Loyalty Loses Ground To Market Freedom In The U.S. Supreme Court, Daniel Harris

William & Mary Business Law Review

In the last decade, the U.S. Supreme Court has taken a much less moralistic and much more market-oriented approach to questions of fiduciary loyalty. In cases involving fiduciaries with conflicts of interest, the Court has shifted the burden of proof to the party claiming unfair treatment, thereby protecting deals and making loyalty harder to enforce. The Court has also struck down or narrowly construed laws designed to prevent disloyalty by fiduciaries on the theory that broad prohibitions on business conduct encroach on constitutionally protected freedoms.

Trade secret theft is a costly and ongoing risk to many businesses. As the two most populous states, California and Texas are home to numerous businesses that own trade secrets. Although civil remedies afford one source of relief when a trade secret has been stolen or disclosed, collecting on a judgment may be impossible due to the Homestead laws in both states, which effectively render the defendants judgment proof. During the Financial Crisis of 2007–2008, the Treasury injected an enormous amount of capital and held equity in 707 financial institutions to stabilize the U.S. financial system. The government’s large-scale ownership of banks alarmed the U.S. banking sector. The mainstream opinion in the United States strongly opposed this practice, mostly due to the distrust of the government and the fear that government intervention would jeopardize private shareholders’ interests. Later developments, including the Treasury’s quick exit from its holdings and the Dodd-Frank Act’s declaration of the end of bailouts, suggest that the U.S. government eventually succumbed to the mainstream opinion.

This study investigates both theoretically and empirically the economic impact of collaborative operation between container carriers. Using the property of superadditivity of the Leontief production function, this study aims to demonstrate that the utilization rate of production factors will improve when liner carriers collaboratively provide services through a strategic alliance. Attorneys play a critical role in remedying the problem of sexual assault in American industry, but the legal profession does not consistently police itself regarding such issues.

In 2002, the American Bar Association established a model ethical rule prohibiting attorneys from entering into sexual relationships with a client unless the sexual relationship existed at the time the attorney-client relationship began. As of 2019, twenty states plus the District of Columbia have failed to adopt the model rule or substantially similar prohibitions. We use a Factor-Augmented VAR (FAVAR) model to investigate the effectiveness of monetary policy in China. As the Chinese economy is an open economy, our FAVAR model divides the macroeconomic variables into three groups. The first group contains measures of external shock to Chinese economy while others groups contain the measure of output and price. This approach allows factors to have an economic interpretation. We estimate our model with the maximum likelihood technique and that an increase in the change of money supply "Divisia M2"has substantial and direct impact on Chinese economic activity and inflation. Merit-based aid is known to increase college attendance and completion. By altering the economic costs of higher education and providing incentives for academic excellence such programs increase the educational attainment of student populations. In a similar vein, West Virginia’s college scholarship program, PROMISE has been found to improve educational outcomes of college attendees and facilitate on-time degree completion among scholarship recipients. However, little is known about the scholarship’s impact on college-going rates. For a state with historically low rates of college attendance this is a pertinent question. Foreign Aid Allocation And Conflict In Sub-Saharan Africa: A Spatial Analytical Approach, Yi Duan

This project uses geographic information systems (GIS) skills to test the effect of foreign aid on conflict occurrences and fatalities at local level in Sub-Saharan Africa. Using lagged aid variables as the instruments for current aid, negative relationship between current aid and future conflict is detected. Aid is effective to deter conflict when conflict events happening in short period or particular types of conflict events are under way. Income per capita, with night lights per capita as proxy, has non-linear impacts on conflict occurrences. Foreign aid can alleviate conflict and help Sub-Saharan countries to jump out of the low-income-conflict trap.

Implementation of Personal Health Record interoperability requires the adoption of national standards. These standards have been driven by regulation. The Center for Information Technology Leadership (CITL) estimates PHRs could result in an annual net value of nineteen-billion dollars. This is based on cost savings to healthcare providers and payers over a ten-year implementation period with an 80% U.S. adoption rate.

According to the WEF Global Competitiveness Report (2017), Germany’s infrastructure ranked eighth in the world. The public investment in Germany has increased significantly in last thirty years. The government gross fixed capital formation increased by 37% in 2018 in comparison to 1990 (German Finance Ministry, 2018). The government gross fixed capital formation in relation to nominal GDP (the investment-to-GDP ratio) was 2.6% in 2018, compared with 1.7% in 2001.These outstanding public infrastructure system and investment profiles are likely a consequences of the country’s healthy public finances, robust institutional framework, structural reforms, and continuous public investments to boost competitiveness.

Purpose: The purpose of this multiple-case study was to explore the experiences of post- 9/11 female combat veterans transitioning from military service to civilian careers, using the Schlossberg transition model factors of situation, self, social support, and strategies.

Methodology: This multiple-case study identified and interviewed post-9/11 female combat veterans transitioning from active-duty to civilian career. Respondents were purposively chosen based on specific criteria and expert panel recommendations.

Findings: Examination of case-study interview data and artifacts from the 3 post-9/11 female combat veterans indicated nine major findings:

Letters of Cleve Gilliam of the Gilliam Candy Company, “Manufacturers of ‘Blue Grass’ Brand Candies,” Paducah, Kentucky, to Edwin Larrance, Indianapolis, Indiana, whose health problems are inhibiting his work as the company’s Indiana sales representative. Gilliam complains of the decline in business and of the further difficulty of maintaining profits while supplying free sample boxes of candy. The final letter praises Larrance but terminates the company’s arrangement with him.
