M’Culloch v. Maryland is rightly regarded as a landmark opinion, one that affirmed the ability of Congress to exercise implied powers, articulated a rule of deference to Congressional judgments about whether given legislative actions were in fact “necessary,” and limited the ability of the states to impair or restrict the operations of the federal government. Most scholarly discussions of the case and its legacy emphasize these aspects of the decision. Less common are attempts to place M’Culloch within the ebb and flow of the Marshall Court and the political and social realities of the time. So, for example, very few …

A century ago, on May 21, 1919, the US House of Representatives voted difinitively (304 to 89) in support of women’s suffrage. Two weeks later, Wisconsinite Belle La Follette sat in the visitors’ gallery of the US Senate chamber. She “shed a few tears” when it was announced that, by a vote of 56 to 25, the US Senate also approved the Nineteenth Amendment, sending it on to the states for ratification.¹ For Belle La Follette, this thrilling victory was the culmination of a decades-long fight. The im(migration) and refugee crisis that are being exacerbated under the Trump administration, is a manifestation of empire-building and the long history of colonization of the Global South. A Marxist-humanist perspective recognizes these as consistent aspects of a clearly racist global capitalism that functions in the interest of multibillion dollar U.S.–based corporations and increasingly transnational corporations. Trade agreements, international economic policy, political intervention, invasion or the threat of these, often secure corporate interests in specific countries and regions. The authors use critical discourse analysis to examine the discourses around Mexican, Central American, and Syrian im(migrants) and refugees as examples of …

The Cold War in Latin America had marked consequences for the region’s political and economic evolution. From the origins of US fears of Latin American Communism in the early 20th century to the collapse of the Soviet Union in the early 1990s, regional actors played central roles in the drama. Seeking to maximize economic benefit while maintaining independence with regard to foreign policy, Latin Americans employed an eclectic combination of liberal and anti-imperialist discourses, balancing frequent calls for anti-Communist hemispheric unity with periodic diplomatic entreaties to the Soviet bloc and the nonaligned Third World. Charles Tyng has been heralded as an American hero after the posthumous publication of his memoir, Before the Wind: The Memoir of an American Sea Captain, 1808-1833, in 1999. Recent research involving British Treasury report books from the nineteenth century suggest otherwise – that Tyng actively promoted and was engaged in the illicit trade of African captives. A Boston Brahmin, Tyng applied the lessons of his time at sea with Perkins & Company, the opium trading firm, to his occupation as an agent of notorious slave trading firms in Havana. Louisiana developed an extensive system of levees throughout the Atchafalaya Basin and along its territorial Mississippi River. This system reached its zenith on the eve of the American Civil War. It went into dramatic decline following the conflict due to the confluence of military activity, protracted irregular warfare, and neglect stemming from labor and capital revolution. These shifts intensified with the 1863 Emancipation Proclamation and finally consolidated after the ratification of Louisiana’s Constitution of 1879. Oral argument scholars like Adam Feldman have categorized the Supreme Court justices’ behavior during oral argument using the approach-based method, labeling each as one-sided, even-handed, or restrained. This approach is too narrowly constructed. Scholars sometimes categorize justices in terms of the tools they use, which include questions, hypotheticals, declarations, interruptions, tone of voice, and silence (Feldman 2018a). Neither of these methods alone produce a nuanced analysis of each justice’s actions during an individual case or across a Term. The Electoral College is used by the United States of America to elect the president every four years. It has been amended and updated several times; however, it remains an extremely convoluted and outdated system. Four presidencies were the product of incongruent elections –– the candidate won the electoral college but lost the popular vote –– and each of these presidencies resulted in immense consequences. Reforming the current electoral college will be difficult, but it is extremely vital and necessary. The American election system must be restructured so that it may fairly and adequately represent the voices of its citizens.

Apartheid South Africa represented a paradox as a US ally and human rights pariah. “Genocide Masquerading” uncovers the implications of US foreign policy on the rise and decline of apartheid, looking specifically at the 1960 Sharpeville Massacre and the 1976 Soweto Uprising. By comparing Presidents Eisenhower, Kennedy, Ford, and Carter foreign policy responses, this thesis creates a comparative analysis of how effective, or ineffective, the United States was during pivotal moments in apartheid history. This thesis will not only expand on the developing South African literature but add to the conversation of international aid, diplomacy practices, and North-South relationships.

In countless speeches and articles in La Follette’s Magazine, Belle Case La Follette urged that women needed the vote to secure “standards of cleanliness and healthfulness in the municipal home,” and because “home, society, and government are best when men and women keep together intellectually and spiritually.” This range of often mutually exclusive arguments created an inclusive big tent. However, arguing that women were qualified to vote by their roles as wives and mothers while maintaining that gender was superfluous to suffrage also contributed to an uneasy combination that would continue the conflict over women’s true nature and hinder their …

The central question this thesis addresses is how increasing federal power impacted local peoples, both politicians and otherwise. Kentucky politics was an already convoluted subject of local interconnected patronage without adding even more possible connections. The War on Poverty did just that, adding more players to the ‘game’ of Kentucky politics through numerous influential programs. This thesis closely follows the later years of the War on Poverty in Floyd County specifically to discover what changes were created in the political and social spheres.

The period of 1936-1964 in the Democratic Party was one of intense factional conflict between the rising Northern liberals, buoyed by FDR’s presidency, and the Southern conservatives who had dominated the party for a half-century. Through the lens of property rights I investigate whether this dichotomy existed at the time of the American founding. First, I examine the state constitutions and identify three clauses, common to the documents, which protect property rights. This thesis discusses the relationship between space (physical and figurative) and sovereign power, with respect to the history of the United States' immigration and boundary policy. It examines spatial organization as a social product, and simultaneously a producer of mainstream associations of illegal activity at the border with Mexico. This study tells the deep, rich story of Evelyn T. Butts, a grassroots civil rights champion in Norfolk, Virginia, whose bridge leadership style can teach and inspire new generations about political, community, and social change. Butts used neighbor-to-neighbor skills to keep her community connected with the national civil rights movement, which had heavily relied on grassroots leaders—especially women—for much of its success in overthrowing America’s Jim Crow system of segregation and suppression. The United Farm Workers formed by Cesar Chavez, Dolores Huerta, and Gilbert Padilla in 1962 has become a hallmark of success in labor history. This movement used traditional yet innovative methods of social movement strategy, eventually branding themselves as a household name. In December of 1989, the United States launched Operation Just Cause, a military invasion of the country of Panama, capturing Manuel Noriega and overthrowing his government. This research project examines how Colin Powell, Richard Cheney, James Baker, and George H.W. Bush presented Operation Just Cause in their memoirs. It attempts to determine how these senior leaders’ depictions of this invasion incorporated it into the Bush administration’s overall foreign-policy strategy. The research finds that their general approach was to present the Panama intervention as an isolated incident which had no intentional link to other major events at the time, was not …
