The purpose of this article is to establish a principled basis for restraint of judicial lawmaking. The principle is that all findings of fact, whether of legislative or adjudicative facts, must be based on evidence in the record of a case. This principle is grounded in moral philosophy. I will begin with a discussion of the relevant aspect of moral philosophy, then state and defend the principle, and finally apply it to a line of cases.

Examination Of Two Decades In Used Clothing Trade: The Case Of The United States And Selected Developed Economies, Youngji Lee, Ling Zhang, Elena E. Karpova

This research examined two decades of the U.S. used clothing exports to the world. All countries (209) were classified into four groups based on the level of economic development. Between 1996 and 2012, U.S. used clothing exports shifted away from low-income economies to high-income economies. For the first time, our research demonstrated that the majority of used clothing discarded by American consumers is exported to high-income economies instead of poorest nations of the world. Next, used clothing exports and imports by volume and value in seven high-income countries were analyzed. The high-income countries not only exported but also imported significant …

This apparel design collection combines origami techniques and digital printing to create an inspiring and faith-filled line entitled Eternal Perspective. The line was inspired by the designer's faith and the importance of always maintaining an eternal perspective. Flat patterning techniques were used to create origami garments which fold into a vortex, spiral, and diagonal stair steps in the completed garments. Two different digital prints were inspired by eternal ideas represented by images which were modified in Adobe Photoshop. Applying design process model as the framework during the creative process facilitates documenting the process in a method easy to interpret and replicate for other wearable artists or designers. In ‘The Bartered Body,’ George Greenia disentangles the complex desires and experiences of religious travellers of the High Middle Ages who knew the spiritual usefulness of their vulnerable flesh. The bodily remains of the saints housed in pilgrim shrines were not just remnants of a redeemed past, but open portals for spiritual exchange with the living body of the visiting pilgrim.

Patrol officers are experiencing high incident rates of musculoskeletal injuries particularly low back pain that has attracted the attention of researchers. The purpose of this preliminary study was to better understand the underlying risk factors of musculoskeletal issues in patrol officers. Focus group discussions, interviews, and shadowing sessions were conducted to collect data. Grounded theory methodology was used to analyze the qualitative data and a model was built based on patrol officers' experiences. The findings identified three major categories of risk factors that emerged from officers' narratives: duty gear, vehicle seat, and physical fitness. It is appropriate to note that …

In the singular search for profits, some corporations inadvertently kill humans. If this routinely occurs throughout an industry, it may no longer serve a net positive social purpose for society and should be eliminated. This article provides a path to an objective quantifiable metric for determining when an entire industry warrants the corporate death penalty. First, a theoretical foundation is developed with minimum assumptions necessary to provide evidence for corporate public purposes. This is formed into an objective quantifiable metric with publicly-available data and applied to two case studies in the U.S.: the tobacco and coal mining industries. The results …

New technology in the form of 24/7 email brings with it increased expectations of begin available, adding to the pressures of work-life balance for employees. Few studies have explored this from the perspective of the Christian pastor, and none within the Seventh-day Adventist Church (SDA) pastoral context. We extend the literature in this area by examining the impact of increased work-email on the work-life balance of SDA local church pastors. For the past two years, five departments in ISU’s College of Design collaborated with the University’s Provost, the College’s Dean, Iowa businesses, and Iowa’s Main Street program to visualize and finance an interdisciplinary masters program in Historic Preservation. With the first phase of implementation complete this breakout session reviews a study that examines 1) how university programs in the arts and applied arts can collaborate with regional businesses and existing governmental agencies to secure external funding and 2) the key characteristics and essential strategies of a successful interdisciplinary and cross disciplinary collaboration.

In this article the author assesses whether a fundamental transformation is underway in public sector (state and local government) labor relations in the United States by revisiting the arguments made by the author and Kochan and McKersie (1986) regarding the transformation of labor relations in the private sector. The author argues that the economic pressures that led to a transformation of private sector labor relations starting in the 1980s have not played a comparable role in recent developments in the public sector because of the political nature of labor relations in that sector.
