An organizational ombudsman (or “ombuds,” used as the preferred term in this paper) is a conflict resolution specialist who works as either an employee or contractor within the organization it serves. Unlike mediators or arbitrators, ombuds work only with a designated constituency group (often employees or other stakeholders) to solve a variety of conflicts at the lowest level possible within the organization. Ombuds, while preserving the confidentiality of the information they learn, can report trends to the organization or the public. While ombuds do not have the authority to make formal policy changes or other formal decisions, their work informs …

This Note examines the United States’ federal boarding school policy, designed to eliminate Native populations, and the federal government’s efforts from June 2021 to December 2024 to acknowledge and address its harms. For 150 years, Native children were subjected to this brutal policy and were removed from their communities and placed in boarding schools. These schools were focused less on providing education and opportunity for Native students, and instead were tools to carry out a concentrated federal policy of cultural assimilation and forcible removal from Native lands. Despite state-level approval, legalization remains riddled with contradictions and obstacles, leaving businesses and policymakers struggling to navigate an unstable framework. This Note explores how regulatory negotiation, an alternative dispute resolution (“ADR”) mechanism, can address key industry challenges, particularly those arising from conflicting federal and state laws.

Arkansas is not a notable state. It is often confused with Kansas or Alabama. It is difficult for most Americans to find on a map. Perhaps Arkansas has few distinctions. However, it is the only place in the country where a tenant can be thrown in jail for missing a rental payment. The legal landscape of Arkansas is unique in many ways, primarily in its old-fashioned, even archaic, view of property law.

This Note explores the fallout of the Harrington v. Purdue Pharma decision and the uncertainty it lends to the future of bankruptcy plans and third-party releases. Specifically, it proposes potential congressional solutions that can pave a path forward for parties to seek relief for the harms they have suffered under the actions of corporations and their leaders. In the Metaphysical Disputations (1597), Francisco Suárez asserts that the human intellect, because it is imperfect, must make use of determinate mental fictions in order to know “real being” (ens reale). In this dissertation, I reconstruct why and how this should be the case. I show that the supreme imperfection of our intellect implies our embodiment, which in turn implies our inability to know any being entirely as it is in itself. To compensate for this inability, we humans must make use of both “beings of reason” (entia rationis) and “nonbeings of reason” (non entia rationis). In the process of …

This volume constitutes the final report of the large-scale salvage excavations directed by Gil Tahal on behalf of the IAA in 1993–1994 at the site of Khirbat ‘Amra, in the north-central area of the Be’er Sheva‛ Valley. The excavations revealed architectural remains and finds dated mainly to the Hellenistic until the Early Islamic periods, in addition to scantier remains or isolated finds from the Chalcolithic period, the Iron Age II and the Ottoman period. ABSTRACT Objectives: To identify risk factors for moderate-to-severe pain during intraosseous infusion (IOI) in non-cardiac arrest patients in the emergency department (ED). Secondary aims include evaluating pain trajectory across procedural stages and assessing the efficacy of a personalized pain management strategy. Methods: This mixed-methods study analyzed 220 ED patients undergoing IOI (150 retrospective, 70 prospective). The prospective cohort was randomized to standard care (n=35) or personalized pain management (n=35). Pain was quantified using the numeric rating scale (NRS) and critical-care pain observation tool (CPOT). Results: During puncture, 35.33% (53/150) reported no/mild pain. The current legal regime governing domestic military deployments was, largely, born of the Civil War. While conflict was ongoing, Congress enacted what are now a pair of statutes criminalizing military interference with federal elections. And as a coda to Reconstruction, Congress criminalized using the military as a civilian law enforcement force. Over the past 160 years, successive Congresses and Presidents have steadily chipped away at these crucial criminal-law protections. In 2024, the Supreme Court’s decision in Trump v. United States further undermined the limitations that remained.

We theoretically investigate the stationary properties of a spin-1/2 impurity immersed in a one-dimensional confined Bose gas. In particular, we consider coherently coupled spin states with an external field, where only one spin component interacts with the bath, enabling light dressing of the impurity and spin-dependent bath-impurity interactions. Through detailed comparisons with ab-initio many-body simulations, we demonstrate that the composite system is accurately described by a simplified effective Hamiltonian. The latter builds upon previously developed effective potential approaches in the absence of light dressing. Nonmajors (i.e., undergraduate students not majoring in the natural sciences) constitute a majority of United States college graduates and are a large potential audience for courses with ecology content. However, nonmajors may be unmotivated to learn about ecology because they perceive it to be uninteresting and irrelevant to their everyday lives or career goals.
