Function Over Form: Bringing The Fixation Requirement Into The Modern Era, Megan M. Carpenter, Steven Hetcher

Law Faculty Scholarship

This Article examines the ways that contemporary creativity challenges copyright’s fixation requirement. In this Article, we identify concrete problems with the fixation requirement, both practically and in light of the fundamental purpose and policy behind copyright law, and argue for a change that would amend the fixation requirement to better function in the modern era.

Specifically, we conclude that a fair appraisal of the justifications for the fixation requirement provides little, if any, rationale for fixation except to the extent that fixation helps to separate idea from expression in determining the “metes and bounds” of creative expression. Rewriting A Murder Pamphlet: The Perspective Of Deviance In The Changeling” Appositions, Jennifer Andersen

This article focuses on the relationship between murder pamphlets and early modern drama. I first provide a brief overview of typical features of murder pamphlets. In the rest of the article, I examine a specific example of a play based on a murder pamphlet, Thomas Middleton and William Rowley’s The Changeling. Exploring the play in contrast to its pamphlet source reveals some of the key differences between the two genres: namely, the pamphlet stories typically follow a moralizing narrative that ensures that providence will bring murderers to a just punishment and repentance, whereas the play invites the audience to …

History: The former St. Mary’s Church of Ireland is one of the earliest examples of a galleried church in Dublin.Built at the beginning of the 18th century, it boasts many outstanding features, such as the Renatus Harris built organ and spectacular stained glass window.

St. Mary’s closed in 1964 and lay derelict for a number of years until it was purchased by John Keating in 1997. Following extensive restoration over a seven year period, this List 1 building finally re-opened its doors in December 2005 as John M. Keating’s Bar. Convict Voices: Women, Class, And Writing About Prison In Nineteenth-Century England, Anne Schwan

In this lively study of the development and transformation of voices of female offenders in nineteenth-century England, Anne Schwan analyzes a range of colorful sources, including crime broadsides, reform literature, prisoners' own writings about imprisonment and courtroom politics, and conventional literary texts, such as Adam Bede and The Moonstone. Not only does Schwan demonstrate strategies for interpreting ambivalent and often contradictory texts, she also provides a carefully historicized approach to the work of feminist recovery. One important question about Bronze Age potmarks is whether they are signs of writing. An affirmative answer has significant implications for our understanding of how widely a script was used within and between communities. This essay discusses two instances for which the claim of writing on ceramics has been made: Red Lustrous Wheelmade (RLWM) pottery and the “inscriptions” found at Ashkelon. In both cases, the question is whether the marks incised into these vases are to be identified as signs of the Cypro-Minoan script. On Constructing A Sonic Gangbang: System And Subversion In Gerald Barry’S Chevaux-De-Frise, Mark Fitzgerald

This paper examines Chevaux-de-frise by Gerald Barry. The work is from a transitional period in Barry's work forming a bridge between the work of the 1980s (most notably The Intelligence Park) and the more polyphonic work of the 1990s. The paper describes Barry's use of canonic devices and his manipulation of found material before making some brief links to later works from Barry's output.

To regenerate. Things break down, get destroyed. We rebuild. We rebuild our mental worlds and our material worlds. I make remnants, collect remnants, of performances and sculptures, and of process. The remnants become the work, the physical and the video, the scars and the tattoo; the evidence is subjected to understanding. What lives through us is not what happens to us, but what remnants we hold on to. What remnants we hold on to in our physical world, what remnants we hold on to in our mental world.

This article advances the thesis that proclamation in Martin Luther’s theology illumines Christ’s non-manipulative presence and sacrament his available presence. It is demonstrated that Luther’s interest in the church as Mundhaus was not advanced at the expense of an emphasis on the sacraments. Hearing and seeing as correlates of Word and sacrament advance different theological points of emphasis vis-à-vis Christ’s sovereign yet available presence. Moreover, I suggest that these themes of Word and sacrament – held in tension – roughly correspond to the following pairs in the thought of Luther: pride and despair; redemption and creation; and forensic and effective …

Beyond Luther’S Imago Dei: Imagining A Modest Humanity, Allen G. Jorgenson

In this article I use a comparative theology—engaging First Nation insights—to explore the imago Dei, and argue that this can only be affirmed by pairing it with the theme of imago mundi. I first review the imago Dei in dialogue with Genesis 1:26-27 before considering modern scholars’ various identifications of it. My point of departure is Luther, who identifies it as being without fear of death and being content with God’s favor, and as unique to homo sapiens.
