Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. International jurisprudential interpretations of the legal definition of genocide are summarized and used as …

The promulgation of the 1969 reformed Roman Missal represents one of the most important events in modern religious history. The transition to the “Novus Ordo” Mass symbolized the end of an era of traditionalism and the beginning of an era of modern Catholicism. At first glance, this transition seemed to take the Church by storm. After over a hundred years of papal condemnations of progressive schools of thought, in the 1960s, progressive scholars were invited by Rome to oversee a general reform of the Mass, the religion’s central act of worship. Religion was almost always involved in murder and massacre during seventeenth century England, if not in its content, then at least in its interpretation. This work will support this assertion by examining multiple case studies of murder in seventeenth century England, which will simultaneously give the reader a more complete picture of the nature of homicide during the period. Specifically, the case studies consist of both homicides and infanticides, and explore the relation of the Devil to violent crime in seventeenth century England.

The Second Vatican Council (1962–65) instituted reforms in the Catholic Church that included changes in language and music employed in the liturgy, inspiring a proliferation of sung vernacular masses throughout Latin America. Drawing on archival and ethnographic research undertaken in Nicaragua and the United States, this article examines three Central American vernacular masses—Misa típica panameña de San Miguelito (1967), Misa popular nicaragüense (1969), and Misa campesina nicaragüense (1975). Each mass emanated from communities founded as part of the transnational Familia de Dios (Family of God) movement, which established programs of religious education, leadership training, and community building among impoverished …

Non-literate societies are often dependent on music for transmitting news and ideas because of music’s ability to enhance memory. Sixteenth-century reformers were aware of this, but they had to compete with secular and Roman Catholic music that often contradicted Reformed doctrine. Highly influenced by the Strasbourg-based Martin Bucer and the writings of Saint Augustine, John Calvin insisted that Biblical Psalms, set in vernacular poetry, were most appropriate for both corporate worship and private devotion. America’s legendary documentary filmmaker Frederick Wiseman shot Essene 50 years ago at the height of the commune movement in the United States. Unlike his previous institutional films which showcase an insane asylum, a public high school, an inner city police force, a hospital, and a military training school, Essene's canvas is the far less turbulent terrain of a serene and austere Benedictine monastery devoted to the love and service of God and the divine spirit. Abolitionists from the Eighteenth Century to the mid-Nineteenth Century tended to be remembered by William Wilberforce, Joseph Soul, Thomas Clarkson, Samuel Bowly, and William Lloyd Garrison. All of these men have been extremely well represented throughout scholarship and the archives. The voices that are often left out of the archives are the men and women who fought on the frontlines for their freedom. Enslaved men and women fought to the death for their freedom and are often overshadowed by White missionaries and abolitionists in the archives. At the fin de siècle the Industrial Revolution created egregious physical, emotional and spiritual conditions for American society and especially for the worker but who would come forward to alleviate those conditions? Protestants implemented their Social Gospel Movement as a proposed cure to these problems. Secular Progressives engaged in a more activist role both materially and through legislation. Both of these groups had limited successes with disappointing outcomes. The article presents a typological categorization of contemporary mega-events and their characteristics, in order to interpret the assemblages mobilized by sectors of the Catholic Church in traditional devotional pilgrimages in the northern region of Brazil. It uses ethnographic accounts of the Círio de Nazaré feast, in Belém, Pará state, Brazil, considered the largest Catholic procession in the West, in order to analyze how the promotion of this event is organized through institutional and market logics that overlap with the religious phenomenon, evincing a contemporary trend. Anthropological studies on Brazilian Catholicism traditionally focused on popular variants of this religious practice and their relationship with the official Catholicism. Encouraged by recent anthropological perspectives, which highlight the relevance of devoting researches not only on the margins, but also on the center of social practices, this paper analyzes contemporary practices of Brazilian Catholic friars and priests on health promotion. In this paper we explore data on Catholicism from the 2010 census in Brazil, as well as other data from the Center for Religious Statistics and Social Investigation. Using these statistics, we question those arguments that explain the reduction in the number of Catholics in Brazilian society as a problem in the institution’s adaptation in response to the challenges of evangelization, or as a lack of ministerial vocations to meet the religious demands of the people. The relationship between Michael Polanyi’s concept of tacit knowledge and religion is a topic that is rarely explored. Applying tacit knowledge to the study of religion and spirituality allows us to think about how we connect with the world and how we address the concern of what one feels to be true of their existence, or existential intuition. A compelling history of the 1846 Mormon expulsion from Illinois that exemplifies the limits of American democracy and religious tolerance.

When members of the Church of Jesus Christ of Latter-day Saints (known as Mormons) settled in Illinois in 1839, they had been persecuted for their beliefs from Ohio to Missouri. Illinoisans viewed themselves as religiously tolerant egalitarians and initially welcomed the Mormons to their state. However, non-Mormon locals who valued competitive individualism perceived the saints‘ western Illinois settlement, Nauvoo, as a theocracy with too much political power. Jonathan Edwards scholarship has been divided in recent years on the correct interpretation of his work. Scholars like Sang Hyun Lee and Amy Plantinga Pauw maintain that Edwards used a radically new dispositional ontology to understand the fundamental realities of nature. Oliver Crisp, Kyle Strobel, and Steve Studebaker have argued that Edwards used an essentialist ontology. I will defend the latter position and explain how it is tied to Edwards’s Trinitarianism. I argue for an interpretation of Edwards that situates him in his historical and theological context. The early modern philosophy of his day was marked by essentialist ontology. The …

This thesis seeks to describe the Jacob narrative through the lens of memory. Taking Gen 28:10-22 as a case study, the objective is to place Jacob’s visit to Bethel alongside other ancient referential claims, analyzing it for authentic memories. However, the complex nature of memory is susceptible to preservation and revision. Since Mary Queen of Scots’ execution in 1587, she has become a symbol of Scottish identity, failed female leadership, and Catholic martyrdom. Throughout the twentieth century, Mary was regularly depicted on screen (Ford, 1936; Froelich, 1940; Jarrott, 1971) as a thrice-wed Catholic queen, unable to rule her country due to her feminine nature and Catholic roots. However, with the rise of third wave feminism and postfeminism in media, coupled with the increased influence of female directors and writers, Mary’s characterization has shifted from portraying female/emotional weakness and religious sacrifice to female/collaborative strength in hardship and a struggle against patriarchal prejudice. …
