Hidden By Sovereign Shadows: Improving The Domestic Framework For Deterring State-Sponsored Cybercrime, Eric Blinderman, Myra Din

This Article analyzes the domestic legal framework applicable to state-sponsored cybercrime. The Article describes several instances where state sovereigns perpetrated cybercrimes in the United States. It then outlines the legal framework that the US government utilizes to hold accountable those who perpetrate such crimes. This Article argues that the current legal framework does not have a deterrence effect on sovereign states engaged in such activity and that prosecutors who seek to apply the current framework against state sovereigns or who misattribute the source of such attacks could negatively impact US foreign policy. The selection of situations and cases remains one of the most vexing challenges facing the International Criminal Court (ICC) and other international criminal tribunals. Since Nuremberg, international criminal law (ICL) has experienced significant progress in developing procedural safeguards designed to protect the fair trial rights of the accused. But it continues to lag in the fairness of its selection decisions as measured against the norm of equal application of law, whether in the disproportionate focus on certain regions (as with the ICC's focus on Africa), the application of criminal responsibility only to one side of a conflict, or the continued …

Civil society, the United Nations, and others are subjecting the conduct of hostilities to increasing scrutiny. But they often lack access to internal targeting data and therefore frequently render legal judgments based on the effects of attacks or assertions that particular weapons or methods of combat are inherently unlawful. This Article analyzes the historical development of key provisions of international humanitarian law (IHL) within the framework of two perennial legal debates--that between rules and standards and that between objective and subjective tests. Information, culture, and memory centers increasingly anchor urban redevelopment projects in historically marginalized communities challenged with contemporary social and economic disparities. This dissertation situated libraries, archives, and museums within a socio-cultural context and examined the role of cultural heritage institutions in gentrification. Librarians, archivists, curators, and community advocates in Detroit, Michigan shared their viewpoints and experiences of gentrification in a legacy city. Using a modified Delphi process, the e-Delphi panel explored the need for assessing policy, service delivery, and programming in a city of color at-risk to gentrification-induced displacement.

On May 1, 2003, standing in front of a banner declaring “Mission Accomplished” aboard the warship U.S.S. Abraham Lincoln, President Bush announced an end to major combat in Iraq, referring to the war as “one victory in the war on terror.” Over seven years later, on August 31, 2010, President Obama in a televised speech also announced an end to the combat mission in Iraq. On October 21, 2011, President Obama once again reaffirmed that U.S. military personnel would be leaving Iraq, saluting the troops on their “success” and remarking on the Iraqi government’s readiness for governing. How to Make a Mudsparkler is a collection of lyrical narratives that address issues of masculinity and identity. These poems are threaded through with repeated themes— religion, place, and the nature of work—as they interrogate familial lineage with inventories of memory. The first section ruminates on family history as it is linked to formative memories. Section two continues these themes, but adds an exploration of adolescence and isolation. Finally, section three is the most immediate section as the speaker explores the fundamental questions of love, loss, and the nature of friendship.

The Woodland period was a time of changing settlement patterns, social structure, and technology. Increasing sedentism and social complexity begin during this period in the Savannah River valley and triangular bifaces enter the technological repertoire for the first time in the form of Yadkin bifaces. Yadkins are found exclusively in Middle Woodland contexts suggesting they played an important role in the changes occurring during this time. This thesis establishes the presence of the bow and arrow during the Middle Woodland period through a functional analysis of Yadkin and Eared Yadkin bifaces from South Carolina. Heroes are not born; they’re made. This article examines the commonalities in the backgrounds of people who take heroic action on behalf of others to theorize the ways in which our society can encourage citizens to prepare themselves to act heroically. In looking closely at a variety of people who have acted heroically, in a single moment or over time, we argue they have at least four crucial commonalities: They imagined situations where help was needed and considered how they would act; they had an expansive sense of empathy, not simply with those who might be considered “like them” but …

Over the past generation, the history of the state has been experiencing a much-noted renaissance, especially in France and the United States. In the United States as late as 1986, Morton Keller complained to William Leuchtenburg in the Journal of American History: “To say that ‘there is much still to be learned about the nature of the State in America’ is … a major understatement. The purpose of this study is to better understand the wholistic meaning that the Canadian Armed Forces embody for graduates of Black Bear Aboriginal Summer Training Program and the factors involved in the graduates’ decision to join the CAF after graduating Black Bear. This was done using an Indigenous Four Directions framework supported by a mixed methods cross-sectional online survey. Out of respect for the cultures involved, Elders and Cultural Advisors were consulted throughout all stages of the process. The findings suggest that perceptions formed within the Spiritual Direction are important indicators of CAF membership. Wholistically, the CAF maintains a …

This dissertation examines the development and implementation of federally funded scientific defence research in Canada during the earliest decades of the Cold War. With a particular focus on the creation and subsequent activities of the Defence Research Board (DRB), Canada’s first peacetime military science organization, the history covered here crosses political, social, and environmental themes pertinent to a detailed analysis of defence-related government activity in the Canadian North. Three contextual chapters on the history of federal defence research in Canada provide the foundation for a close study of defence research projects pursued and supported by the Canadian government. Following Joseph Stalin’s death in 1953, Nikita Khrushchev became leader of the Soviet Union and ushered in a liberalization campaign that reverberated outward to certain Eastern European nations. Canadian officials recognized that limited freedom of maneuver was conceded to certain Eastern European nations, in addition to Yugoslavia’s existing independent position. This proved important, as Communist Eastern Europe became a deliberate and considered factor in Canada’s foreign policy. Canadian Soviet policy thus evolved into a Canadian policy towards Communist Eastern Europe, equipped with various nuances. Specifically, this project examines Canadian policy with Yugoslavia, Poland, and the Soviet Union.

Posttraumatic stress disorder (PTSD) is currently known as the silent killer among combat veterans who have served in Operation Iraqi Freedom, Operation Enduring Freedom, and Operation New Dawn. Many combat veterans do not know or understand that they may be suffering from mental illness/disorders such as PTSD and turn to maladaptive behavior, resulting in criminal justice involvement (CJI). The Department of Defense (DoD) utilizes risk management to develop antiterrorism practices and policies on military installations. However, there is a gap in understanding the impact these practices have on the culture and relationship among military personnel and their civilians. Using Schneider and Ingram's conceptualization of social construction of target populations, the purpose of this ethnographic qualitative study was to understand the nature of the relationship between antiterrorism programs, culture, and risk management on a single military installation. Double-cropping soybean (Glycine max L.) after a winter annual crop is common in Kentucky. The preceding winter annual crop may affect double-crop soybean yield in Kentucky. Producers and agronomists have reported greater double-crop soybean yields when preceded by winter canola (Brassica napus L.) rather than winter wheat (Triticum aestivum L.). Explanations for these yield differences remain unresolved. Having been honored by a request to contribute to a Symposium honoring my talented friend Alafair Burke, I composed this essay describing the various ways the criminal justice system has been depicted in English-language crime fiction. This survey, necessarily highly selective, considers portrayals penned by writers from Dickens to Tana French. Various dimensions of comparison include the authors’ apparent beliefs about the rule of law (from ridiculously idealistic to uncompromisingly cynical), the characters’ professional perspectives (private detective, police officer, prosecutor, defense lawyer, judge, victim, accused), and the protagonists’ status as institutional insiders or outsiders or occupants of the uncomfortable middle. …

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์ในการศึกษาบทบาทของอนุรักษนิยมไทยที่มีต่อการกำหนดนโยบายต่างประเทศในช่วง พ.ศ. 2516 ถึง พ.ศ. 2521 อันเป็นช่วงที่เกิดการเปลี่ยนแปลงทั้งในเวทีระหว่างประเทศและในการเมืองไทย ทั้งนี้ ความไร้เสถียรภาพทางการเมืองภายในของไทยอันเกิดขึ้นจากการขยายตัวของพลังฝ่ายขวาในการต่อต้านขบวนการนักศึกษาและขบวนการเคลื่อนไหวอื่นจำนวนมากในบริบทของการเปลี่ยนแปลงทางการเมืองระหว่างประเทศในภูมิภาคหลังการประกาศถอนตัวของสหรัฐฯ ออกจากเวียดนาม ทำให้รัฐอนุรักษนิยมไทยต้องหาทางเลือกใหม่สำหรับการรักษาระบอบที่จะนำเสถียรภาพและความมั่นคงกลับคืนมา นั่นคือการตัดสินใจเลือกแนวทางการปรับนโยบายที่แตกต่างจากข้อเรียกร้องของขบวนการฝ่ายขวา โดยผลการศึกษาพบว่าอนุรักษนิยมไทยในบริบทของการกำหนดนโยบายต่างประเทศนั้นไม่มีความเป็นเอกภาพ นั่นคือ มีทั้งอนุรักษนิยมที่มีบทบาทที่สำคัญในการปรับนโยบายต่างประเทศให้สอดคล้องกับสถานการณ์ด้วยการสนับสนุนการสร้างความสัมพันธ์ทางการทูตกับกลุ่มประเทศคอมมิวนิสต์ โดยเฉพาะอย่างยิ่งสาธารณรัฐประชาชนจีน และกลุ่มประเทศอินโดจีน และอนุรักษนิยมที่เป็นฝ่ายขวา คือ ต่อต้านคอมมิวนิสต์ ต่อต้านประเทศที่เป็นคอมมิวนิสต์ และต่อต้านการปรับนโยบายต่างประเทศต่อประเทศคอมมิวนิสต์ แต่ก็ไม่ประสบความสำเร็จแต่อย่างใด จึงอาจกล่าวได้ว่าอนุรักษนิยมฝ่ายขวาเป็นปัจจัยสร้างเงื่อนไขเร่งความไร้เสถียรภาพทางการเมืองภายในของไทย และสามารถสั่นคลอนฐานะของรัฐบาลได้ แต่กลับไม่ได้มีผลต่อการกำหนดนโยบายต่างประเทศ

Ionic liquids (ILs) were investigated for functionalization of activated carbon (AC) adsorbents for the filtration of warfare toxins. Preliminary steps were taken by testing absorption capacity of neat ILs and tethering ionic liquids to the surface of AC. AC is known to have good adsorption ability for warfare agents. Functionalizing the AC with ILs could enhance the capture ability significantly. ILs have been found to be good absorbents for a variety of gaseous species. The absorption selectivity and capacity can be tuned by changing the anion-cation pair. By tethering ILs to AC, the beneficial properties of gas absorption from ILs …

Research on the student veteran population is extremely limited. The literature does tell us, however, that mental health difficulties in veterans has been present for thousands of years, and that recent warfare has led to a steady increased in posttraumatic stress and suicidality. The present study evaluated the challenges associated with transitioning from active duty to collegiate life. This included examining if psychological factors and demographic variables influence a male veteran’s ability to succeed in an academic institution. Success was defined by how well they performed in school measured by their self-reported grade point average. Other measures included the Combat Exposure Scale (CES), PTSD Checklist- Military Version (PCL-M), and Suicidal Behavior Questionnaire-Revised (SBQ-R). To what extent does the law of armed conflict (LOAC) apply to the United States military fighting in armed conflicts? Though the question seems straightforward enough, the answer is anything but. This article explains, in general, why the answer is imprecise and unsatisfying as applied to the most prevalent type of contemporary armed conflict, non-international. More specifically, this article argues that the U.S. government's primary response of claiming to apply LOAC as a matter of policy when and where that law wouldn't otherwise apply is superficially persuasive but not substantively responsive.

Unbeknownst to many, Lethal Autonomous Weapons (LAWS) have existed for decades, but they have largely been defensive and anti-material. However, as increasingly advanced defensive LAWS, such as complex swarming systems, become more prominent, states will assuredly develop ways to counter, including offensive LAWS. Certainly, the near-term developmental focus of such systems will be on operational environments in which there are relatively low risk of injury or death to civilians or untoward incidents in general, but it is a matter of when, not if, these systems will be widely used in direct combat situations. This dissertation investigates the logic for unconventional weapon non-use during wars in the 20th Century. International relations scholarship has offered two primary explanatory factors for the non-use of radiological, biological and chemical weapons: either it is a result of power concerns and utility or due to adherence to taboo norms. However, these logics are insufficient in explaining oscillations in policy, near misses and instances of actual use. Thus, I argue that normative concerns based on the rules of war as associated with Just War theory impact the decisions concerning unconventional weapons.
