Turn on the television, open a book, or even walk down the street and you will no doubt notice at least one geek or nerd. Most Americans today have heard these terms, and each individual probably has his own working definition of what they mean. Unpacking those definitions, however, is tricky. What is a nerd? What is a geek? How does one identify a person as belonging to these groups? To analyze how modern culture understands geeks and nerds, one must first understand the history behind these terms. The field of neuroscience has opened up a proverbial can of worms when it comes to questions of free will and culpability. The more we know about the mind the more it appears that no one has any real choice in their actions. The ethical implications of this assumption are astronomical. Guilt and culpability come into question; it would seem unjust to punish a person for a crime if he had no choice but to commit it. While these are interesting questions for an ethicist they are impractical for society as they might affect how society functions. As such, the …

The Ethics Of Legislative Vote Trading, John Thrasher

Philosophy Faculty Articles and Research

It is argued in this article that legislative vote trading by representatives is both ethically permissible and may be ethically required in many cases. This conclusion is an implication of a thin, general account of representation that requires representatives to vote on the basis of the perceived preferences or interests of their constituents. These special duties arise from a thin account of representation and create a weak, defeasible duty for representatives to engage in what they believe will be beneficial vote trades. After establishing this claim, the article considers two objections to this duty. One is based on equating legislative …

Landscapes Of Research: Perceptions Of Open Access (Oa) Publishing In The Arts And Humanities, Julia Gross, John Charles Ryan

It is widely known now that scholarly communication is in crisis, resting on an academic publishing model that is unsustainable. One response to this crisis has been the emergence of Open Access (OA) publishing, bringing scholarly literature out from behind a paywall and making it freely available to anyone online. Many research and academic libraries are facilitating the change to OA by establishing institutional repositories, supporting OA policies, and hosting OA journals. In addition, research funding bodies, such as the Australian Research Council (ARC), are mandating that all published grant research outputs be made available in OA, unless legal and …

Lovers of the music of Frank Sinatra, Elvis Presley, Etta James, and hundreds of other recording artists whose records were made before February 15, 1972, may soon have a hard time hearing these great artists on any satellite or Internet radio service. Recently, two federal district courts have found that state laws were violated when satellite radio broadcaster Sirius XM Radio included pre-1972 sound recordings in its broadcasts without the owners’ permission, but these courts did not consider-–and the parties did not argue-–how the Supremacy Clause applies to those state law claims.
