The Playbook: A Guide To College Athlete Unionization In The Wake Of Alston, Ashlyn Hare

Since the Supreme Court's decision in National Collegiate Athletic Association v. Alston, the movement for college athlete unionization has drastically expanded. As college sports—and their profitability—continue to grow, problems such as the exploitation of athletes of color, gender inequity, and abuse and mistreatment of athletes have signaled the need for restoring decision-making power to the athletes. This can be achieved through collective bargaining, but the complexity of college sports and its many stakeholders makes the route to a college athletes players association far from clear. It Shouldn’T Be Sexy: Exploring The Intersection Between Staged Intimacy And The Law, Spencer Darling

If your job requires you to passionately embrace your coworker after surviving the seat-riveting climax action of the third act, does that complicate your workplace’s sexual harassment prevention strategy? Most jobs do not require workers to make intentional intimate contact with their coworkers. Yet, in the entertainment industry, some jobs require not just intimate contact with coworkers but selling that contact as authentic. This staged intimacy, like staged violence, carries a risk that simulated conduct can result in real harm.

“Music metadata” is virtually any of type of content electronically embedded in a digital audio file and may include information that identifies various rightsholders of a copyrightable sound recording, such as producer(s) and performer(s). A standardized system for music metadata does not exist, and instead music industry stakeholders devote significant resources to maintain redundant and incongruent databases. As a result, licensees expend significant effort in tracking copyright holders and licensors risk inadequate protection and potential loss of royalties. How The States And The Ncaa Are Changing The Landscape Of Collegiate Name, Image, And Likeness Compensation, Carly Sirota

This Comment evaluates the recently enacted laws in California and Colorado which require universities in those states to allow student-athletes to receive compensation for their name, image, or likeness. When California first introduced this legislation, there was intense pushback from many in the intercollegiate community. However, less than a year after the bill was enacted, the NCAA’s Board of Governors has committed to changing their bylaws in compliance with the law. The Comment discusses some legal implications of the law for many student-athletes, especially female student-athletes, and how the NCAA should go beyond pay-to-play law compliance to create an equal …

This Comment will examine the many ways that courts struggle to balance the right of publicity and the First Amendment. The main issue is that docudramas are an intermediary production between movies and documentaries, and producers are claiming the protections that exist for those two mediums also protect their works. There has been only one Supreme Court case on the right of publicity. Since this ruling, however, lower courts have found that precedent to be too narrow and have decided cases individually. This has enabled courts to try docudrama right of publicity cases with a multitude of tests.

The Right Way To Pay Intercollegiate Student-Athletes: A Legal Risk Analysis, Ian K. Schumaker, Leeann M. Lower-Hoppe

“How should student-athletes get paid?” This is the next big question in the intercollegiate sport industry. While the National Collegiate Athletic Association (NCAA) fights relentlessly to protect the amateurism of intercollegiate athletics, public pressure continues to mount for establishing a method of paying student-athletes beyond scholarships and educational expenses. There are two compensation methods frequently discussed by the media, fans and practitioners in the industry: 1) compensating student-athletes through the university, or 2) compensating student-athletes through their name, image and likeness (NIL).
