The publication of the first number (March 1941) of this periodical is a noteworthy event in the writing of Florida’s history. Professor Lewis Leary of the University of Miami is its editor, and it is issued as a bulletin of the University. Its forthcoming appearance was noted in our last issue where its board of editors and plans of publication were mentioned. Congressman James Mott was worried about his nephew. It was years since young James Holmes had left his family in Monmouth, New Jersey, to seek his fortune in Georgia. Finally, in January 1804, the congressman wrote Peter Freneau, also a Monmouth man, who had settled in the south, and had lived in Charleston since the close of the Revolution, and was now editing the influential City Gazette of that city.

If the United States Supreme Court had wanted a precedent for deciding the insular cases it might have found one in Spain’s treatment of the St. Marys-St. Johns district in 1813. When brought face to face with the question of applying the Spanish Constitution of 1812 to that area, Governor Sebastian Kindelan of East Florida, like the United States Supreme Court a century later, decided that the Constitution did not follow the flag. Higher authorities supported the governor in his decision, which, as will be shown below, was a result of the “Republic of Florida” episode of 1812-1813.

The organic act establishing the Territory of Florida was passed by Congress on March 30, 1822. Another act of Congress admitted Florida into the union of states on March 23, 1845. 2 Provision was made for either the appointment or the election, by October 1845, of all officers under the state government who succeeded to functions of officers under the territorial government. 3 The territorial period, therefore, may be said to have ended with the elections in October 1845.

Florida’s geographical peculiarities have resulted always in giving her a colorful history, and at no time has this been more evident than during the Cuban War of Independence, previous to American intervention. This period, from 1895 to 1898, has provided inspiration for many books and articles about the Cuban Juntas formed in the United States and about their filibustering enterprises. Because Florida’s ragged outline forms an arm which Uncle Sam extends into the affairs of Spanish America, it was inevitable that Cuban insurrectionists should lean heavily upon this arm after they declared their independence from Spain.
