Property rights in the subsurface of land are adapting to accommodate modern activities like massive hydraulic fracturing (fracing). Property rights will need to continue adapting if they are to accommodate other developing activities like large-scale carbon capture and storage (CCS). Courts and commentators rarely approach the nature of subsurface property directly. They tend instead to discuss appropriate standards for tort liability when disputes arise—for example when artificial fissures from a frac treatment extend into and drain oil or gas from a neighbor’s land. The case law and literature generally approach unauthorized subterranean invasions as trespasses. Because the tort of trespass …

Harris County, Texas, experiences flooding almost every year, and the situation is getting worse. Uncontrolled development is leading to an increase in flooding events. This study investigated how rapid urbanization and sprawl led to a higher frequency and intensity of flooding in the Cypress Creek watershed in northern Harris County. According to urban ecology, the basis of the theoretical framework, the human actions on the environment are not just bystanders, but direct contributors as inputs. In this case, the outputs are the intensity of the flooding events caused by Hurricane Ike, the Memorial Day flood of 2016, and Hurricane Harvey. …

This dissertation examines geographic forms of evidence in the practices of landscape architects and geographers. I analyze evidence not only as an epistemic phenomenon, but as an aesthetic one, as well. Convincing an audience that the world is (or should be) one way and not another requires that knowledges be stacked, extended, and stitched together in a manner admissable to an audience. Digitally-mediated practices of archaeological data require reflexive thinking about where archaeology stands as a discipline in regard to the ‘digital,’ and where we want to go. To move toward this goal, we advocate a historical approach that emphasizes contextual source-side criticism and data intimacy—scrutinizing maps and 3D data as we do artifacts by analyzing position, form, material and context of analog and digital sources. Age of Concrete is a history of the making of houses and homes in the subúrbios of Maputo (Lourenço Marques), Mozambique, from the late 1940s to the present. Often dismissed as undifferentiated, ahistorical “slums,” these neighborhoods are in fact an open-air archive that reveals some of people’s highest aspirations. At first people built in reeds. Then they built in wood and zinc panels. And finally, even when it was illegal, they risked building in concrete block, making permanent homes in a place where their presence was often excruciatingly precarious.

This article seeks to understand and extend current understandings of intangible heritage and particularly forest-walks as such. The study is related to Swedish conditions and has been conducted in Sweden. The research is grounded in social practice theory – and the perspective of practice architectures in particular – and it draws on the work of Stephen Kemmis. Further, we view practice theory entangled with the phenomenological life-world concepts of intersubjectivity and historicity. Tree species composition and health are key attributes for rural and urban forest biodiversity, and ecosystem services preservation. Remote sensing has facilitated extraordinary advances in estimating and mapping tree species composition and health. Yet previous sensors and algorithms were largely unable to resolve individual tree crowns and discriminate tree species or health classes at this essential spatial scale due to the low image spectral and spatial resolution. Public land plays a central role in contemporary urban planning struggles. Using a comparative case study approach focused on the north-eastern US cities of Newark and New York City, we uncover patterns of land acquisition and dispossession that fit five broad and often overlapping periods in planning history: City Beautiful, metropolitan reorganization, deindustrialization, and devaluation, followed by hyper-commodification in New York City and redevelopment amidst disinvestment in Newark. Through this periodization, we find that accumulation and alienation of urban public land has largely taken place through two modes of municipalization (targeted and reactive) and two modes of privatization (community-led and …

Landscape design needs a novel value system centred on human experience of the landscape rather than simply on economic value. Design-oriented research allows us to shift the focus from mechanistic paradigms towards new sensemaking approaches that value both the sensual and the cognitive in human experience. To move in this direction, we investigate cultural and natural aspects of sensory experience in rural landscapes, arguing that: (1) rural (non-urban) regions offer diverse sensory experiences for optimising human health; and (2) spatial interconnectedness between rural and urban areas means that healthy rural regions are critical for urban development. This article illuminates contemporary land-use and disposition struggles in New York City by tracing the history of land’s passage between the private and public realms. The authors contend that government and community-controlled nonprofit organizations should govern the disposition of the city’s remaining public land supply, deliberately deploying this scarce resource to promote the well-being of the people and neighborhoods most at risk in a speculation-fueled real-estate environment.

This thesis examines the struggles of squatters and slum dwellers for housing prior to the 1973 coup in Santiago de Chile, Valparaíso, and surrounding areas, with a focus on the Frei era of the late 1960s. The work argues that severe urban overcrowding generated advocacy for housing during the rise of progressive and leftist politics in Chile. It also explores the dynamics of efforts to promote housing through the lens of the work of professionals in the fields of architecture and urban planning. Nebraska is a state that is not often viewed as affected significantly by mobility and migration. As a state, the net migration rate of 1.1 from 2015 to 2016 is fairly low compared to others like Florida (16.0) or Nevada (14.4). However, data from this report suggests that there is, in fact, substantial movement of people moving in and moving out; as well as pockets within the state where there is higher than average influx of both domestic and international migrants.

In both its historical Progressive Era roots and its contemporary manifestations, U.S. urban progressivism has evinced a contradictory tendency toward promoting the interests of capital and property while ostensibly protecting labor and tenants, thus producing policies that undermine its central claims. This article interrogates past and present appeals to urban progressive politics, particularly around housing and planning, and offers an in-depth case study of one of the most highly touted examples of the new urban progressivism: New York City’s recently adopted Mandatory Inclusionary Housing program. Researchers in many disciplines have turned to Google Street View to replace pedestrian- or carbased in-person observation of streetscapes. It is most prevalent within the research literature on the relationship between neighborhood environments and public health but has been used as diverse as disaster recovery, ecology and wildlife habitat, and urban design. Evaluations of the tool have found that the results of GSV-based observation are similar to the results from in-person observation although the similarity depends on the type of characteristic being observed. The Cully neighborhood is situated in the Northeast quadrant of Portland, Oregon. It is 2.75 square mile plot of land and home to roughly 13,000 people. In addition to being one of the most diverse neighborhoods in Portland, it is the most densely populated, with the smallest amount of parkland per capita. Over the last two decades, home value has increased 203% in Cully, compared to a 90% citywide increase. Around the world, municipalities are facing new challenges, not the least of which is climate change. This is especially true for rural communities that, for a variety of reasons, will be disproportionately affected by the climatic changes and accompanying policies or programs.
