This article examines how the role of transactional lawyers should change in the new world of shadow banking. Although transactional lawyers should consider the potential systemic consequences of their client's actions, their actions should be tempered by their primary duties to the client and by their responsibilities to the l,egal system more broadly.

With Amgen, the Supreme Court’s majority once again holds that inquiry into the alleged market impact of a misrepresentation is not required to invoke fraud on the market approach to causation so that the class can be certified. Rather than just leaving matters where they have been since the Supreme Court’s muddled encounter with causation in Basic Inc. v. Levinson, the Supreme Court’s most recent decision appears to relax some earlier-held tenets with respect to markets believed sufficiently efficient for fraud on the market to be invoked. Purpose – Exploring experiences of participants on an Irish active labour market programme, the purpose of this paper is to examine accounts of everyday forms of resistance to the subject positions offered in the dominant discourse of “doing employment” espoused on such schemes.

Design/methodology/approach – Employing narrative research, the process of individual opposition to established work routines is illustrated at the level of meaning, identity and self reflection by using the three-dimensional narrative inquiry space to chronicle three participants’ stories. This paper narrates the role of education/training in the career success stories of twelve women on an Irish active labour market programme, Community Employment (CE). All from lower socio-economic groups, having early school-leaving backgrounds, and, prior to CE, were long-term unemployed. CE enhances the employability of the long-term unemployed by offering work opportunities and providing education/training. Using narrative inquiry, it understands how the women (re)construct their interpretations of their career success following critical moments of change in their lives. Farm Financial Performance Of Kentucky Farms, Tarrah M. Dunaway

Theses and Dissertations--Agricultural Economics

This study examines farm financial performance of Kentucky farms using Kentucky Farm Business Management data from 1998-2010. Logit models are used to estimate the likelihood of farm characteristics affecting whether financial ratios fall into critical zones or not. The results show that large farms in terms of total gross returns and total assets are less likely to experience repayment capacity problems. Total gross returns significantly affect all five financial measures. These findings will help farmers and lenders understand what factors influence farm financial performance. Profitability migration is tested to see if the migration probabilities differ across business cycles. Migration drift …

This paper examines why physicians react differently to the introduction of healthcare information technology (IT) in the same hospital at the same time. These diverse reactions, manifested as different forms of acceptance and resistance, are interpreted within the social-historical context of physicians’ work at a large urban hospital in the USA, using Activity Theory as the theoretical lens. While prior IT research has examined patterns of “similarities” in user behaviors, we examine user “differences” and reconcile these differences within a meta-theoretic framework. To better understand the effect of emotions on formal and informal interactions in the workplace, I focus on emotional dynamics, the exchange and experience of emotions occurring within repeated interpersonal interactions. Emotional Ability (EA; how individuals perceive, use, understand, and manage their own or others’ emotions) is a key component in emotional dynamics. Specifically, I focus on the role of EA on individuals’ choices of coworkers for gaining emotional support (the receipt of empathy, caring, trust, and concern), and in turn, their occupational well-being and task performance. This research introduces a new theoretical perspective (termed the Adaptive Processing Perspective) that reexamines how consumers should think before making decisions and the optimal outcomes that result. New insights into conscious (“careful deliberation”), unconscious (“sleeping on it”), and intuitive (“going with your gut”) thought processes are provided. Across four studies, empirical evidence demonstrates that consumers can make significantly better decisions by thinking more about routine choices, using their intuition for occasional purchase decisions, and distracting themselves before making major purchase decisions. Specifically, in study 1, increased conscious thought optimized routine decision making due to increases in openness to information. In …

Stakeholders are a vital element in all complex systems problems. They are customers, users, clients, suppliers, employees, and team members. They fund the system, design it, build it, operate it, use it, maintain it, and dispose of it. While many approaches exist for classifying and determining their attitudes, these approaches stop short of evaluating stakeholders in a holistic manner. This paper closes this research gap by developing the metric of stakeholder situation influence, a measure which allows for quantitative evaluation of stakeholder influence on a given problem. LinkedIn’s goal is to help business professionals meet, make business deals, inquire about jobs, and find careers through connections with people that members already know. This research study will investigate the ethical practices of LinkedIn recruitment. Students’ awareness of the methods for effective use, as well as the damaging elements of a LinkedIn profile will be examined. LinkedIn is an effective, helpful tool for recruiting candidates and for job searching; however, the best results will come to those who use LinkedIn professionally and with caution. Our findings indicate that despite its risks, jobseekers and employers can benefit from using LinkedIn.

Sustainability: A Paradigmatic Shift In Entrepreneurship Education, Frances M. Amatucci, Nelson Pizarro, Jay Friedlander

New England Journal of Entrepreneurship

This article proposes that sustainability represents a paradigmatic shift from traditional perspectives in entrepreneurship education. This “call to action” argues that it is imperative for entrepreneurship scholars and practitioners to add sustainability to academic curricula and consulting support activities. The evolutionary development of entrepreneurship from the traditional profit-oriented perspective to sustainable entrepreneurship is described. A case study of an academic institution, which has successfully incorporated sustainability principles into its curriculum, is provided.This article is among the first that details the importance of a paradigmatic shift because “business as usual” is no longer effective in the twenty-first century.

Entrepreneurial Orientation In Public Schools: The View From New Jersey, Steven E. Phelan, Ane T. Johnson, Thorsten Semrau

New England Journal of Entrepreneurship

We utilize a sample of New Jersey schools to explore the relationship between entrepreneurial orientation (EO) and school performance. The results indicate a significant relationship between several dimensions of EO and performance after controlling for a number of relevant variables. Charter schools were found to have higher EO than traditional schools. The implications of these findings for education and entrepreneurship research are discussed.
