Against Bloom: A Defense Of Smithian Fellow-Feeling, Damian Thomas Masterson Jan 2020

Against Bloom: A Defense Of Smithian Fellow-Feeling, Damian Thomas Masterson

Legacy Theses & Dissertations (2009 - 2024)

In his 2016 book, Against Empathy: The Case for Rational Compassion, Paul Bloom argues that “if we want to be good caring people, if we want to make the world a better place, then we are better off without empathy.” I’ve specifically chosen this formulation of Bloom’s position because it gets at the issue I will most directly challenge him on - that we would, or even could, be better off without empathy. The position I will defend is that our empathy plays an indispensable role in the development of our moral conscience, and an ongoing role in the cultivation …

The Obligation Of Promises, Toan Tran Jan 2020

The Obligation Of Promises, Toan Tran

Legacy Theses & Dissertations (2009 - 2024)

In my dissertation I discuss the historical and philosophical significance of the commonplace moral phenomenon of promising and I lay out the essential features of a promise. I claim that promises have five features; they produce a moral obligation, they are directed toward another individual who holds the right to demand action and is the one wronged in case of failure, they are successful only if there is uptake, and finally that they are self-imposed. My discussion of the puzzle created by these features starts in David Hume and extends into David Owens. The need to resolve this puzzle in …

Idealist And Materialist Approaches To Abolition In Uncle Tom's Cabin And The Daughter Of Adoption, Jillian Shea Jan 2020

Idealist And Materialist Approaches To Abolition In Uncle Tom's Cabin And The Daughter Of Adoption, Jillian Shea

Legacy Theses & Dissertations (2009 - 2024)

Sentimentalism was a popular aesthetic, moral, political, and literary movement in the 18th and 19th centuries in the United States and England, and both Harriet Beecher Stowe’s Uncle Tom’s Cabin (1852) and John Thelwall’s The Daughter of Adoption (1801) use sentimentalism in their attempts to advocate for the abolition of slavery. Scholars such as Lauren Berlant critique sentimentalism, specifically Stowe’s use of sentimentalism, for its potential to make structural problems appear as if they can be assuaged by personal change, and I situate this understanding of sentimentalism within an idealist framework, or a framework that primarily emphasizes subjectivity’s role in …

Aesthetic Education In The Anthropocene, Nathaniel Williams Jan 2020

Aesthetic Education In The Anthropocene, Nathaniel Williams

Legacy Theses & Dissertations (2009 - 2024)

This big picture study wrestles with the environmental crisis and the digital revolution, two grand themes of our century. Their grand scale is evident in their global significance, which we can anticipate will only grow in coming decades. Will these collective developments be met in such a way that democracy and individuality can be expanded and preserved? This study contributes to this query, offering a new articulation of aesthetic education that draws on a discourse reaching back to Friedrich Schiller, while incorporating many contemporary theorists. The study suggests that the environmental crisis and the digital revolution are creating a perfect …

Symposium On Justin Remhof's Nietzsche's Constructivism: A Metaphysics Of Material Objects (Routledge, 2018), Justin Remhof Jan 2020

Symposium On Justin Remhof's Nietzsche's Constructivism: A Metaphysics Of Material Objects (Routledge, 2018), Justin Remhof

Philosophy Faculty Publications

Like Kant, the German Idealists, and many neo-Kantian philosophers before him, Nietzsche was persistently concerned with metaphysical questions about the nature of objects. His texts often address questions concerning the existence and non-existence of objects, the relation of objects to human minds, and how different views of objects impact commitments in many areas of philosophy―not just metaphysics, but also language, epistemology, science, logic and mathematics, and even ethics. In this book, Remhof presents a systematic and comprehensive analysis of Nietzsche’s material object metaphysics. He argues that Nietzsche embraces the controversial constructivist view that all concrete objects are socially constructed. Reading …

Pluralistic Perspectives On Logic: An Introduction, Colin R. Caret, Teresa Kouri Kissel Jan 2020

Pluralistic Perspectives On Logic: An Introduction, Colin R. Caret, Teresa Kouri Kissel

Philosophy Faculty Publications

(First paragraph) Logical pluralism is the view that there are distinct, but equally good logics. Recent years have witnessed a sharp upswing of interest in this view, resulting in an impressive literature. We only expect this trend to continue in the future. More than one commentator has, however, expressed exasperation at the view: what can it mean to be a pluralist about logic of all things? [see, e.g., Eklund (2017); Goddu (2002); Keefe (2014)]. In this introduction, we aim to set out the basic pluralist position, identify some issues over which pluralists disagree amongst themselves, and highlight the topics at …

Effects Of Laws, Policies, And Rehabilitation Programs On African American Male Juvenile Recidivism In Southwest Georgia, Kizzie Donaldson-Richard Jan 2020

Effects Of Laws, Policies, And Rehabilitation Programs On African American Male Juvenile Recidivism In Southwest Georgia, Kizzie Donaldson-Richard

Walden Dissertations and Doctoral Studies

The laws, policies, and rehabilitation programs of Georgia’s juvenile justice system need to be revisited, especially given the documented rates of recidivism of African American male juveniles in southwest Georgia. The primary purpose of the juvenile justice system is to rehabilitate youthful offenders and to ensure that recidivism, defined as 3 or more arrests within 3 years after release, does not occur. Data have suggested that corrective behavior sanctions, rehabilitation programs, and lenient sentencing have escalated African American male juvenile recidivism rates, particularly in Dougherty and Tift Counties, Georgia. The purpose of this qualitative methodological study was to explore the …

Diminishing Powers Of Traditional Leaders: The Case For Dinka Bor Social Revival, Daniel Leek Geu

Walden Dissertations and Doctoral Studies

Many people are traumatized and most of the population are young of whom many are orphaned children of war growing up in poverty and violence. The problem is that Dinka Bor traditional leaders have lost governing powers over their people in the villages across Jonglei State. Thus, as civilians return to rebuild their lives no stable system of governance is present in the remote villages to guide and protect the people. The research question addressed …

Restructuring Old-Path Dependence In Inland Container Depots In The Nigerian Maritime Industry, Abiodun John Akinade Jan 2020

Restructuring Old-Path Dependence In Inland Container Depots In The Nigerian Maritime Industry, Abiodun John Akinade

Walden Dissertations and Doctoral Studies

The neglect of Inland Container Depots (ICDs) in the Nigerian maritime industry has been a protracted problem even though the facilities are potential sources of revenue in boosting the nation’s economy. The specific problem was the full potential of coordinated governance initiatives, such as the Maritime Anti-Corruption Network (MACN) aimed at addressing the challenge, has not been realized because of the failure of port actors to break away from old-path dependence in managing the port facilities. The purpose of this qualitative classical Delphi study was to determine how a panel of maritime industry experts views the desirability, feasibility, and importance …

Caseworkers' Perspectives On Female Juvenile Delinquent Rehabilitation Based On Age Groups, Cynthia Stephens Jan 2020

Caseworkers' Perspectives On Female Juvenile Delinquent Rehabilitation Based On Age Groups, Cynthia Stephens

Walden Dissertations and Doctoral Studies

The incidence of female juvenile delinquency is increasing and, along with it, the need for effective age-appropriate rehabilitation. The purpose of this study was to address the lack of research regarding age-appropriate rehabilitation programs for female juvenile delinquents. This basic qualitative approach was used to uncover the perspectives of experienced caseworkers on the best practices and success of age-differentiated rehabilitation programming for female juvenile delinquents. Data were collected to answer the following guiding research question: What are the perspectives of caseworkers on rehabilitation programming for female juvenile delinquents, taking into account the age differences among the incarcerated youth population? Bronfenbrenner’s …

A Qualitative Study Of Peer Reporting Of Attorney Ethical Misconduct, Jason Alan Helm

Attorney misconduct affects the victims, the justice system, and the reputation of the entire legal profession. The legal profession suffers from a negative public perception because of a perceived lapse of ethical conduct. This study was designed as a general qualitative study and its purpose was to understand the processes attorneys experience regarding peer reporting of attorney ethical misconduct. The questions examined in this study was whether attorneys were willing to report their peer's ethical misconduct and why those attorneys decided to report or not report their peer's ethical misconduct. Management Strategies For Improving Construction Industry Ethics, Stacy R. Foster

Walden Dissertations and Doctoral Studies

Despite the existence of ethical codes, ethical lapses continue to occur frequently in the construction industry. Ethical violations can have negative effects on society. The specific research problem was that many executive managers in construction companies may not understand what ethical strategies to implement to align practical ethical conduct in the construction industry with existing codes of ethics. The purpose of this qualitative, exploratory case study was to explore the perceptions of construction industry professionals on how to achieve alignment between industry ethical conduct and published codes of conduct. A conceptual framework based on Bandura’s concept of reciprocal determinism was …

Decolonizing Gender Identities In Indonesia: A Study Of Bissu ‘The Trans-Religious Leader’ In Bugis People, Petsy Jessy Ismoyo

Paradigma: Jurnal Kajian Budaya

Bhinneka Tunggal Ika is one of the pillars of Indonesia that has placed our nation and nationess to a diversity of identity, from genders, tribes, religions, to cultures. Indonesia has a long history of gender diversity that recognized various gender identities as part of the culture. Henceforth, In Indonesia, gender is not perceived in a binary way between male or female, masculine and feminine, without giving the ‘third space’ to other genders and sexuality. For example, Bugis people recognize five genders: oroané, makkunrai, calabai, calalai, and bissu, which will be examined further in this paper. In reality, a lively debate …

Ii. Contemplation And Fine Wine: Tasting With Saintsbury, Schopenhauer, And Pater, Charles S. Taylor

Wine Journey: Tasting Dwelling Learning at The Kitchen Table

Iii. Tasting Dwelling Thinking: Tasking Wine Thinking About Being With Heidegger, Charles S. Taylor Jan 2020

Iii. Tasting Dwelling Thinking: Tasking Wine Thinking About Being With Heidegger, Charles S. Taylor

Wine Journey: Tasting Dwelling Learning at The Kitchen Table

It started simply enough. Wanting something not yet tasted I brought from the cellar a barely 6-year old 2009 Fattoria di Felsina Berardenga Chianti Classico. Had it turned the corner into its optimal drinking window? Six years is usually a bare minimum for these wines to get through their early awkwardness while reports said the 2009’s were early-maturing. A pleasant surprise, it was delightful. Chianti aroma and taste as well as the harmonious, full-spectrum profile one expects even from an entry-level Felsina Chianti were all in place. Based on that experience I opened on the next opportunity a 2009 Badia …

The Racial Offense Objection To Confederate Monuments: A Reply To Timmerman, Dan Demetriou Jan 2020

The Racial Offense Objection To Confederate Monuments: A Reply To Timmerman, Dan Demetriou

Philosophy Publications

The reply essay (1000 words) to Travis Timmerman's "A Case for Removing Confederate Monuments" in Bob Fisher's Ethics, Left and Right: The Moral Issues That Divide Us volume. In it, Demetriou explains why he thinks the mere harm from the racial offense a monument may cause does not justify removing it.

Ashes Of Our Fathers: Racist Monuments And The Tribal Right, Dan Demetriou Jan 2020

Ashes Of Our Fathers: Racist Monuments And The Tribal Right, Dan Demetriou

Philosophy Publications

In this chapter Demetriou sketches a rightist approach to monumentary policy in a diverse polity beleaguered by old ethnic grievances. He begins by noting the importance of tribalism, memorialization, and social trust. He then suggests a policy which 1) gradually narrows the gap between peoples in the heritage landscape, 2) conserves all but the most offensive of the least beloved racist monuments, 3) avoids recrimination (i.e., “keeps it positive”) and eschews ideological commentary in new monuments or revisions to old ones, 4) as much as politically feasible, recognizes only the offense of willing tribemates, and 5) responds to aesthetic and …

The Ontological Significance Of Consciousness, Corydon Diamond Jan 2020

The Ontological Significance Of Consciousness, Corydon Diamond

CMC Senior Theses

Providing a wholly physical description of consciousness in nature is an elusive process. Unlike all other physical systems, consciousness seems to be explainable only if it is considered as non-physical. However, the arguments for a materialist view of consciousness, with consciousness prioritized as a process which creates imperfect dependence relations in reality, eliminates the need for a dualist understanding of reality. Through an explanation of imperfect dependence, materialist consciousness overcomes all relevant dualist arguments, while simultaneously retaining an epistemic gap, denying the conceivability of zombies, and providing convincing explanations of seemingly dualist positions in a materialist fashion.

Why Does Aristotle Make So Much Sense? A Philosophical Analysis Of Aristotle, Kant, And Mill’S Moral Theories, Will Sileo Jan 2020

Why Does Aristotle Make So Much Sense? A Philosophical Analysis Of Aristotle, Kant, And Mill’S Moral Theories, Will Sileo

CMC Senior Theses

Throughout my experience as a student of philosophy these past four years, the philosophy that has interested me the most has been that which gives us something to take back to daily life or the ‘real world’ with us. As a result, I've been strongly drawn to ethics and pulled into the debate between the three main schools of ethics — virtue ethics, deontology, and consequentialism, with a strong affinity for virtue ethics, especially the ideas of Aristotle.

The question that I am exploring in this paper is if there is something unique about Aristotle’s virtue ethics compared to the …

Suffrage Over Suffering: How Disenfranchisement Erodes The Legitimacy Of Democratic Punishment, Kendall Hollimon Jan 2020

Suffrage Over Suffering: How Disenfranchisement Erodes The Legitimacy Of Democratic Punishment, Kendall Hollimon

CMC Senior Theses

In this thesis I analyze both retributive and consequentialist justifications for punishment to understand the foundation for disenfranchisement as punishment. I then argue that although some of these justifications can condone disenfranchisement, the practice of disenfranchising criminals damages the democratic process, thus delegitimizing the punishments that societies democratically decide to impose.

Escaping The Snowstorm: Legal Rights And Economics In The Developing World, Zane Tolchinsky Jan 2020

Escaping The Snowstorm: Legal Rights And Economics In The Developing World, Zane Tolchinsky

CMC Senior Theses

In this thesis, I seek to provide a framework for developing nations making policy-decisions about legal rights, as in the realm of Rawlsian ideal theory, prescriptions for governments not living in conditions of moderate scarcity is lacking. I first springboard off Stephen Holmes and Cass R. Sunstein’s conclusion that “all legal rights are positive,” from their book, The Cost of Rights, to argue for the value of considering the economic implications of rights protections. I then propose that Holmes and Sunstein’s conclusion means that we can think of legal rights as goods to be purchased by governments. Next, I …

Stakes-Sensitive Testimonial Injustice: Prejudicial Thresholds For Belief In Testimony Of Sexual Assault, Grace Kelleher Jan 2020

Stakes-Sensitive Testimonial Injustice: Prejudicial Thresholds For Belief In Testimony Of Sexual Assault, Grace Kelleher

CMC Senior Theses

In this thesis, I expand on Miranda Fricker’s account of epistemic injustice by advancing an additional model of testimonial injustice. This model, called stakes-sensitive testimonial injustice posits that an individual may incur an epistemic harm when his or her testimony is measured against a threshold for belief that has been unjustly influenced due to prejudiced stakes considerations on the part of the hearer. In particular, I focus on our society’s tendency to hold the statements of women who testify about their experiences of sexual assault to high thresholds for belief and posit that this tendency stems from a biased understanding …

The Road To Human Emancipation - The Moral And Political Foundations Of Markets, William Shi Jan 2020

The Road To Human Emancipation - The Moral And Political Foundations Of Markets, William Shi

CMC Senior Theses

The thesis aims to provide both a real public ideology and the legal and socioeconomic structures to realize Karl Marx’s ideal of human emancipation. Marx argues that in capitalist society, the legal and political superstructure forces the ruling class to represent its interest as the public interest, which legitimizes the massive inequality in resources and social power. To demonstrate how to realize the substantive public interest, the two parts of the thesis have two goals. The first part aims to formulate a rightful candidate to the public ideology of human emancipation, which represents the substantive public interest rather than the …

Examining The Ashley Treatment: A Case Study Of The Bioethical Implications Associated With Growth Attenuation Therapy Through The Lens Of The Capabilities Approach, Allison Hill Jan 2020

Examining The Ashley Treatment: A Case Study Of The Bioethical Implications Associated With Growth Attenuation Therapy Through The Lens Of The Capabilities Approach, Allison Hill

CMC Senior Theses

In this paper, I will be addressing the questions: what is the capabilities approach? How does this framework help us to understand how altering our – and our children’s – bodies can assist in achieving equality for minorities? Or does it instead work against accomplishing this goal? How does this framework help us to understand how altering the bodies of people with disabilities can also protects those individuals’ dignity? Or does it do the opposite?

@Usa Vs. @Realdonaldtrump: The Decline Of Democracy In 280 Characters Or Less, Bryn Edwards Jan 2020

@Usa Vs. @Realdonaldtrump: The Decline Of Democracy In 280 Characters Or Less, Bryn Edwards

CMC Senior Theses

From threats, to hate speech, to potential criminal statements, Donald Trump has made use of Twitter like no president or world leader before him. His presidency and communication strategy have been defined by his “tweetstorms” and a consequent slew of legal issues. The prolific rate of his tweeting has made large-scale analyses difficult as they quickly become dated.

Nevertheless, this thesis has aimed for a more holistic analysis by uniquely linking trends in his tweeting to its perceived social consequences, situating this work in a long line of analyses of presidential rhetoric and media strategies. Moreover, it assesses Trump’s use …

The Capabilities Approach To Metaphysical Personhood, Mohnish Shah Jan 2020

The Capabilities Approach To Metaphysical Personhood, Mohnish Shah

CMC Senior Theses

It is accepted that humans are persons, but what does this mean? Society equates personhood with legal rights, moral worth, and metaphysical status. But exactly what makes us persons and distinguishes us from non-persons? What does our conception of this distinction and the value and rights we grant to persons but not to non-persons say about the type of creature that we are?

Many philosophers have tried to define metaphysical personhood. However, this thesis argues that current accounts of metaphysical personhood are inadequate. Next, this thesis borrows and modifies Martha Nussbaum’s capabilities approach to human dignity in order to construct …
