Is A Ban On Non-Competes Supported By Empirical Evidence?, Sarah Oh Lam, Thomas Lenard, Scott Wallsten

The U.S. Federal Trade Commission (FTC) has proposed a rule to declare virtually all non-compete agreements unfair methods of competition under Section 5 of the FTC Act and therefore, illegal. However, the empirical literature on non-compete agreements cited by the FTC in its Notice for Proposed Rulemaking (“NPRM”) shows mixed results on earnings, job creation, firm formation, entrepreneurship, training, investment, and firm value. Evidence in other current studies also does not support an economy-wide ban. The FTC concludes that the proposed rule would yield net benefits even though by its own admission it lacks the information necessary to conduct a …

All entrepreneurs seek favorable legal or regulatory treatment for their businesses. Sometimes this leads an entrepreneur to build a business within a gap in the law—a loophole. In so doing, these “loophole entrepreneurs” may avoid steep regulatory compliance costs that otherwise would beset (or perhaps prohibit) their businesses, thereby gaining advantages over competitors. Despite these benefits, loophole entrepreneurship is fraught with risks. Loopholes, by nature, are fragile, and their contours are often uncertain. Moreover, the stigma of “exploiting a loophole” (which connotes unfairness or deception) can provoke ill will among competitors, policymakers, and the public.

Crowdfunding is an increasingly popular method for entrepreneurial ventures to raise financing from a large number of small supporters (the “crowd”) instead of raising it through a small number of larger supporters. Purpose of this article is to find out whether determinants of women entrepreneurship are different from those of men’s entrepreneurship in general and specifically in Côte d’Ivoire. To do this, we conducted a quasi-experimental analysis using non-parametric and parametric approaches to survey data on a sample of 161 entrepreneurs in Côte d'Ivoire, 113 of whom were women and 48 men. Our survey was designed and conducted to neutralize the socio-demographic and conjunctural differences between men and women entrepreneurship in order to produce matched data. Women entrepreneurs are a rapidly growing demographic. Mentoring is a recurring theme in the literature as a valuable contribution in helping women entrepreneurs succeed. The roles of mentoring as well as the literature of mentoring relationships is presented, followed by a study in which the demand and perceived benefit for mentoring was conducted among women currently engaged or self-identified as aspiring small business owners and entrepreneurs. The budget limitation urged DKI Jakarta Provincial Government (DJPG) to change their conventional training program for SMEs and arrange an IT-based platform enabling all city entities, including private and non-private sectors, to participate in a coproduction scheme. Highly successful entrepreneurial ventures often result from solving problems that have not been solved before (i.e., entrepreneurial problems). The problem-solving and entrepreneurship literatures indicate that individuals need to develop novel problem frames—uncommon interpretations of observable needs or pain points (i.e., symptoms) signaling the problems—to create solutions that other people would not typically think of and generate unique value that is key to entrepreneurial success. However, developing novel frames of entrepreneurial problems is difficult for two reasons. This article presents a feminist constructivist political economy perspective on the role of women’s enterprise development in modern times. Through establishing women’s enterprise as an aesthetic of good institutions rooted in the microcredit movement of the late twentieth century but with expanded resurgence into the global North in the aftermath of the 2008 financial crisis, I illustrate how female (micro)enterprise programs afforded moral legitimacy to international organizations, NGOs, and later corporations, financial institutions, and states in ways that downplayed individual and systemic empowerment.

The potential impact of social media use on the development of entrepreneurial intention has received little attention. In addressing this gap, research reported herein extends entrepreneurial intention literature by explicitly incorporating social media use. Conceptual Articles Are Important for Theory Building but the Special Challenges of Developing Conceptual Articles on Entrepreneurship Has Not Been Fully Considered. We Begin to Fill This Gap by Discussing the Nature of Conceptual Articles on Entrepreneurship, Particularly Those Geared for Publication in Entrepreneurship Theory and Practice. We suggest a new category of “rogue entrepreneurship,” that describes entrepreneurial activity where the core business idea violates established or expert consensus, to be contrasted with “conforming entrepreneurship,” where it does not. There are large entrepreneurial rents hidden behind a bulwark of expert consensus that predicts doom for a venture based upon a rogue and unlikely claim. The “rogue” cases, where the predominant assessment context is different from the entrepreneur’s, result in broad skepticism against the entrepreneurial claim. The benefits of entrepreneurial mentorship are well documented, but there is limited research on how entrepreneurs connect with mentors, especially in digital settings. We partnered with an online platform that connects entrepreneurs to potential mentors to conduct a field experiment in online mentoring. Drawing on literature on entrepreneurial mentorship and Social Cognitive Theory, we compared the effects of three interventions on the likelihood of reaching out and making a connection with a mentor in a digital setting. While the market-based approach places hope on entrepreneurship as a major impetus to drive the underdeveloped economy, the performance of entrepreneurial businesses and their impact on poverty reduction are sometimes below expectations. Purpose: In 2023, the New England Journal of Entrepreneurship (NEJE) reached its 25th anniversary.To commemorate this major milestone as well as entrepreneurship’s growth as an academic field, the study employs bibliometric methods to provide key trends and research suggestions for entrepreneurship scholars using all original research published in the journal.

Design/methodology/approach: The authors perform two predominant bibliometric techniques, performance analysis and science mapping, using all 251 articles published by NEJE from1998 to 2022.

Business leaders are concerned with inadequate innovation performance, as innovation is a significant driver of business growth. Grounded in entrepreneurial leadership, the purpose of this qualitative multi-case study was to explore entrepreneurial leadership strategies that some healthcare business leaders used to catalyze innovation performance.
