From spreading misinformation to selling deadly products, bad actors use technology platforms to their advantage while causing devastating harms to privacy, health, and even democracy. Despite their central role in enabling these bad actors, the platforms almost entirely escape liability. This legal immunity is purportedly grounded in economics. From the beginning, courts and legislatures feared that liability would chill innovation, growth, and user access. They also speculated that platforms have sufficient market incentives to voluntarily police bad actors, making liability unnecessary.

Part I retells the history of Supreme Court decisions—from the time when Justices followed the British practice of issuing seriatim opinions to the time of Chief Justice John Marshall who instituted a policy of a single opinion for the Court. This norm of consensus lasted 140 years, during which the Court decided more than ninety percent of its cases unanimously. However, modern practice has been marked by division and dissensus, which have incited rhetoric of delegitimization. Part II examines two types of consensuses. Section A discusses internal consensus, or the extent to which the Justices agree with each other. Yet …

In a string of recent opinions, Justice Gorsuch and Justice Thomas have posited that postconviction relief upon a writ of habeas corpus was historically unavailable except where the judgment of conviction was issued by a court lacking jurisdiction. In light of this history, Justices Gorsuch and Thomas have argued for a reconsideration of the modern scope of the writ, which generally allows for relitigation of alleged constitutional error in the course of criminal trial.

Many of America’s most significant policy problems, from failing schools to the aftershocks of COVID shutdowns to national debt to climate change, share a common factor: the weak political power of children. Children are twenty-three percent of all citizens; they have distinct interests; and they already count for electoral districting. But because they lack the maturity to vote for themselves, their interests don’t count proportionally at the polls. The result is policy that observably disserves children’s interests and violates a deep principle of democratic fairness: that citizens, through voting, can make political power respond to their interests.

Joshua Kleinfeld and Stephen Sachs make a significant contribution to the literature on children’s disenfranchisement by describing and defending parental proxy voting: empowering parents to vote on their children’s behalf. The authors’ democratic critique of the status quo is particularly persuasive. Children’s exclusion from the franchise indeed distorts public policies by omitting children’s preferences from the set that policymakers consider. However, Kleinfeld and Sachs’s proposal wouldn’t do enough to correct this distortion. This is because contemporary parents diverge politically from their children, holding, on average, substantially more conservative views. At root, Stephanopoulos and Fishkin don’t think parents are the right people to represent their children politically, and we do. This Note fleshes out the history of SEPs and the recent arguments against them. First, Part I traces the history of SEPs, from the early use of third-party payments, through the development of formal policies governing SEPs, to the Trump and Biden administrations’ dueling approaches to them. Then Part II explains what’s wrong with SEPs. Expanding on the arguments made in the various Justice Department memoranda, this Note argues that SEPs contravene both the Miscellaneous Receipts Act (MRA) and the Antideficiency Act (ADA). In the aftermath of the failed 1842 Dorr Rebellion, a new Rhode Island state constitution was drafted and ratified. It was claimed that the new constitution included many of the provisions that were in the extra-legal People’s Constitution. This was not exactly true. In one respect the new state constitution differed from the People’s Constitution in that naturalized citizens were required to have a freehold while native born citizens were not. Henry J. Duff, a naturalized citizen from Ireland, fought for a period of five years to have the state constitution amended to remove the freehold requirement for naturalized citizens. …

Abstract of Research: This study examines 1) how heritage speakers' self-perceived proficiency and fluency in Spanish influence their identity as Latinos, and 2) the generational similarities and differences in their lived experiences. Through surveys and interviews, the relationship between Spanish proficiency and fluency and perceived Latinidad among nine Spanish heritage speakers (with Latin American ancestry) has been assessed. The research suggests that no statistically significant relationship was found between language proficiency or fluency and perceived Latinismo. However, qualitative findings revealed that participants construct their Latino identity based on cultural values, lived experiences, and a sense of belonging rather than language …

Prevailing emotion-sensing systems privilege a facial-and-gaze paradigm that encodes neurotypical tempo, channel priority, and expression classes, thereby mischaracterizing or erasing neurodivergent communication. This article advances a design-oriented framework for biometric sensing that centers resonant body communication: temporally extended, multimodal, and environmentally situated patterns of posture, gesture, rhythm, and interoception that carry affective meaning. Through an integrative methodology that synthesizes cognitive neuroscience, embodied arts practices, and human–computer interaction, the study formalizes a theoretical model with four pillars: temporal elasticity, multimodal sensory hierarchies, resonant gestures and rhythmic entrainment, and environmental attunement. Purpose: Building on organizational change management (OCM), this study examines how digital and agile transformations influence organizational performance through people-centred mechanisms. Using socio-technical systems theory, the study investigates how aligning technical workflows and social roles can turn transformation initiatives into measurable performance gains.

Design/methodology/approach: The research analyses data from 402 employees in Turkey’s connector manufacturing sector through structural equation modelling (SEM). Agile HR practices and employees’ behaviours that challenge their comfort zones are tested as parallel mediators connecting digital and agile transformations to organizational performance.

Bar passage and employment rates are widely used to evaluate law school performance, yet these raw outcomes often reflect student selection rather than institutional performance. This study applies a value-added modeling (VAM) framework to assess the contributions of law schools to student success, controlling for prior achievement and contextual factors. Using a 10-year panel dataset of 189 ABA-accredited law schools, we estimate fixed-effects models to isolate the impact of the law school learning environment on first-time bar passage and law-related employment. The Chinese government prioritizes supply chain digital transformation. Pilot policies for supply chain digitalization will accelerate digital development across industrial and supply chains. While existing research offers substantial empirical evidence on supply chain digitalization, its impact on corporate innovation performance requires further investigation. Based on this, the study constructs a quasi-natural experiment using data from A-share listed companies and appropriate econometric models, demonstrating that supply chain digitalization significantly enhances corporate innovation performance. Graph perturbation, rooted in classical perturbation theory, studies how small topology edits, i.e., adding or deleting edges, affects graph properties (e.g., density, centrality). This fundamental problem underpins applications like bioinformatics, privacy preservation and system defense. While much prior work targets perturbations that influence global graph statistics or model outputs, comparatively little addresses robustness for knowledge discovery and information retrieval. In these settings, graphs are attributed: nodes carry real-world semantics (e.g., locations, people) and edges encode interactions or relationships. In this article we explore ways of approaching what educators and researchers perceive as mistakes that are consistent with views of mathematics that tolerate ambiguity, contradiction, and multiple possible truths. The approaches we describe draw on works within and beyond the field of mathematics education and detail theories from biologist Humberto Maturana, community organizers Bob Moses and Ella Baker, and poet-philosopher Edouard Glissant. These alternative theoretical perspectives are distinctly relational in their approach. BACKGROUND: Of patients who receive standard concomitant chemoradiation (CRT; intensity-modulated radiation therapy [IMRT] plus cisplatin) for locally advanced head and neck cancer (HNC), approximately two-thirds will develop severe oral mucositis (SOM), limiting their ability to eat solids (WHO grade 3) or drink liquids (WHO grade 4). In a randomized, double-blind phase 2b trial, avasopasem manganese substantially reduced duration and incidence of SOM versus placebo. This phase 3 trial further assessed avasopasem's reduction of SOM due to CRT.

Against the backdrop of deeply integrated digital and platform economies, the resource characteristics of small and medium-sized enterprises (SMEs) and platform participation’s impact on business performance have emerged as key interdisciplinary research focuses between strategic management and digital economy studies. Building upon the resource-based view (RBV) and dynamic capabilities theory (DCT), the study establishes a theoretical framework of “resource characteristics-platform participation-business performance.” It systematically examines the relationships and moderating mechanisms among SMEs’ resource endowment, platform embedding strategies, and performance outcomes.
