"At two o'clock on a Sunday morning, no one in their right mind would be sitting on the remainder of a sordid, disco-era recliner, casting sideways glances to four unfamiliar walls, each adorned with outdated college paraphernalia, subconsciously fighting the bitter March air that, without invitation, has ventured under the door and through the cracks of a drafty, filthy, nearly condemned apartment. Yet, here I am, in my left mind apparently. I'm slouched voluntarily in my uneasy chair, balancing on a rusty spring. . . waiting for him."

There are few motifs more ubiquitous in Renaissance and Baroque poetry than those that link falling in love to the eyes. Based at least in part on Theophrastus, as Halstead has pointed out (113-20), this notion of love describes a process by which one is captivated by looking at the object of desire, prompting an exchange of humors or spirits. If the love is returned, both lovers feel complete and satisfied, but if the object of desire does not reciprocate, one feels empty because one has given one’s soul to another while receiving nothing in return.

For many scholars, colonialism and neocolonial policies remain the root causes of Africa's numerous impediments to its progress, ranging from the persistence of poverty to the ravages of ethnic conflicts. However, the number of scholars who prefer to ascribe these impediments essentially to the persistence of traditional views and methods and to the lack of reforms radical enough to trigger a sustained process of modernization is not negligible. My position contests this either-or debate and identifies the culprit as the rise of African elitism—a phenomenon implicating the specific effect of colonialism in conjunction with internal African contributions. The term "fundamentalism" has been used to describe a host of religious movements across the globe that are militantly antimodernist, aggressively patriarchal, literalist in their reading of sacred texts, and assiduous in their efforts to draw boundaries between themselves and outsiders. While "Islamic fundamentalism" has received the most attention, particularly after the September 11, 2001, terrorist attacks, scholars and journalists have also applied the term to movements within such disparate traditions as Judaism, Sikhism, and Hinduism, as well as to various Christian groups.

In America fundamentalism is a movement within Protestantism that was organized immediately after World War I in opposition to "modernism," which included liberal theology primarily, and also Darwinism and secularism. A subgroup of evangelicalism, fundamentalism staunchly affirmed with evangelicals "fundamentals of the faith," including the deity of Christ, his virgin birth, his bodily resurrection, and his substitutionary atonement. What distinguishes fundamentalists from other evangelicals is their strident opposition to modernism. They are, to quote George Marsden, "militant anti-modernist evangelicals."

This article discusses some dimensions of the antituberculosis struggle considering initiatives originated in civil society, physicians specialized on antituberculosis treatments and the state. It studies with more detail the 1935 national campaign against tuberculosis as a modern experience of social marketing. Finally, it explores the acceptance of the antituberculosis code as an evidence of the triumph of a certain culture of hygiene.

Postmodern thinking puts severe stress on the project of legal theory. The philosophical critique of grand narratives, coupled with the radically pragmatic return to localized practices, has rendered theorizing suspect. Theory appears to be a quaint vestige of previous "bad faith" refusals to accept the finitude of human existence. But the postmodern position is even more complex, because postmodern anti-theorists tend to employ perplexing jargon and wield sophisticated and obscure concepts in their work. The postmodern puzzle is whether one can challenge theory without theorizing. Is theory defined by its practical effects, or by its refusal to become complicit in …

This article appears as part of a Symposium on "Nietzsche and Legal Theory" published by the Cardozo Law Review. It addresses connections between philosophical hermeneutics and Nietzschean critique, and the relevance that these connections might have for legal theory.

Legal practice inevitably is hermeneutical, with lawyers and judges interpreting governing legal texts and the social situations in which they must be applied. Hans-Georg Gadamer's philosophical hermeneutics describes this practice well, but he treats the question of the possibility of a critical hermeneutics in an ambiguous and under-developed manner. Consequently, Gadamer is frequently (and unfairly) accused of conventionalism and quietism. At …
