The Trump Administration and U.S. Congress are promoting new ventures to extract valuable minerals from outer space. This Article does not dismiss the idea out of hand, but explores reasons for caution, including practical problems with space mining, its environmental impact, the likelihood that the United States could violate international law, and the risk of armed conflict. These problems are exacerbated by financial conflicts of interest in our government with a handful of billionaires, who have a financial interest in space mining work. To counter these structural threats, this Article proposes a restrictive, fiduciary-based standard for the use of GPAI in substantive legal work. The proposed “Fiduciary-Grade & Independence Safeguards” (FGIS) standard posits that law firms should presumptively prohibit the use of GPAI for tasks involving legal analysis, strategy, or the synthesis of confidential facts and law. A firm may only depart from this default prohibition if it can certify, with auditable proof, the implementation of two pillars of protection: (1) robust safeguards that neutralize vendor influence and preserve the lawyer’s independent professional judgment, and (2) fiduciary-grade confidentiality controls, including private deployment and …

Can the President adjourn Congress, declare that the adjournment constitutes a recess, and appoint cabinet officers without the Senate’s consent? President Donald Trump has considered invoking this supposed power. Adjourning Congress would enable the President to appoint otherwise unconfirmable officials. Even if the President does not adjourn Congress, the looming threat of adjournment could chill the Senate’s review of nominees.

This Article concludes that the President cannot evade the Senate’s role in the appointments process by adjourning Congress. Three clauses in the Constitution inform the analysis: the Consent Clause, which requires each house to consent to the other’s adjournment; the …

This Article makes a series of interventions into the existing literature on birthright citizenship. It makes three historical claims about the common law rule and its development. First, the Article centers the importance of parental status. The relevant status was not the citizenship of the parents, however, but whether they were under the protection of, and owed allegiance to, the sovereign. The common law rule therefore did not depend on descent, but the modern belief that the rule depended solely on place of birth is also mistaken. Background. Depression and anxiety are common among adults with type 2 diabetes and obesity, yet one-time intake screening may not identify symptoms that emerge or change during treatment. Local Problem. Within a telehealth obesity care program, PHQ-9 and GAD-7 screening occurred at intake, but no standardized reassessment process existed. Methods. A single Plan-Do-Study-Act cycle evaluated electronic PHQ-9 and GAD-7 reassessment among adults with type 2 diabetes and obesity. The primary outcome was reassessment completion, with a prespecified feasibility target of at least 20%. Paired symptom changes, clinical and safety triggers, and follow-up were also evaluated. The state of charge (SOC) of a battery indicates the remaining charge in the battery relative to its nominal maximum charge capacity. The accurate estimation of SOC is of utmost importance for efficient energy management as it indicates the level of energy stored in the battery.

Bayesian and machine learning (ML) approaches represent two distinct estimation strategies for battery state estimation. This dissertation investigates extending the frequency range over which a one-dimensional, plane traveling wave can be generated in a water-filled, steel-walled waveguide under ocean temperature and hydrostatic pressure conditions. The wave guide considered is a thick-walled, steel cylinder filled with a water/glycol mixture with a transducer at each end and a hydrophone array along the length. One transducer excites a plane wave while the other cancels reflections, resulting in a traveling wave in the waveguide. During Reconstruction, as Congress debated the place of African-Americans in U.S. society, it evaluated how the principles it articulated would apply to Chinese-Americans. Rather than adopting a race-neutral jurisprudence, it began identifying the ways in which the law could be deployed to deny Asians economic and political opportunities, and the right to immigrate. Ultimately, a joint network of federal and state laws denied Asians the right to naturalize, to own land, and to immigrate. The first manuscript, “BrkgaCuda 3.0: A Redesigned Multi-GPU Framework for Biased Random-Key Genetic Algorithms,” presents a ground-up architectural redesign of BrkgaCuda 2.0 that enables a true multi-GPU island model for Biased Random-Key Genetic Algorithms (BRKGA). The BRKGA island model evolves multiple semi-independent populations that periodically exchange elite solutions, a structure that maps naturally to multi-GPU parallelism; however, BrkgaCuda 2.0 is confined to a single GPU. This study examines the ideological development and political significance of the Blueshirt movement in the Irish Free State, focusing mainly on how the transnational fascist thought developed amidst local conditions. It argues that although the Blueshirts, associated with organizations such as the Army Comrades Association (ACA) under the leadership of Eoin O'Duffy, incorporated aesthetic and ideological features of other interwar European fascisms into their program, including palingenetic ultranationalism, corporatism, and paramilitarism, these elements developed within the context of Ireland’s postcolonial political culture. The United States recorded its largest ever unhoused population in 2024. Acute affordable housing shortages and climate-fueled natural disasters have exacerbated a decades-long unaddressed humanitarian crisis, straining resources in cities and rural areas alike. In response, state and local governments have pivoted to a more punitive approach to houselessness. Draconian "anti-camping" ordinances subject houseless people to fines or arrests while police destroy their property in encampment "sweeps," disconnecting the unhoused from critical social structures. Quality-of-life laws criminalize basic biological functions in public. New York, California, and other states have expanded the reach of involuntary civil commitment procedures, forcibly hospitalizing and …

This study investigates how major agricultural commodities interact with diversified U.S. equity funds, sorted by their environmental, social, and governance (ESG) risk exposure. Using daily Morningstar data on 880 U.S. equity mutual funds, we construct portfolios representing high- and low-ESG-risk equities and examine their linkages with prices for eight agricultural commodities. Applying Fourier-augmented Toda–Yamamoto VAR and LM-GARCH models that accommodate both abrupt and gradual structural breaks, we document clear heterogeneity across ESG risk segments. Low-ESG-risk portfolios exhibit minimal price and volatility spillovers from agricultural commodities, whereas high-ESG-risk portfolios display strong and often bidirectional transmissions—particularly for coffee, corn, cotton, livestock, and …

When Congress enacted the Americans with Disabilities Act (ADA) in 1990, it envisioned a unique dispute resolution mechanism within the statute—the interactive process. Under this process, when an employee requests an accommodation from an employer, the two must “work together to assess whether an employee’s disability can be reasonably accommodated.” Although the term “interactive process” does not appear in the ADA’s text, the Equal Employment Opportunity Commission (EEOC) interpreted Congress’s intent and incorporated the interactive process into its regulations to guide disability accommodations. Fifty-one private domestic wells across western Kansas were sampled to quantify nitrate and arsenic occurrence, identify geochemical controls, and evaluate carcinogenic and non-carcinogenic health risks for adult and child receptors in a region where groundwater serves as the primary drinking water source with no routine regulatory oversight. Samples were analyzed for major ions, nutrients, and trace elements by ICP-MS, ion chromatography, and UV-Vis spectrophotometry. Shapiro-Wilk testing confirmed non-normal distributions for both contaminants; inter-county comparisons were therefore conducted using Kruskal-Wallis tests with Dunn's post-hoc correction. This thesis examined the intersection of chronic illness and systemic inequities faced by Black women living with lupus. These women often encountered unique challenges in managing their health and well-being, exacerbated by both the physical and sociocultural implications of the disease. The 2022 Russian attacks on the Chernobyl and Zaporizhzhia nuclear facilities in Ukraine shocked the international community. Claims that the attacks constituted war crimes immediately entered the public consciousness, and a flurry of opinions were set forth on the international humanitarian law (“IHL”) protections afforded to nuclear plants, focusing on Article 56 of Additional Protocol I of the Geneva Conventions, which provides special protection to nuclear electrical generating stations. What makes a conviction wrongful? Developments in DNA science have led to a wave of exonerations over the past thirty years, revealing sources of error in the criminal legal process. Innocence organizations proliferated to represent people whose convictions could be overturned by newly discovered evidence. This is vital work for the individuals who are released and for the purpose of systemic change. At the same time, a focus on exonerations constructs a relatively narrow conception of wrongful convictions—one that is synonymous with factual innocence.

The Administrative Procedure Act (APA) requires federal agencies to simply “incorporate in the rules adopted a concise general statement of their basis and purpose” after they receive comments from the public, and the Supreme Court ruled in Overton Park that courts are to adjudicate whether rules are arbitrary and capricious based on agencies’ contemporaneous rationales. Judge-created doctrines incentivize agencies to rely on these “concise” statements to elucidate their rationales, and, as a result, rulemaking preambles have ballooned in size as agencies seek to insulate themselves from critical courts.
