Genocide Studies and Prevention: An International Journal
The contemporary discourse on genocide is dominated by international criminal law, designed to punish individuals after the fact. This article proposes a legal framework derived from Public International Law and the Genocide Convention’s original purpose to prevent genocide. We clarify the conceptual and practical differences between individual criminal responsibility for the crime of genocide and State responsibility for breaches of the Genocide Convention, including distinct standards of proof and indicia of intent. We propose correctives to prevailing errors. We argue for a more appropriate and flexible standard of proof for State breaches of the Genocide Convention. We further outline a …

As transitional justice has grown as a field and as an international mandate in post-atrocity contexts over the past several decades, the memorialization of past atrocities through the construction of physical spaces of memory has increasingly been recognized as an essential aspect of this complex process. Often, these spaces of memory are touted not only as honoring past victims, but also as important tools for preventing future violence. Preventing genocide is more achievable than ever before. In the past two decades, there has been an upsurge in research and resources dedicated to genocide and mass atrocity prevention. There is now substantial knowledge of risk factors for genocide, of current countries at risk of genocide and mass atrocities, and, most importantly, a small but passionate field of practitioners dedicated to prevention. Crucial to their effectiveness, however, is the adoption of evidence-based strategies. Developing Effective Intervention: A Case Study Of Genocidal Moments In Srebrenica And Kosovo, Caleb Bryan

Despite numerous treaties and international agreements aimed at stopping genocide, genocidal mass killings continue to take place within the current international system. In order to better understand how to best combat genocide, scholars have developed two main approaches: intervention and prevention. The interventionist approach argues genocide can be stopped in its tracks through use of military force and targeted diplomacy, while the preventionist approach argues pre-emptive action is needed to truly stop genocide. Both approaches, however, have relied too heavily on hypothetical analysis of how past genocides could have turned out differently given certain factors. This study instead aims to …

Risky Times And Spaces: Settler Colonialism And Multiplying Genocide Prevention Through A Virtual Indian Residential School, Andrew Woolford, Adam Muller, Struan Sinclair

In this article, we examine how the logic of genocide prevention aligns with a settler colonial logic of elimination. We examine how the exclusion of cultural techniques of destruction from consideration contributes to the logic of elimination, and we suggest this is, in part, a structural problem built into the logic of genocide prevention. Along these lines, we interrogate linear and molar approaches to genocide prevention and propose, in addition to existing macro-level strategies, a molecular, everyday ethos of genocide prevention that is attuned to genocidal intimacies and seeks to foster anti-genocide habits and practices.
