Uzuegbunam V. Preczewski, Nominal Damages, And The Roberts Stratagem, Michael Wells
Uzuegbunam V. Preczewski, Nominal Damages, And The Roberts Stratagem, Michael Wells
Scholarly Works
In Uzuegbunam v. Preczewski the Supreme Court held for the first time that federal-court jurisdiction exists over a § 1983 case that presents only a claim for nominal damages. As a result, such claims remain subject to adjudication even when the plaintiff’s request for prospective relief, targeting an allegedly unlawful practice, has been mooted by the government’s discontinuance of the thus-challenged behavior. In dissent, Chief Justice Roberts maintained that the majority’s ruling clashed with Article III’s “personal stake” requirement and also unwisely permitted plaintiffs to sidestep controlling jurisdictional rules by adding a meaningless claim for nominal damages to a complaint …

Childhood Reliquary De Una Catracha/Mexi Entre Nopales, Juliana Bustillo
Theses and Dissertations
Childhood Reliquary De Una CatrachaMexi Entre Nopales is a multisensory based installation consisting of three large and six medium scale mixed media paintings with performance. It is informed by my upbringing in Boyle Heights in the projects during the 90s, followed by East LA in the mid 2000s. It is the reliquary for my discomfort in institutional spaces and why I have found comfort in dystopian-like installations. This is the landscape in which I exist, regardless of where I am now. It is where I place my work. It is the context in which I celebrate the powerful delicacy of …

Holler: An Exploration Of Appalachian Performativity, David Powell
Holler: An Exploration Of Appalachian Performativity, David Powell
Theses and Dissertations
Holler: An Appatragedy is a play written in order to indict, examine and contemplate the toxic ideals of Appalachian culture. The play and the following in-depth character analysis are meant to portray a quartet of siblings who have been abandoned by their parents due to undisclosed issues (potentially addiction or mental health issues) and left to be cared for by their grandparents.
Throughout the events of the play, the culture is questioned as the elder siblings return from their lives outside Appalachia to attend the grandmother’s funeral, colliding with their brother and scheming to help their youngest brother escape from …
Multimodality And The Sociality Of Literacies: Shaping First-Year Writing Students’ Literacies Through Multimodal Approaches, Jonathon Collins
Multimodality And The Sociality Of Literacies: Shaping First-Year Writing Students’ Literacies Through Multimodal Approaches, Jonathon Collins
Online Theses and Dissertations
The research presented here focuses on approaches to developing multimodal literacies through social semiotics, digital modes of communication, and multiliteracies. Intentionally developing these literacies opens the door for first-year writing students to build upon social discourses in which they already engage and develop new modes of meaning making outside of solely alphabetic literacy. Composition textbooks today, both traditional and Open Educational Resources (OER), become more effective in developing post-process and collaborative pedagogy writing standards when they focus on multimodal literacies and practices as outlined in this research. My research addresses both the historical precedent for multimodality in the Composition classroom …
Samuel Beckett's Theory Of Repetition, Kennedy Carpenter
Samuel Beckett's Theory Of Repetition, Kennedy Carpenter
Online Theses and Dissertations
The thesis explores playwright, Samuel Beckett, and his use of repetition within four of his plays. The way in which repetition is discussed and shown in his plays displays Beckett’s own theories about repetition such as the futility and meaningless of life that repetition brings about, how repetition causes stagnation, repetition is something people are both trapped in and willing go towards for comfort, and the only way to break out of repetition is by involving others in one’s life. After literary analysis of repetition in Beckett’s works, his theories are then applied to Beckett’s personal life as a director …
Asking Appalachia: Appalachian English In The Writing Classroom, Rachel Nicole Hampton
Asking Appalachia: Appalachian English In The Writing Classroom, Rachel Nicole Hampton
Online Theses and Dissertations
This thesis combines primary and secondary research in order to make an argument about the need for better educational practices for Appalachian students. A problem is first established that, because of how Appalachian people and their culture are represented in the media, negative stereotypes are spread about those from the region who are easily identified by their use of Appalachian English. Standard English is widely taught and students are encouraged to suppress their accent and dialect in order to mediate this. However, these practices allow no room for these students to use and embrace their own language. This thesis investigates …
Wattpad As An Online Medium For Contemporary Folklore, Alisha Tess Helton
Wattpad As An Online Medium For Contemporary Folklore, Alisha Tess Helton
Online Theses and Dissertations
This project focuses its discussion within the discipline of folklore by identifying Wattpad.com as a contemporary medium of online folkloric content. Wattpad provides its users with a text-based—and sometimes multimodal—means of communication via its interface that mimics traditional communication as we know it—a means founded in orality, literacy, and the archive. Wattpad users are creating new folktales that are nuanced with elements from Wattpad’s archive, which characterizes contemporary online folklore in a way that has not been fully explored. This project serves to identify the past and present discourses that inform such a discussion while also explaining the intricacies of …

The Criticism Of Eurocentrism And International Law: Countering And Pluralizing The Research, Teaching, And Practice Of Eurocentric International Law, Makane Moïse Mbengue, Olabisi D. Akinkugbe
Articles, Book Chapters, & Popular Press
This Chapter draws on Third World Approaches to International Law (TWAIL) in examining the question: how does the research and teaching of international law in the Global South challenge Eurocentrism in international law. The Chapter focuses on the emergent activities within Global South that pluralize Eurocentric international law’s dominance in the research production, teaching, and practice arenas. The Chapter pushes against the unfair over-representation of European countries in the scholarly production and institutions of international law. To illustrate the often-underexplored regional diversity of international law outside Europe, the Chapter reflects on the contemporary roles of critical Global South scholars and …

Music: Modernist Remediation And Technologies Of Listening, Josh Epstein
Music: Modernist Remediation And Technologies Of Listening, Josh Epstein
English Faculty Publications and Presentations
Excerpt:
Ludwig van Beethoven, if not exactly a modernist, offers ample fodder for modern artists looking to defend – or expand – their turf. While producing City Lights (1928), Charlie Chaplin responded to the newly popular ‘talkies’ by proclaiming that ‘Moving pictures need sound as much as Beethoven symphonies need lyrics’ (qtd. in Crafton 1999: 296).

Masking Free Speech: The First Amendment Implications Of Masks, Clothing, And Public Health, Roy S. Gutterman
Masking Free Speech: The First Amendment Implications Of Masks, Clothing, And Public Health, Roy S. Gutterman
Loyola University Chicago Law Journal
Regulations mandating the wearing of face coverings to prevent the spread of COVID-19 have encountered resistance on a variety of grounds. This article analyzes the constitutional status of mask requirements from a free-speech perspective, differentiating between the issue of written words or logos on a mask as a form of speech, and the ability to keep one’s face uncovered as a speech right in itself. It examines the similarities and distinctions between challenges to mask mandates and other First Amendment objections to government restrictions related to clothing (or the lack thereof)—from public nudity prohibitions, to motorcycle helmet laws, to regulations …

¡Controlamos La Narrativa!: Collaborative Dramaturgy As A Tool For Latine Representation In Secondary Theatre Education, Domenika N. Moncayo
¡Controlamos La Narrativa!: Collaborative Dramaturgy As A Tool For Latine Representation In Secondary Theatre Education, Domenika N. Moncayo
Honors Undergraduate Theses
Current secondary theatre education in America places a priority on Western ideals of theatre history and practices. Latine theatre history is hardly taught, and if it is, it is touched minimally. Latine culture places an emphasis on a collective, both in theoretical and practical work. Similarly, the practice of dramaturgy itself is rarely mentioned in curriculums, rather intertwined within lessons of acting, directing, and design. This creates an imbalance in practice versus theory in theatre education. I intend to introduce the concept of collaborative dramaturgy: a form of dramaturgy where students collaborate as dramaturgs to bring about discussions about identity. …

I’M Not A Tragedy: Speaking Up About Ableist Microaggressions, Kasandra Marguerite Colwell
I’M Not A Tragedy: Speaking Up About Ableist Microaggressions, Kasandra Marguerite Colwell
Communication Senior Capstones
Have you heard of ableist microaggressions? Let me tell you about them, as someone who has experienced them. I have a bi-lateral dislocating knee condition that I was born with. I can walk, but sometimes I need additional stability or reduction of pain while getting around, in which case I tend to use a cane. I have had many othering interactions while using a mobility aid in public, whether that be a knee brace, a cane, or crutches. While it often seemed the stranger didn’t mean any harm, the question is how many invasive questions and comments from strangers can …
Extraordinary Writ Or Ordinary Remedy? Mandamus At The Federal Circuit, Jonas Anderson, Paul R. Gugliuzza, Jason Rantanen
Extraordinary Writ Or Ordinary Remedy? Mandamus At The Federal Circuit, Jonas Anderson, Paul R. Gugliuzza, Jason Rantanen
Utah Law Faculty Scholarship
Ordinarily, in federal court, only case-ending judgments can be appealed. The writ of mandamus is one exception to that so-called final judgment rule. Mandamus permits a litigant who is dissatisfied with a lower court ruling to obtain immediate reversal if, among other things, the ruling was indisputably wrong and the party seeking mandamus has no other way to get relief. This exacting standard stems from mandamus’s origin as one of the common law’s “extraordinary” writs. Federal courts of appeals typically issue mandamus once or twice per year at most.
In patent cases, however, mandamus is a remarkably ordinary form of …
Ecological Development Of Purpose Among Graduating College Students: A Mixed Methods Study, Alexis Mccarthy
Ecological Development Of Purpose Among Graduating College Students: A Mixed Methods Study, Alexis Mccarthy
West Chester University Doctoral Projects
This mixed methods study explored ecological purpose development among graduating college students at a large, public university in the Mid-Atlantic, focusing on the influence of college and familial contexts. Using Bronfenbrenner and Morris’ (2007) Process-Person-Context-Time (PPCT) model as a framework, I undertook an explanatory sequential design (Creswell & Plano Clark 2017), assigning more weight to qualitative results (quan à QUAL). I collected quantitative survey data from 110 graduating students a college of liberal arts (consisting of Art and Design, Communication and Media, English, History, Languages and Cultures, Philosophy, Theatre and Dance, and Women’s and Gender Studies majors) and then purposefully …
