Developing An International Framework For Addressing Non-State Actors In Cyberspace, Joanna C. Di Scipio Nov 2021

Developing An International Framework For Addressing Non-State Actors In Cyberspace, Joanna C. Di Scipio

Cybersecurity Undergraduate Research Showcase

On May 7, 2021, Colonial Pipeline shut down its operations following a ransomware attack by the criminal group DarkSide (Bordoff, 2021). It took five days to resume normal operations, but this short period led to panic buying, rising prices, and significant gas shortages. The attack underscores an emerging threat in the landscape of cybersecurity: critical infrastructure attacks carried out by non-state actors.

Transforming Pete’S Initial Standards: Ensuring Social Justice For Black Students In Physical Education., Brian Culp Nov 2021

Transforming Pete’S Initial Standards: Ensuring Social Justice For Black Students In Physical Education., Brian Culp

Faculty Articles

Calls to transform the initial Physical Education Teacher Education (PETE) standards to reflect social justice have garnered little attention. Recent events have magnified the racial injustices inflicted upon Black people in America and their ability to participate as full equals in a society influenced and characterized by white supremacy. Using critical race theory (CRT) as a framework, the authors examine the racial formulation of the historical and current installations of SHAPE America’s initial PETE Standards to illustrate the influence of white supremacy in PETE programs, the relationship to physical literacy, and the impact on Black students. After analysis, the authors …

And The Heat Goes On: Police Repression And The Modalities Of Power, Howard Liu, Christopher M. Sullivan Nov 2021

And The Heat Goes On: Police Repression And The Modalities Of Power, Howard Liu, Christopher M. Sullivan

Faculty Publications

Among security institutions, police occupy a unique position. In addition to specializing in the repression of dissent, police monitor society and enforce order. Yet within research studying state repression, how police institutions are used and deployed to control domestic threats remain under-explored, particularly as it relates to the dual functionality just described. In this study, we develop and test an explanation of police repression accounting for the bifurcation of Mann’s two modalities of state power: infrastructural power and despotic power. Infrastructural power allocates police resources to surveil dissidents and preemptively limit dissent’s emergence or escalation. Police deploy despotic power through …

Social Disruptions In Securities Markets - What Regulatory Response Do We Need?, Iris H-Y Chiu

Richmond Journal of Law & Technology

Direct retail trading of securities, now mobilized by emerging technology and social media, has recently experienced new popularity. Trading in certain stocks favored by retail investors using these new technologies can result in extraordinary price volatility. In late January 2021, a spectacular price hike in the GameStop stock took place in the US, resulting in a short squeeze for a number of hedge funds. In the wake of this trading event, questions remain as to whether new patterns in direct retail trading should be subject to regulatory control. In light of the concerns surrounding market manipulation, this Article examines market …

Status Of The Operator: Biologically Inspired Computing As Both A Weapon And An Effector Of Laws Of War Compliance, Carolyn Sharp Nov 2021

Status Of The Operator: Biologically Inspired Computing As Both A Weapon And An Effector Of Laws Of War Compliance, Carolyn Sharp

Richmond Journal of Law & Technology

Artificial intelligence and machine learning technology are developing in such a way that neural networks and systems architecture will soon mimic the structure and functions of the human brain. Consequently, autonomous weapons systems that rely on the limited analytical skills of today’s artificial intelligence and machine learning capabilities may soon realize human-like judgment. This biologically inspired technology known as neuromorphic computing presents a breakthrough for weapons’ capabilities, particularly in the management and analyses of battlefield environments. Future cognitive lethal autonomous weapons systems (CLAWS) could complement important roles in combat, such as accountability obligations, whereas their independent compliance to the principles …

The Jury Trial Reinvented, Christopher Robertson, Michael Elias Shammas Nov 2021

The Jury Trial Reinvented, Christopher Robertson, Michael Elias Shammas

Texas A&M Law Review

The Framers of the Sixth and Seventh Amendments to the United States Constitution recognized that jury trials were essential for maintaining democratic legitimacy and avoiding epistemic crises. As an institution, the jury trial is purpose-built to engage citizens in the process of deliberative, participatory democracy with ground rules. The jury trial provides a carefully constructed setting aimed at sorting truth from falsehood.

Despite its value, the jury trial has been under assault for decades. Concededly, jury trials can sometimes be inefficient, unreliable, unpredictable, and impractical. The COVID–19 pandemic rendered most physical jury trials unworkable but spurred some courts to begin …

Limits Of The Rule Of Law: Negotiating Afghan "Traditional" Law In The International Civil Trials In The Czech Republic, Tomas Ledvinka, James M. Donovan Nov 2021

Limits Of The Rule Of Law: Negotiating Afghan "Traditional" Law In The International Civil Trials In The Czech Republic, Tomas Ledvinka, James M. Donovan

Vanderbilt Journal of Transnational Law

Drawing on ethnographic research of judicial cases in the Czech Republic which involve the law in migrants' countries of origin, this Article outlines how multiple strategies handle encounters with the legal-cultural differences of Afghanistan in order to neutralize what may be called the "alterity" of law. The Article suggests that far from being analytical tools, concepts such as "context," "culture," and "customary" are strategically used by courts to neutralize unsettling aspects of foreign Afghan legalities. Further, it applies Leopold Pospisil's ethnological concept of legal authority as a vehicle for reinterpreting the contextual differentiation of Afghan "traditional" law as an alternative …

The Status Of State And Nonstate Actors In Postwar Hostilities: Restoring The Rule Of Law To Us Targeted Killing Operations, Claire Finkelstein Nov 2021

The Status Of State And Nonstate Actors In Postwar Hostilities: Restoring The Rule Of Law To Us Targeted Killing Operations, Claire Finkelstein

Vanderbilt Journal of Transnational Law

With the killing of Iranian general Qassim Soleimani, the United States crossed a new frontier in the use of extrajudicial lethal operations outside of armed conflict. As a state actor, Soleimani once would have been entirely off-limits as a target outside the context of a formal armed conflict between the United States and Iran. The Trump administration's choice to conduct a one-off strike on a state military leader indicates that conflicts among state adversaries are increasingly fought using the hybridized tools of the war on terror. This Article will argue that the increasing use of such techniques and the perceived …

Neurotoxicological Effects Of Chlorpyrifos And Deltamethrin On Dopamine And Acetylcholine Systems In Drosophila Melanogaster, Hala Husam Abdul Baki Nov 2021

Neurotoxicological Effects Of Chlorpyrifos And Deltamethrin On Dopamine And Acetylcholine Systems In Drosophila Melanogaster, Hala Husam Abdul Baki

Theses

Emerging evidence suggests a positive association between pesticide exposure and sporadic Parkinson's disease (PD) development. The molecular mechanisms of PD and other neurodegenerative diseases are not fully understood, which hinders the development of therapeutic agents to cure or prevent the development of such diseases. Drosophila has been widely used as a model organism to study various neurodegenerative diseases and to screen for promising therapeutic agents. The aims of this study were: (i) investigating the toxic effect of 24 hours exposure to chlorpyrifos (CPF) and deltamethrin (DLM) on the dopaminergic system and AChE activity in Drosophila melanogaster; (ii) comparing different methodologies …

Weaponizing En Banc, Neal Devins, Allison Orr Larsen Nov 2021

Weaponizing En Banc, Neal Devins, Allison Orr Larsen

Faculty Publications

The federal courts of appeals embrace the ideal that judges are committed to rule-of-law norms, collegiality, and judicial independence. Whatever else divides them, these judges generally agree that partisan identity has no place on the bench. Consequently, when a court of appeals sits “en banc,” (i.e., collectively) the party affiliations of the three-judge panel under review should not matter. Starting in the 1980s, however, partisan ideology has grown increasingly important in the selection of federal appellate judges. It thus stands to reason—and several high-profile modern examples illustrate—that today’s en banc review could be used as a weapon by whatever party …

The Effect Of Maternal Traumatic Life Events And Social Support On Maternal-Child Interaction At Child Age 3 Years, Sandra I. Madubuonwu Nov 2021

The Effect Of Maternal Traumatic Life Events And Social Support On Maternal-Child Interaction At Child Age 3 Years, Sandra I. Madubuonwu

Theses and Dissertations (ETD)

Introduction: Becoming a parent is a very important role and responsibility in people’s lives and knowing the role traumatic life events (TLEs) may play on a mother-child relationship is a very important area to explore. TLEs are known to have adverse effect on individuals; however, little is known regarding the effect of maternal TLEs on maternal-child interaction. Social support has been known to positively affect the overall wellbeing of individuals, but little is known about the effect of social support on mothers who experienced TLEs and interaction with their children thus the need for this study. This study examines the …

The Haunting Power Of Sound In Aswang, Katrina Macapagal Oct 2021

The Haunting Power Of Sound In Aswang, Katrina Macapagal

Akda: The Asian Journal of Literature, Culture, Performance

This paper examines the audibility of Aswang (2019), the first feature-length documentary that tackles Philippine President Rodrigo Duterte’s war on drugs. I locate the documentary against the audibility of terror produced by the Duterte regime, accentuated by the primary metaphor of the aswang legend where the documentary initially draws its political charge. Inspired by theories of sound and haptic listening, I argue that Aswang, through its composition of key sound elements such as the voice-over, music, and urban noise, configures an overall audibility that amplifies, rather than reduces, the humanity of the documentary’s subjects.

This included the management of natural resources, flora and fauna. Although their variety has been well documented in Old Javanese literature and inscriptions, so far there has not been an in-depth study identifying the diversity of flora and fauna of the region during …

Media And War: Vietnam And Afghanistan, Safet Zejnullahu Oct 2021

Media And War: Vietnam And Afghanistan, Safet Zejnullahu

UBT International Conference

Robert McNamara, the U.S. Secretary of Defense at the height of the Vietnam War, after a visit to the war fronts, held two press conferences, one under Tan Son Nhut Airport and the other after arriving in the country, at Andrews Air Force Base. In both he expressed optimism for victory. He told the president the truth. But it took eight years for the New York Times and the Washington Post to publish secret documents known as the Pentagon Papers, which presented the truth that the American leadership knew about the Vietnam War. This was the report of the American …

Racial Captialism And Race Massacres: Tulsa's Black Wall Street And Elaine's Sharecroppers, André Douglas Pond Cummings, Kalvin Graham Oct 2021

Racial Captialism And Race Massacres: Tulsa's Black Wall Street And Elaine's Sharecroppers, André Douglas Pond Cummings, Kalvin Graham

Law Faculty Scholarship

United States history is marked and checkered with grievous race massacres dating back to the end of slavery. These race “riots,” as they are benignly referred to in some quarters, occurred infamously in Tulsa, Elaine, Rosewood, Chicago, Detroit, and so many other lesser remembered cities. The starkest period of race massacres in the United States, including each of those just mentioned, occurred in the early 1900s, between 1919 and 1923 when Black Americans, newly empowered by service in a world war and having gained available land grants in territories where indigenous peoples were forced to abandon, began finding economic and …

Bahiga Hafez On Youtube And Feminist Archives Of Egyptian Cinema, Claire Cooley Oct 2021

Bahiga Hafez On Youtube And Feminist Archives Of Egyptian Cinema, Claire Cooley

Regards

Since YouTube’s inception in 2005, scholars of Egyptian cinema have enjoyed access to films in unprecedented ways. Remediated to the digital from a variety of formats – satellite broadcasts, VHS, celluloid – Egyptian films and other parafilmic material are available on YouTube and accessible to nearly everyone.
Despite the growing dependence of scholars on YouTube for research on Egyptian cinema, and the possibility of complicating male-centered narratives through its collections, there has been little theoretical consideration of YouTube’s role in their work.
In this essay, I draw on the idiosyncratic collection of Bahiga Hafez-related material on YouTube to argue that …

Classroom Exchanges: Big Data And The Commodification Of Educational Communication, Nicholas J. Eastman, Ethan E. Hansen Oct 2021

Classroom Exchanges: Big Data And The Commodification Of Educational Communication, Nicholas J. Eastman, Ethan E. Hansen

Education and Culture

We contrast the centrality of free and full communication, especially as it occurs in classrooms, for John Dewey’s democratic vision of the Great Community with the technologically mediated classroom communication characteristic of the COVID-19 pandemic. We focus on Google’s dominance of educational communication in particular. Drawing on Shoshana Zuboff’s concept of rendition, we argue that Google’s interest in and influence over educational communication is rooted in behavioral data analytics that captures and exploits classroom language (spoken, written, and bodily) for capitalist accumulation and social control. We conclude that Dewey’s theories of language and communication are descriptively powerful regarding the commodification …
