Copyright’S Creative Hierarchy In The Performing Arts, Michael W. Carroll

Scholarly Articles in Law Reviews & Journals

Copyright law grants authors certain rights of creative control over their works. This Article argues that these rights of creative control are too strong when applied to the performing arts because they fail to take account of the mutual dependence between writers and performers to fully realize the work in performance. This failure is particularly problematic in cases in which the author of a source work, such as a play or a choreographic work, imposes content-based restrictions on how a third party may render the work in performance. This essay analyzes the Hyers Sisters, a Reconstruction-era African American sister act, and their radical efforts to transcend social limits of gender, class, and race in their early concert careers and three major productions, Out of Bondage and Peculiar Sam, or The Underground Railroad, two slavery-to-freedom epics, and Urlina, the African Princess, the first known African American play set in Africa. At a time when serious, realistic roles and romantic plotlines featuring black actors were nearly nonexistent due to the country’s appetite for stereotypical caricatures, the Hyers Sisters used gender passing to perform opposite one another as heterosexual lovers in …

Corporeal Modification In The Hollywood Musical: New Paradigms For Genre Analysis, Christopher Timothy Gullen

This project explores the trend of bodily and identity modification in the contemporary Hollywood musical and calls for a re-reading of the genre away from the standard classification, that of one strictly imbued with wistful nostalgia and heteronormativity. This work argues that several films have abrogated these traditional ideals to create a carnivalesque representation of the societal norms through a genre, and a production code that sought to preserve them. Using the work of Russian semiotician Mikhail Bakhtin, this project reveals that these films feature dark and satirical para-realities of murder, debauchery and cannibalism that act as a catharsis to …

Tokoyo: A Story of Cultural Movement is an exploration of Japanese culture through performance. The piece incorporates stylized, ritualistic, and contemporary movement. The device used to portray our research was a folk tale told solely through physical expression. Music by Japanese composers and projections of the country supported the movement and helped to tell the story of the culture.

For my Capstone project, I developed an original cabaret entitled “When You Got It, Bump It: A Lost Showgirl’s Cabaret.” The story follows Mazeppa, the lost showgirl, as she travels the vaudeville “circuit” in an attempt to regain her fame. I portray this leading character, while two other women portray her friends and co-stars. All three characters are based on perhaps some of the most famous showgirls on Broadway, Mazeppa, Tessie Tura and Electra of the 1959 musical, Gypsy.

Barbershop singing is a hobby enjoyed by hundreds of thousands of men and women across the world. We attend conventions, shows, competitions, and educational outreach programs each year at our own expense to preserve a style we truly love.

Most singers of the style are amateur musicians. This constitutes somewhat of a challenge when we consider the need for healthy singing in light of certain assumptions about the vocal technique required of the barbershop style. Most do their best to make a healthy sound but end up doing more harm than good to their own voices after a lengthy rehearsal. …

Despite the interest in and importance of producing high quality choral performance, the question "How is superior performance produced?" has not been addressed in a holistic and naturalistic way. A synthesis of previous research findings suggests that a combination of actions, interactions, relationships, and conditions produce superior choral performance. Yet a holistic examination of this multi-faceted production process has not been conducted. In order to identify all factors contributing to the production of superior performance and how these factors work together, I comprehensively examined an extreme case of superior performance. Silence: Exploring Salvatore Sciarrino’S Style Through L’Opera Per Flauto, Megan R. Lanz

The purpose of this paper is to examine the works in Salvatore Sciarrino’s (b. 1947) collection L’opera per flauto written for solo flute and to examine Sciarrino’s compositional style, focusing on his characteristic markings, creative sonorities, and other pertinent facts about pieces in the collection. The first chapter in this paper discusses the value of silence in music and how Sciarrino provides the illusion of perceived silence. Chapter Two discusses elements of Sciarrino’s compositional style and the presence of complex notation. The final chapter provides flutists with a technical guide to the seven pieces in his L’opera per flauto collection. …

Environmental psychologists, like Robert Gifford who study transactions between individuals and their physical settings, maintain that as an individual's environment is changed, the environment also changes his/her behavior and experience. (Gifford, 2002) Like other segments of a theatrical setting, manipulation of the environment can enhance or constrain a broad range of audience actions from traditional theatre audiences to shoppers in a mall or guests at a wedding. Conceived by Belasco and filtered through Puccini, the characters in La fanciulla del West exhibit a diversity that is unusual even for an opera with an exotic setting: Mexicans, Australians, and European-Americans of various backgrounds reinvent themselves in a new land of seemingly endless possibilities, while the area's native inhabitants struggle to survive. California's multi-cultural population as understood by Belasco, by his Broadway audience, and by Puccini and his operatic audience create compound layers of difference that both focus and obscure the racial and ethnic hierarchies that played out in the 1840s and 50s.
