Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca Jan 2015

Work Made For Hire – Analyzing The Multifactor Balancing Test, Ryan G. Vacca

Law Faculty Scholarship

Authorship, and hence, initial ownership of copyrighted works is oftentimes controlled by the 1976 Copyright Act’s work made for hire doctrine. This doctrine states that works created by employees within the scope of their employment result in the employer owning the copyright. One key determination in this analysis is whether the hired party is an employee or independent contractor. In 1989, the U.S. Supreme Court, in CCNV v. Reid, answered the question of how employees are distinguished from independent contractors by setting forth a list of factors courts should consider. Unfortunately, the Supreme Court did not give further guidance on …

Creating Inclusive Workplaces In Singapore: A Corporate Guide For Companies And Hr Practitioners, Benjamin Tien Yong Wong, Muhammad Hafiz Kasman, Tye Wei Lee

Student Publications

We are a team of students from the Singapore Management University (SMU). Our team recognises that LGBT (Lesbian, Gay, Bisexual and Transgender) individuals – as with all employees – are valuable members of many organisations that operate in Singapore. We therefore believe that companies can harness the potential of stronger teams by creating diverse and inclusive workplaces for its LGBT and LGBT-affirming members. While we acknowledge that diversity and inclusion ought to proactively encompass a spectrum of strands such as gender, race and socio-economic backgrounds, management literature concerning LGBT issues in Singapore remain relatively unchartered – a gap that this …

Ryanair Holdings, Nicole Blake Tran, Jamie Perkinson, Caron Sinnenberg, Lionel Tarcia, Jeffrey S. Harrison

Robins Case Network

The crass Irish CEO of Ryanair presides over a modern miracle. Ryanair, with its ridiculously low prices and poor reputation for service, has become one of Europe’s largest and most successful airlines. Employees pay for their own training, flights are cancelled if they won’t be full enough to be profitable, and the concept of “no frills” is heartily embraced. However, some new competitors have come on the scene, and Ryanair may be forced to improve its service and reputation to keep up.

Adoption Factors Impacting Human Resource Analytics Among Human Resource Professionals, Roslyn Vargas

HCBE Theses and Dissertations

In today’s fast paced, ever-changing world, one cannot help hearing the terms Big Data and analytics. The Internet holds vast amounts of data and this data, for example in retail, is being used to predict shopping habits, current needs, trends, and more. Why should this be limited to the retail side of an organization? Today, there is a more significant push for Human Resource (HR) professionals to be strategic business partners, and, therefore, HR professionals need to work on leading, not lagging, in the area of measurements and analytics. Some organizations that have adopted the use of analytics in their …

Generation Y Perceptions Of The Traditional Career Model, Aoife Kelliher

Masters

Generation Y will be expected to play the most significant role in the work place as their careers develop and older generations retire. This study responds to Ng and Gossett’s (2013) call for further research into the values, attitudes and expectations of young people as they will emerge as leaders of tomorrow. The purpose of the study is to examine if the traditional career model …

Flexible Working: What Does It Mean To The Worker And The Workplace?, Paul Kent Jan 2015

Flexible Working: What Does It Mean To The Worker And The Workplace?, Paul Kent

Masters

Separation of work and personal life is becoming more difficult. With the advances in technology, the use of personal devices for work, the mobility of work devices and the ability to remotely work for many, this research poses a question. What does Flexible Working mean to the worker and the workplace? Legislatively, Irish workers are protected by the Organisation of Working Time Act (1997). From the evidence in this study, however, this is often a law that is disregarded and has questionable applicability in modern working life. The study looks at how the current worker manages their time and contrasts …

Adding Value For An Organisation Through Employee Engagement: A Case Study Of A Temporary Workforce, Hannah O'Shea

Theses

Over the last 10 years, the requirement for temporary workers has shown significant increases. Casual and part-time workers, on the live register, have increased during this period from 20,752 to 71,744. In March 2013 the numbers rose to 89,798, an all-time high in Ireland (Central Statistics Office, 2014). Consequently, it is becoming increasingly important to observe how organisations undertake engagement with temporary employees. This research study focusses on the employee engagement levels of a temporary agency workforce, working in an e-commerce organisation, on behalf of a third party agency. Examining The Supervisor-Similarity And Work-Family Conflict Relationship: Is Family-Supportive Supervision A Mediator?, Chela M. White-Ramsey

LSU Doctoral Dissertations

To say that interest in work-family conflict has increased is an understatement. With the number of dual-earner households increasing, the diversification of the workforce, and women quickly moving into industries that were once primarily male-dominated, the work-family literature is filled with various intonations of the concept. Drawing on insights from social identity and self-categorization theories, this dissertation examined how supervisor-subordinate demographic similarity might relate to the provision of family-supportive supervision and work-family conflict. 102 members of a professional organization dedicated to women who work in technology were surveyed to evaluate whether or not supervisor-subordinate racial and gender similarity would predict …

The dataset comprised of employees from diverse organizations who had participated in different types of organizational instructor-led classroom training programs. Confirmatory factor analyses supported the construct validity of the LTSI General and Specific Scales (N = 619). Hierarchical multiple regression analysis measured …

Mcgregor's Theory X/Y And Job Performance: A Multilevel, Multi-Source Analysis, Leanna Lawter, Richard J. Kopelman, David J. Prottas Jan 2015

Mcgregor's Theory X/Y And Job Performance: A Multilevel, Multi-Source Analysis, Leanna Lawter, Richard J. Kopelman, David J. Prottas

WCBT Faculty Publications

McGregor's Theory X/Y (1957; 1960/1985; 1966; 1967), one of the most famous theories of motivation and leadership, has had a profound effect on managerial thinking over the past fifty years. Yet the effect of X/Y attitudes on job performance has never been empirically demonstrated. The present research investigates whether X/Y attitudes and X/Y behaviors-examined as two distinct constructs-are related to job performance. Further, the present research uses a multilevel, multi-source design to examine via hierarchical linear modeling the performance effects of McGregor's (1957; 1960/1985; 1966; 1967) theorizing about managerial assumptions (and behaviors) at both individual and workgroup levels. As predicted, …

Are Employee Assistance Programs An Effective Mechanism For Preventing, Managing And Alleviating Stress In The Workplace?, Carol O'Keeffe

Theses

According to the EAP Institute (2015), the rise in litigation related to occupational illnesses in the 1980’s has spurred companies to take employee health and well-being more seriously, which, subsequently, led to a growth in Employee Assistance Programs (EAPs). In particular, the employers' liability for workplace stress continues to be one of the growth areas in Irish employment law (CIPD, 2012), ultimately placing very substantial obligations on employers (Gorry, 2015). This includes the employer’s obligation to identify risk factors, and put in place remedial mechanisms for, preventing, managing and alleviating stress in the workplace.

This dissertation focuses on examining whether …
