Are the Due Process and Equal Protection clauses interconnected? Justice Kennedy in Obergefell v. Hodges, the Supreme Court case holding the fundamental right to marry includes the right to a same-sex marriage, stated that they are profoundly connected in that each clause “may be instructive as to the meaning and reach of the other.” But exactly what instruction each doctrine might afford the other, Justice Kennedy did not say. An earlier Supreme Court decision, Plyler v. Doe, also suggested a connection, when the Court held unconstitutional a Texas statute baring funding for the education of undocumented children. But …

Contesting The Public Sphere: Within And Against Critical Theory, David Ingram

This chapter examines how European thinkers working from within and without the Frankfurt School of critical theory have understood the public sphere as a distinctive political category. First-generation members of the school rejected institutional democracy and mass politics as ideologies that mask domination. The succeeding generation, whose most important representative is Jürgen Habermas, rejected that diagnosis. Habermas’s more optimistic assessment of the emancipatory potential of the public sphere as a medium of rational learning sought a middle ground between critics and defenders of liberal democracy. This ambivalence provoked strong counter-reactions from systems theorists, such as Niklas Luhmann, and from adherents …

This thesis attempts to analyse and evaluate several interpretations of the Confucian Analects under the light of Gadamerian hermeneutics. In chapter 1, I explicate Gadamerian hermeneutics and analyse Gadamer’s hermeneutical view. In chapter 2, I introduce a challenge to Gadamer’s theory regarding the problem of objectivity, give Gadamer a limited defence, and then reconstruct Gadamerian hermeneutics in order to answer the challenge. Chapter 3 deals with some further concerns about the application of Gadamerian hermeneutics in terms of evaluating interpretations. Multicultural competence is necessary to provide psychological services to an increasingly diverse population (Sue, 2001). It is established that multicultural competence is important for training in psychology (Bodin et al., 2014; Diaz-Santos & Hill, 2016). Despite increased interest in recent years, multicultural competence in neuropsychology has not progressed in parallel with the focus of multiculturalism in psychology broadly (Rivera Mindt, Byrd, Saez, & Manly, 2010). Chapman & Huffman argue that humans are neither unique nor superior to other animals. I believe they are right in claiming that we are no more unique than any other species, but wrong in assuming that this means we cannot be ranked as superior. I show how this need not undermine the central aim of their target article, for superiority can only be measured with respect to a certain standard, and it’s only by using anthropocentric standards that we can be plausibly regarded as superior. Other — perhaps more neutral — standards yield different results.

The purpose of this study was to assess the degree to which servant leadership characteristics are exhibited in medical group practices, and the degree to which servant leadership characteristics correlated with measures of empathic care. This study featured an explanatory mixed methods research design embedded in appreciative inquiry. A total of 189 mid-level practitioners consisting of nurse practitioners, physician assistants, and practice mangers responded to a 32-item scale survey that featured a six-point Likert scale to measure servant leadership items and a 10-point continuous scale to assess measures of empathic care. We are failing to protect the biosphere. Novel views of conservation, preservation, and sustainability are surfacing in the wake of consensus about our failures to prevent extinction or slow climate change. We argue that the interests and well-being of non-humans, youth, and future generations of both human and non-human beings (futurity) have too long been ignored in consensus-based, anthropocentric conservation. Consensus-based stakeholder-driven processes disadvantage those absent or without a voice and allow current adult humans and narrow, exploitative interests to dominate decisions about the use of nature over its preservation for futurity of all life. Mather argues convincingly for the existence of minds in octopuses based largely on laboratory experiments. Many of these experiments are highly invasive and involve mutilation and death. Moreover, octopuses are now being hailed as a “new model” for biological research and are being enthusiastically bred in captivity, both for research and for food. We argue that the compelling evidence for mind in octopuses must be accompanied by intense scrutiny of the ethics that shape how we treat them and that the intrinsic value of their individual lives must be recognized.

The Tugalo site is a prehistoric and early historic Native American site located in northeast Georgia along the upper Savannah River basin, near the junction of Toccoa Creek and the Tugalo River. According to archaeological materials analyzed from the site it was occupied from ca. A.D. 1100 to 1600 (Anderson et al. 1995). Although archaeological investigations of the site revealed basic characteristics of its chronology and architecture, very little analysis and reporting of the skeletal remains from Tugalo has been completed. Given his attempt to physiologize aesthetics, this project attempts to show the value of the parallels and reciprocities between taste, style, beauty, and good health for scientists - especially natural scientists. Even as democratic sovereignty and globalization are increasingly seen as incompatible in theory, this chapter argues that, in some important realms, they are proving compatible in practice. As tariffs have fallen to negligible levels, trade agreements among rich countries have come to focus on reconciling regulatory differences. In many sectors, novel forms of cooperation have emerged that allow trade partners deliberately to investigate and learn from one another’s practices, eventually recognizing the equivalence of regimes that are not strictly identical — and in the process extending domestic political oversight to relations among states while often heightening domestic accountability. In this article, I examine Simondon's concept of the technical object reflecting on its analogous relationship to digital technology. Intrinsic to such an analysis is Simondon's distinction between the abstract and concrete and his specific critique of the hylomorphic model. In a deeply rich example, Simondon, contra Aristotle, mobilises the process of mould-making as an exemplar of the modulated ensemble of forces that prefigure any formations of matter through form.
