Fixed Constitutional Meaning And Other Implausible Originalisms, Frederick M. Gedicks

Public-meaning originalists contend that judges properly interpret the Constitution only when they discover and apply its “original public meaning”—how the public understood the Constitution at the time it was adopted. Public-meaning originalism is premised on the “fixation thesis”—the meaning of any constitutional text is fixed when it is adopted. Concerns of the present, therefore, cannot affect constitutional meaning. Public meaning originalists acknowledge that the search for the fixed original meaning is not always successful, but it is always ontologically “there” to be found, even if epistemologically we sometimes fail to find it. Humankind, for Gregory of Nyssa, was poisoned through a primordial act of eating the forbidden fruit from the Garden of Eden. As a result, the toxin of sin and death has been blended into the body and soul of each person, dispersing itself throughout the component parts of their nature. If eating and drinking initiated the spiritual and physical degradation of humanity, Gregory argues, then it must also be through eating and drinking—namely, through the Eucharist—that humanity will be healed. This research focuses on the working conditions, professional lives and identities of immigrant cooks working in Paris with a view to improving, through a better understanding of these aspects, their accessibility to the workforce and potential career paths. The Portuguese explorer, Vasco da Gama (1460-1524), was the first European to sail from Portugal to India. Accolades for this achievement have long obscured the messianic motivation for the 1498 voyage, “to invade, capture, vanquish, and subdue all Saracens (Muslims) and pagans and other enemies of Christ; to reduce them to perpetual slavery; to convert them to Christianity; [and] to acquire great wealth by force of arms from the Infidels,” as sanctified by various Papal Bulls, together called “the Doctrine of Discovery” (Dum Diversas, 1452; Romanus Pontifex, 1455; Inter Caetera, 1493). Very little has been written about Ethiopian Sign Language, but the language has obvious differences from more well-studied signed languages. This thesis focuses on striking differences in reference tracking: looking at all the different referring types—lexical items, points, eye gaze, body shift, agreement, and zero reference—and their distribution throughout narrative texts. Through this process, Ethiopian Sign Language has proved different from expectations based on previously studied signed languages. This language uses loci with much more flexibility, depending on role shift alone to strongly establish loci for entities. Lichtenstein had used a neutral and cool palette and an angular design that would add a splash to even the dullest wall, and Boshkoff — a man of vision and creativity himself — knew that the Law School’s main lobby would serve as the perfect display space for the vivid print.

Like Tuesdays with Morrie, which tells the inspiring story of the relationship between writer Mitch Albom and his professor Morrie Schwartz, this narrative-reflective essay is about the equally inspirational bond between Leovino Garcia and his former professor Fr. Roque Ferriols, S.J. Their relation is a tale of friendship and companionship that manifest extraordinary commitment, fidelity, and sacrifices from both parties in their mutual care and dynamic love for one another. This essay aims to view the philosophy of Roque J. Ferriols, from a Heideggerian perspective. It argues that Ferriols’ way of philosophizing may be appreciated by illuminating it with Heidegger’s authentically historical way of philosophizing. Heidegger’s Wiederholung or creative retrieval of Ancient Greek philosophy is evident in Ferriols’ own approach in thinking meron. Both hold that genuinely historical philosophical thinking may not be reduced to a historiographical approach to philosophizing, akin to Nietzsche’s account of the antiquarian approach to history. To wit, it may be argued that Ferriols’ way of thinking is somehow similar to Heidegger’s insofar as it desires …

The relationship between European science and religion has varied considerably through time and among different traditions. This monograph attempts to catalogue one such variant by exploring the context entrance of European science into the Indian subcontinent, at the beginning of the British colonial period, by focusing on how a single religion leader drew upon European notions of science in building his reformed Vedic theology. Dayananda Saraswati (1824-83) spent much of his life traveling northern India as an itinerate ascetic and ultimately founded an intellectual lineage that was instrumental in the Indian Independence movement. 自2012年開始，作者專注研究藝術作為圖像語言的本質，以及如何利用藝術創作介入保護家庭及兒童服務，促進家暴兒童受害者的自我表達，為他們在不利的成長環境之中，提供一處或是僅有的安全空間和渠道，讓他們長期被抑壓的情緒得以適當的宣洩，作為導向他們健康成長的開步。

多年來，作者與相關服務單位的社工和專業的藝術治療師，為家暴兒童受害者特別設計連串的藝術創作計劃，所有完成的計劃都是各方專業共同積極參與的成果。最短的計劃為時半年，大多數是一年的計劃，嚴重的個案會個別跟進至年半或更長。

由2012至今，多項完成的計劃已服務超過六十位受家暴創傷的兒童，當中不少的創傷是經年累月的。本書摘錄了這些孩子的作品，當中展現了驚恐、悲傷、憤怒、迷惘和歉疚等，反映的是他們內心那紛亂不安的世界。他們當中承受的創傷或有相同，但每幅圖像都有其獨特的複雜性，非一個孩子能夠用說話和文字說得清楚的。

本書收錄的每一幅圖畫都是一種圖像書寫（image writing）。圖像書寫不需依賴兒童那尚待開發和學習的語言能力。正因如此，這些作品讓我們看見家暴兒童受害者內心那說不出的痛。

In this presentation, I address a pressing development issue in Papua New Guinea, an independent nation in the subregion of the Pacific known as Melanesia. Papua New Guinea is undisputedly the largest country in Melanesia in terms of land mass and population size. The sociocultural diversity and complex precolonial history of Papua New Guinea is highlighted as one of many contributing factors to the contemporary challenges it faces as a nation.

Chewed in the Marianas for centuries, pugua, known scientifically as Areca catechu and colloquially as betel nut, is the world’s fourth most commonly used psychoactive substance after tobacco, alcohol, and caffeine-containing beverages. It has and continues to serve numerous cultural, social, political, medicinal, and economic purposes. At the same time, health concerns are mounting against pugua due to its classification as a carcinogen by the World Health Organization, as well as to high rates of cancer among Chamorros and to federal research funds that promote an antichewing agenda.
