Housing Equity In Golden Gate Village, Nicole White Jan 2024

Housing Equity In Golden Gate Village, Nicole White

Social Justice | Senior Theses

For generations, the African American community has faced many forms of housing discrimination that have created major inequalities in their everyday lived experiences (Lockwood, 2020). This study explores the long-lasting effects of discriminatory housing policies in creating disparate housing conditions within the public housing community in Marin City called Golden Gate Village, as well as the role of the Marin Housing Authority in practices of displacement and neglect. The methodology for the study included seven different interviews with Golden Gate Village residents to obtain knowledge about the community as well as grasp an understanding of the lived experiences of the …

The Relationship Between Internet Addiction Test Scores And Academic Achievement, Michael L. Houston, John Foubert Jan 2024

The Relationship Between Internet Addiction Test Scores And Academic Achievement, Michael L. Houston, John Foubert

Growth: The Journal of the Association for Christians in Student Development

The purpose of this study was to analyze the relationship between the Internet Addiction Test (IAT) score and academic performance in college students. The IAT measured the students’ addiction to the internet based upon their use. Academic performance was measured by grade point average (GPA). A sample of 692 traditional-aged college students from both public and private institutions was used to examine if IAT scores were related to and predictive of GPA. This study found a negative relationship between students’ IAT scores and GPAs. As IAT scores increased, students’ GPAs decreased. A better understanding of how internet addiction is related …

The Elephant In The Room: The Intersection Of Religion And Pornography Among Young Christian Men, Ryan Hewitt Jan 2024

The Elephant In The Room: The Intersection Of Religion And Pornography Among Young Christian Men, Ryan Hewitt

Growth: The Journal of the Association for Christians in Student Development

Pornography presents a unique paradox for young Christians —a culturally normative phenomenon among younger generations, yet one that most Christians morally oppose. These conflicting trends make pornography an “elephant in the room” among young Christians today—an ever-present reality, yet one often not discussed due to its sensitive nature. This work presents a recent quantitative study exploring pornography use patterns and its impact on Evangelical Christian men from both Christian academic institutions and other social and religious contexts. Results revealed high levels of religiosity and porn use, and significant correlations between religiosity, porn use, potentially problematic use, and perceived problems due …

Bespoke Regulation Of Artificial Intelligence, Brenda M. Simon Jan 2024

Bespoke Regulation Of Artificial Intelligence, Brenda M. Simon

Faculty Scholarship

The decision to regulate artificial intelligence (AI) has far reaching consequences. Determining how to address budding applications of AI technology should depend on their effects. This article describes how regulation should be carefully tailored to avoid harm while maximizing social welfare, building on Orly Lobel's taxonomy of regulatory tools. Part I examines the foundational difficulties in governing AI, including industry influence in regulation and deficiencies in enforcement. Part II elaborates on Lobel's framework, detailing the benefits and limitations of a variety of tools, such as voluntary standards, soft law mechanisms, and public-private partnerships. It describes how bringing in diverse stakeholders …

Shareholder Primacy Versus Shareholder Accountability, William W. Bratton Jan 2024

Shareholder Primacy Versus Shareholder Accountability, William W. Bratton

Seattle University Law Review

When corporations inflict injuries in the course of business, shareholders wielding environmental, social, and governance (“ESG”) principles can, and now sometimes do, intervene to correct the matter. In the emerging fact pattern, corporate social accountability expands out of its historic collectivized frame to become an internal subject matter—a corporate governance topic. As a result, shareholder accountability surfaces as a policy question for the first time. The Big Three index fund managers, BlackRock, Vanguard, and State Street, responded to the accountability question with ESG activism. In so doing, they defected against corporate legal theory’s central tenet, shareholder primacy. Shareholder primacy builds …

Counterman V. Colorado: True Threats, Speech Harms, And Missed Opportunities, R. George Wright Jan 2024

Counterman V. Colorado: True Threats, Speech Harms, And Missed Opportunities, R. George Wright

Indiana Law Journal

Some Supreme Court cases amount, at their best, to missed opportunities. The Supreme Court’s recent case Counterman v. Colorado resolved, quite dubiously, one particular issue of mens rea. In the course of doing so, however, the Court ignored a variety of clearly presented issues of even greater significance.

The Counterman case involved a state court criminal conviction for issuing a true threat of violence, or more simply, a true threat. True threats, as defined and limited by the Court, comprise a narrow, traditionally constitutionally unprotected category of speech. Nevertheless, the majority in Counterman unnecessarily and unadvisedly extended a substantial measure …

A New Criminal Response Framework: Rejecting The "Four Horsemen Of The Carceral State", George Glass Jan 2024

A New Criminal Response Framework: Rejecting The "Four Horsemen Of The Carceral State", George Glass

Indiana Law Journal

Many first-year criminal law courses begin with a discussion of the nineteenth-century English case Regina v. Dudley & Stephens. In this case, a ship was caught in a storm, and while stranded at sea, two men decided to kill and eat a younger man in order to survive. The case considers whether these two men should be punished for killing the third man, and if so, how severe should that punishment be. For many law students, this is one of the rare occasions when they are asked whether punishment is justified. Soon, they will instead be asked which of the …

Verses Turned To Verdicts: Ysl Rico Case Sets A High-Watermark For The Legal Pseudo-Censorship Of Rap Music, Nabil Yousfi Jan 2024

Verses Turned To Verdicts: Ysl Rico Case Sets A High-Watermark For The Legal Pseudo-Censorship Of Rap Music, Nabil Yousfi

Seattle University Law Review

Whichever way you spin the record, rap music and courtrooms don’t mix. On one side, rap records are well known for their unapologetic lyrical composition, often expressing a blatant disregard for legal institutions and authorities. On the other, court records reflect a Van Gogh’s ear for rap music, frequently allowing rap lyrics—but not similar lyrics from other genres—to be used as criminal evidence against the defendants who authored them. Over the last thirty years, this immiscibility has engendered a legal landscape where prosecutors wield rap lyrics as potent instruments for criminal prosecution. In such cases, color-blind courts neglect that rap …

The Racial Attitudes Of White Students At A Christian Institution, Jarad Russell Jan 2024

The Racial Attitudes Of White Students At A Christian Institution, Jarad Russell

Growth: The Journal of the Association for Christians in Student Development

This phenomenological study used semi-structured interviews to understand the lived experiences and racial attitudes of White students at a Council for Christian Colleges and Universities institution as they related to Black people. The participants were asked about their past experiences with Black people, their discussions with family about race, their present understanding of terminology related to race and racism, and their desire to support racial justice in the future. Through this study, three categories of students emerged: those that had taken steps to educate themselves on matters related to race and racism, those that were just beginning to understand issues …

More Than A Feeling: Exploring The Drivers Of Music Catalog Values, Emily Nutting Jan 2024

More Than A Feeling: Exploring The Drivers Of Music Catalog Values, Emily Nutting

CMC Senior Theses

This paper examines which characteristics of songs affect transaction price in the sale of artist’s music catalogs. My analysis tests many variables, including the number of years between the song’s release its catalog’s sale (age); the natural log of the number of Spotify streams the song has (popularity); the genre of the song; themes in the song, such as dating, violence, romance, obscenity, sadness, and feelings; and elements of the song like danceability, energy, loudness, instrumentalness (the prevalence of instrumentals relative to vocals in a song), and acousticness (the measure of sound made using instruments as opposed to electronic means). …

Developing Resilience In Early Adolescent Females, Laura Fleetwood Jan 2024

Developing Resilience In Early Adolescent Females, Laura Fleetwood

Doctor of Leadership

American stress levels are rising in almost all age groups, especially in females. The medical and mental health response is largely reactionary as practitioners scramble to address the resulting negative impacts on bodies and minds. Traditional avenues for help are overwhelmed and increasingly difficult to access. As a result, there is opportunity for Christian organizations to help communities deal with the impact of the stress epidemic.

The scale of addressing stress-related issues is initially overwhelming, but starting small and supporting a targeted group provides significant opportunity for the development of self- leadership skills and habits to proactively address it. Resilience …

Holistic And Holy: An Inward Journey Toward Healing And Wholeness, Chad Mcswain Jan 2024

Holistic And Holy: An Inward Journey Toward Healing And Wholeness, Chad Mcswain

Doctor of Leadership

There are two ubiquitous challenges to the modern church in North America: declining church attendance and the mental health crisis. This is an opportunity for the modern church to take up the missional imperative by providing access to mental health resources to meet the mental and spiritual needs of those they serve, while creating a positive connection to those who do not currently attend church.

This doctoral project seeks to address both challenges by providing a podcast called, Holistic and Holy, Listener Guide, and website that creates conversations at the intersection of mental health and spirituality. This approach uses traditional …

Using A Decision-Making Process To Determine Where To Relocate A Newer Dual Language Program, Laura C. Weiss Jan 2024

Using A Decision-Making Process To Determine Where To Relocate A Newer Dual Language Program, Laura C. Weiss

Doctor of Education (EdD)

This qualitative research study used culturally responsive protocols to provide stakeholders in a small rural community access to a district’s decision-making process. Community stakeholders were tasked with making a recommendation for relocating its dual language program (DLP). The committee identified three themes to guide their decision making: (a) keep the school in one location, (b) maintain the culture, and (c) provide access to resources. Despite intentional protocols used, barriers remained that impacted committee members’ level of engagement and participation. Key factors contributing to a lack of engagement included insufficient time and lack of trust. Additionally, native Spanish speakers (NSS) and …

The Bourgeoisie Black Church: An Analysis Of The American Black Church's Aspirations And Imagination, Alexander Robert Booker Jan 2024

The Bourgeoisie Black Church: An Analysis Of The American Black Church's Aspirations And Imagination, Alexander Robert Booker

Seattle Pacific Seminary Theses

I am a product of the Black church. It is my home, my heart, and it has helped me spiritually, financially, and emotionally in many ways throughout my life. However, the church that I love dearly and has provided me with many opportunities has also provided spaces of harm, exclusion, and the promotion of an imperialistic Christ. This tension is not a unique tension for many institutions born in America, but what I see so clearly is the tension between the Black church’s countercultural and resistant roots that started in the brush harbors of the antebellum south and into what …

Exploratory Study Of Students’ Creative Mindset, Perceived Values Of Open Educational Resources, And Flow, Hungwei Tseng, Mark Sciuchetti, Yingqi Tang

Research, Publications & Creative Work

As the awareness, benefits, and adoption of Open Educational Resources (OER) in various fields have increased, so have efforts to conduct research on its impact on students learning behaviors, experience, and engagement. However, limited research has been conducted regarding the efficacy of using OER on students’ perceived enjoyment in learning and interactions with educational materials. This study aimed to examine the relationships between creative mindset, flow experience, and perceived values of OER among 88 online undergraduate students. First, results revealed that students who have a growth-oriented creative mindset are more likely to understand and embrace OER’s intrinsic worth. Their willingness …

Research, Publications & Creative Work

This study examined the effect of creatine nitrate and caffeine alone and combined on exercise performance and cognitive function in resistance-trained athletes. In a double-blind, randomized crossover trial, twelve resistance-trained male athletes were supplemented with 7 days of creatine nitrate (5 g/day), caffeine (400 mg/day), and a combination of creatine nitrate and caffeine. The study involved twelve resistance-trained male athletes who initially provided a blood sample for comprehensive safety analysis, including tests for key enzymes and a lipid profile, and then performed standardized resistance exercises—bench and leg press at 70% 1RM—and a Wingate anaerobic power test. Cognitive function and cardiovascular …

Predicting Hurricane Evacuation Decisions With Interpretable Machine Learning Methods, Yuran Sun, Shih-Kai Huang, Xilei Zhao Jan 2024

Predicting Hurricane Evacuation Decisions With Interpretable Machine Learning Methods, Yuran Sun, Shih-Kai Huang, Xilei Zhao

Research, Publications & Creative Work

Abstract Facing the escalating effects of climate change, it is critical to improve the prediction and understanding of the hurricane evacuation decisions made by households in order to enhance emergency management. Current studies in this area often have relied on psychology-driven linear models, which frequently exhibited limitations in practice. The present study proposed a novel interpretable machine learning approach to predict household-level evacuation decisions by leveraging easily accessible demographic and resource-related predictors, compared to existing models that mainly rely on psychological factors. An enhanced logistic regression model (that is, an interpretable machine learning approach) was developed for accurate predictions by …

Unfair Discrimination Standards, Actuarial Fairness, And Insurers’ Use Of Big Data, Laura L. Arp Jan 2024

Unfair Discrimination Standards, Actuarial Fairness, And Insurers’ Use Of Big Data, Laura L. Arp

Nebraska Law Review

Technological innovations in insurance rating allow increasingly large sets of data about insureds to be collected, analyzed, and turned into rates. Consumers’ concerns about artificial intelligence can translate into mistrust that their insurance rates accurately reflect the risk they present. In response, regulatory frameworks are being developed for testing these new algorithms. When people encounter the word “discrimination,” they often register a meaning of “unfair discrimination.” However, in the insurance context, “discrimination” is a neutral term.

This Article attempts to unpack the multiple and complex facets present in the definition of unfair discrimination—and in particular proxy discrimination—as applied to insurance, …

Heads Held High And Hands Holding Hope: The Victory And Vulnerabilities Of The Indian Child Welfare Act After Haaland V. Brackeen, Mikayla Jones Jan 2024

Heads Held High And Hands Holding Hope: The Victory And Vulnerabilities Of The Indian Child Welfare Act After Haaland V. Brackeen, Mikayla Jones

Nebraska Law Review

Congress enacted the Indian Child Welfare Act (ICWA) in 1978 to mitigate the catastrophic effects of the federal government’s longstanding policy of forcibly removing Indian children from their families and tribal communities. ICWA has safeguarded Indian children and families for decades by setting minimum standards in state child welfare proceedings to prevent unwarranted removals, support family preservation and reunification, and foster cultural and community connection.

However, ICWA has faced numerous legal challenges since its implementation—often on the theory that the law discriminates against Indian children on the basis of race in violation of the Equal Protection Clause. In 2023, the …

Using A Congressional-Executive Agreement To Protect Abortion At Home And Abroad, Amanda V. Landaverde Jan 2024

Using A Congressional-Executive Agreement To Protect Abortion At Home And Abroad, Amanda V. Landaverde

Nebraska Law Review

In the Supreme Court’s decision in Dobbs v. Jackson Women’s Health, the Court rejected the existence of a constitutional right to abortion and obliterated the only federal protection of abortion. Two years after the Court’s decision, Congress has not passed federal legislation protecting abortion, and our country has no national standard on abortion access. In the meantime, in states with draconian abortion restrictions, women are forced to wait until they are at death’s door before the state allows them to have an abortion. This occurs despite the majority of Americans supporting some form of abortion access.

Although potential legislation …

The Case Law Of The Court Of Justice Of The Eu On Art. 17 Of The 1999 Montreal Convention: An Evaluation From A Comparative Perspective, Michael Chatzipanagiotis

Journal of Air Law and Commerce

This paper analyzes the case law of the Court of Justice of the European Union (CJEU) on Article 17(1) of the 1999 Montreal Convention (MC99) regarding the liability of international air carriers for death or bodily injury to passengers. The interpretational principles and methods applied by the CJEU are examined, accounting also for the particularities of the EU legal order. Furthermore, the results reached by the CJEU are compared with the case law of other jurisdictions, mainly the US, and doctrinal writings. Nonetheless, this paper does not explore the pertinent issues from a de lege ferenda perspective.

The paper concludes …
