargaining units the right to choose whether they want to pay union dues or pay no fees at all.

The international economic trends of globalization and neoliberalism have exposed and enabled the exploitation of Mexican workers, especially women in the maquiladora garment industry. During the 1950s, globalization gave rise to the new international division of labor and transnational corporations (TNCs) that have offshored labor-intensive phases of production to developing countries, many of which have pursued export-led industrialization. Export processing in Mexico was encouraged in the 1960s by Item 807 of the U.S. Tariff Code and Mexico’s Border Industrialization Program. Downsizing, realignment, and closure of military bases have forced many low-skilled, blue-collar federal employees into involuntary job loss and job transition. The impact of involuntary job loss on blue-collar workers has been linked to stress and other adverse psychological effects. There is gap in the literature regarding the lived experiences of federal blue-collar employees following downsizing of military bases. This Article analyzes the history, design, and effectiveness of the highly controversial CEO pay ratio disclosure rule, which went into effect in 2018. Based on a regulatory mandate contained in the Dodd-Frank Act of 2010, the rule requires public companies to disclose the ratio between CEO pay and median worker pay as part of their annual filings with the Securities and Exchange Commission (SEC). The seven-year rulemaking process was politically contentious and generated a level of public engagement that was virtually unprecedented in the long history of the SEC disclosure regime. The study focused on the correlation of injuries and time in service for workers in labor intensive, repetitive jobs. The population for this study comprised all hourly employees working at the Wal-Mart Distribution Center located in Mount Crawford, VA. In compliance with OSHA requirements, when an employee injury requiring medical attention occurs the data is collected and recorded. These data records were provided by the Safety Manager of the facility. The data was collected from February 2016 through January 2017 to coincide with fiscal year. This study analyzes the effectiveness of management of flight crewmembers’ careers based entirely on seniority. The research evaluated if it is possible, through the exclusive use of seniority criteria, to recognize and compensate high-performance crewmembers. Although the seniority model indeed creates stability and predictability for managers and crew members, the employee's performance is not considered in career development, failing to recognize and reward good performance. The statistical analysis showed that the seniority does not have direct relationship with the performance of the crew member. The Lynchburg Metropolitan Statistical Area (MSA) has an average turnover that exceeds the national and regional average. Organizational turnover unfavorably influences productivity and has the potential to adversely affect, not only the Lynchburg MSA, but also the regional, state, and national economy. This quantitative non-experimental, correlational research examined the relationship between perceived job satisfaction and organizational commitment in the Lynchburg MSA. The results of this research supports earlier research and demonstrated a statistically significant positive relationship existed between perceived job satisfaction and organizational commitment in small business employees in the Lynchburg MSA. Perceived Organisational Injustice And Counterproductive Behaviour: The Mediating Role Of Work Alienation Evidence From The Egyptian Public Sector, Dr. Maha Ahmed Zaki Dajani, Dr. Mohamed Saad Mohamed

This study examines the relationship between the four dimensions of organisational justice, namely, distributive, procedural, interpersonal, and informational justice, and workers’ counterproductive behaviour, and whether work alienation has mediating effect in this relationship. These relationships were tested in a sample of 300 blue-collar workers operating in Egyptian public industrial context, only 236 responded positively. Results revealed that there are significant relationships between organisational injustice (in its four types) and counterproductive behaviours, and each of the work alienation dimensions partially mediated this relationship. This article sheds light on pilots’ perceptions of justice and their job identification. The research investigates pilots’ perceptions of the fairness with which they are treated, how these perceptions might influence their identification with their jobs and whether this identification influences operational safety. The methodological approach integrates the pilot-organisational behavioural model introduced in this research into two commonly known models of the human factor in aviation: the ‘Software-Hardware-Environment-Liveware (pilot)-Liveware (team)’ – or SHELL – model and the ‘Swiss cheese’ model. The article includes an outline regarding aviation safety and recommendations for applying our approach toother transportation industries.

Two competing theories argue that the nonprofit sector pays differently: Nonprofit employees may accept lower pay to be able to do meaningful work for a good cause, or they may earn higher pay due to nonprofit organizations’ tax exemptions and weaker incentives to hold down wages. To test these opposing expectations, we use the 2005-2013 American Community Surveys to examine pay differences among registered nurses working for nonprofit, for-profit, and public hospitals. We also test hypotheses that public and nonprofit hospitals have smaller pay disparities by gender, race, and relationship status. We find that pay is highest in nonprofit hospitals, …

The current work examines a contemporary workplace stressor that has only recently been introduced into the literature: illegitimate tasks. Illegitimate tasks are work tasks that violate identity role norms about what can reasonably be expected from an employee in a given position. Although illegitimate tasks have been linked to employee well-being in past work, we know little about the potential explanatory mechanisms linking illegitimate tasks to work-relevant negative psychological states. Using a sample of 213 US-based employees of mixed occupations and a cross-sectional design, the present study examines job satisfaction and intrinsic motivation as outcomes of illegitimate tasks. This project sought to determine what the labor conditions of porters working in Annapurna are and the factors both immutable and human-influenced that shape them. To do so, I interviewed government bodies, national and regional trekking organizations, unions, agencies, guides and porters to ascertain what issues a broad term such as “labor conditions” encompasses. Participants highlighted the importance of insurance, wages, weight carried, equipment, access to employment, job training and topography as important factors. Judges are often called upon today to determine whether certain workers are “employees” or “independent contractors.” The distinction is important, because only employees have rights under most statutes regulating work, including wage and hour, anti-discrimination, and collective bargaining law. Too often judges exclude workers from statutory protection who resemble what legal scholars have described as typical, industrial employees — long-term, full-time workers with set wages and routinized responsibilities within a large firm. To explain how courts reach these counterintuitive results, the article examines recent federal decisions finding that FedEx delivery drivers are independent contractors rather than employees.
