U.S. courts and policy-makers have recently authorized laws and practices that interfere with the wearing of religious modesty attire that conceals the hair or face in contexts such as courtroom testimony or driver’s license issuance. For example, in response to a court’s dismissal of the case of a woman who refused to remove her niqab in the courtroom, the Michigan Supreme Court decided that judges can exercise “reasonable control” over the appearance of courtroom parties. But what degree of control over religious attire is reasonable? The Constitution will not allow a blanket niqab removal policy based on any of the …

Free Speech And The Myth Of The Internet As An Unintermediated Experience, Christopher S. Yoo

In recent years, a growing number of commentators have raised concerns that the decisions made by Internet intermediaries — including last-mile network providers, search engines, social networking sites, and smartphones — are inhibiting free speech and have called for restrictions on their ability to prioritize or exclude content. Such calls ignore the fact that when mass communications are involved, intermediation helps end users to protect themselves from unwanted content and allows them to sift through the avalanche of desired content that grows ever larger every day. Intermediation also helps solve a number of classic economic problems associated with the Internet. …

[Excerpt] The private sector clerical work force is largely nonunion, simultaneously offering the labor movement a major source of potential membership growth and an extremely difficult challenge. Based on December 1990 data, there are eighteen million workers employed in office clerical, administrative support, and related occupations. Eighty percent of these employees are women, accounting for 30 percent of all women in the labor force. Among private sector office workers, 57 percent work in the low-union-density industry groups of services (only 5.7 percent union) and finance, insurance, and real estate (only 2.5 percent union). The post-World War II labor movement, founded on a social truce with capital and the apparent inevitability of a rising living standard, has hit a bulkhead-piercing iceberg of dramatic proportions. The global economy, economic restructuring, deregulation, and privatization have wrought destruction on U.S. unions. [Excerpt] In June 1993, the Industrial Union Department (IUD) of the AFL-CIO initiated a project to gather cases from affiliated unions that would highlight aspects of the National Labor Relations Board process deserving attention from those shaping labor law reform proposals. Based on the cases submitted, we conclude that in its current form the National Labor Relations Act serves to impede union organizing. Particularly problematic are NLRB policies that allow employers to wage no-holds-barred antiunion campaigns. Even where there are legal restrictions on specific actions, the penalties for violations are so meager that they serve no deterrent effect. The cases …

[Excerpt] It has become increasingly clear that the U.S. system of collective bargaining is no longer a realistic option for a large and growing proportion of American workers, and the situation will continue to worsen absent a major redirection of public policy. The decline in union density rates in this country is alarming to those who value and promote unionization. The extent to which this decline is due to management resistance and the failure of the law to promote collective bargaining is an important question that requires continued study and debate. Some legal theorists deny that states can conceivably act extralegally in the sense of acting contrary to domestic law. This position finds its most robust articulation in the writings of Hans Kelsen and has more recently been taken up by David Dyzenhaus in the context of his work on emergencies and legality. This paper seeks to demystify their arguments and ultimately contend that we can intelligibly speak of the state as a legal wrongdoer or a legally unauthorized actor.

[Excerpt] As part of its ongoing commitment, SEIU has devoted increasing attention to the challenge of getting local unions to embrace organizing and to allocate sufficient resources to the task. In this context, the unions 1992 national convention adopted two key resolutions: one to affirm the centrality of organizing, the second to assist leadership development with targeted educational programs. In the months following the convention, a discussion unfolded among national staff regarding appropriate steps required to assist local union leaders committed to change. [Excerpt] Bei einer länderübergreifenden Betrachtung erweist sich die Neubelebung der Arbeiterbewegung als ein komplexer Prozess des Wandels, der je nach soziopolitischem und ökonomischem Kontext variiert.Zwar lassen sich zahlreiche, vielfältige Gewerkschaftsstrategien und Ergebnisse beobachten, aber dennoch sind in den meisten der untersuchten Länder (Deutschland, Italien, Spanien, Großbritannien, USA) verschiedene Formen der strukturellen Anpassung, wie Zusammenschlüsse und Übernahmen, sowie eine „Rationalisierung“ der internen Gewerkschaftsstrukturen übliche Elemente der Revitalisierungsbemühungen. Disputes between married couples in 18th century were sometimes brought before the Jewish court ( the Beit-Din). Analysis of protocols of session which dealt with such disputes reveals facts about tensions caused by contemporary family structure and marriage customs as well as about the means which the court applied to enforce policy. The texts presented here are excerpts from one of the protocol books of the Jewish court of Altona. Altona, at the time subject to the Danish King, shared institutions with the neighboring Jewish communities in Hamburg and Wandsbeck, a union which produced several kinds of documents covering a …

The advance of technology profoundly impacts how people interact with culture as the proliferation of digital networks transforms the effects of copyright in modern societies. This paper argues that the oligopolistic conditions of content markets and the legal discourse of intellectual property law have historically enabled copyright holders to promote a limited conception of art and obscure the complexities of copyright theory. While conceptual ambiguity is inevitable in the construction of aesthetic legal categories, current practices impose too many restrictions.
