Throughout its history, the RICO statute has presented lawyers with something of an interpretive parlor game. It is indefinite along multiple dimensions and thereby given multiple interpretations, even down to the word level. In Medical Marijuana v. Horn, the Supreme Court set out to define one of RICO's civil-standing provisions: Namely, whether the statute's "injury to business or property" requirement can be satisfied when a plaintiff suffers both economic and personal injuries. In a 5-4 decision, members of the Court engaged in an interpretive battle over the meaning of the phrase and succeeded only in holding that civil RICO does …

In 2018 and 2019, two Boeing 737 MAX airplanes fell from the sky, killing 346 people—one of the deadliest corporate crimes in U.S. history. Instead of taking the case to trial, the United States Department of Justice (“DOJ”) addressed the matter by using two different alternative dispute resolution vehicles. First, Boeing was given a three-year deferred prosecution agree-ment. That deal was canceled when DOJ determined the company had breached it. Next, Boeing was given a plea bargain. This Article argues that federal courts, which are empowered to approve or reject plea deals, should be skeptical when the government turns to …

Background: Relapsed medulloblastoma remains a significant therapeutic challenge as it is near universally fatal. The tumor microenvironment of medulloblastoma plays a critical role in tumor progression, influencing tumor growth, immune evasion, and therapeutic resistance. We hypothesized that defining tumor-immune interactions in diagnostic and relapsed medulloblastoma may uncover mechanisms of immune evasion and identify novel therapeutic targets.

Methods: We analyzed paired primary and recurrent RNA-sequencing data from 140 medulloblastoma patients to profile immune cell composition and validate spatial relationships within the TME. The digestive system is essential for nutrient absorption, processing, and waste elimination. The expression of many genes and physiological processes within this system exhibits a 24-h rhythmicity. However, modern lifestyle factors, such as jet lag, shift work, and irregular eating patterns, significantly disrupt these rhythms, triggering various stress responses and contributing to numerous digestive disorders. This paper examines how caseworker turnover is portrayed in New York State foster care assessment documents published between 2014 and 2024. Utilizing a qualitative content analysis (QCA) approach informed by Margrit Schreier’s methodology, this study evaluates publicly available government reports, assessment documents, policy documents, and audit reports to identify how turnover is represented, what causes are highlighted, and what consequences are downplayed. The data reveals that turnover is often framed as an administrative issue rather than a workplace welfare crisis with extensive emotional and relational impacts on caseworkers, children, and families. This mixed-methods study examines how generational cohorts (Generation X, Millennials, and Generation Z) and gender influence attitudes and responses to workplace sexual harassment (SH). Grounded in the bystander intervention model, moral responsibility theory, critical theory, and critical feminist theory, the study explores perceptions of verbal, visual, physical, and digital SH. Data were collected through a survey instrument administered to professionals in higher education and related fields, which included quantitative measures and open-ended questions to capture lived experiences. Quantitative analyses explored differences across generational cohorts and gender identities, while qualitative responses were analyzed thematically. The Kentucky Transportation Cabinet (KYTC) uses AASHTOWare’s Pavement ME Design Version 3.0 (PaveME) to develop mechanistic-empirical designs for new and reconstructed pavements. Transfer functions used for estimating pavement distress in PaveME rely on national calibration values derived from the Long-Term Pavement Performance (LTPP) database. However, these often fail to reflect Kentucky’s local conditions, materials, and practices. Born in 1877, Rose McDonough grew up in Montclair, New Jersey. She learned French in a local school inside a Congregational Church, and by 1920 was a private teacher. This thesis recovers information about Rose McDonough’s life through a single archival object: Easy Conversations In French, by Gustave Choquet and published by New York’s George R. Lockwood & Son, in 1854. Housed in the Montclair History Center, Rose’s penciled marginalia is scattered throughout. Using book history as the primary methodology, this thesis reads the material object of the schoolbook, marks left by its reader, along with Census records, historic maps, …

Traditional Von-Neumann computing architectures suffer from a fundamental limitation known as the memory wall, where performance is constrained by the cost of data movement between memory and processing units rather than by computational capability. This limitation is particularly pronounced in data-intensive workloads such as machine learning (ML) and hyperdimensional computing (HDC), where matrix-vector operations dominate execution and are often memory-bound. Climate disruption has become a persistent organizational condition rather than an episodic event, yet most information systems designed to support organizational resilience treat each disruption as an isolated incident. Existing digital resilience platforms, disaster recovery systems, and AI-driven decision support tools lack the capacity to accumulate, encode, and reuse organizational knowledge across successive climate-related crises. This paper introduces Algorithmic Resilience Memory (ARM), a novel IS construct defined as an AI-enabled organizational capability through which agentic AI systems sense climate-related disruptions, encode prior organizational responses, preserve decision rationale, generate contextually adaptive recommendations, and reconfigure future actions through structured outcome feedback. Over the past two decades, China’s rapid expansion of aid and investment throughout sub-Saharan Africa has raised questions about how the United States responds to growing competition in the region. While the impact of China’s aid has been the subject of considerable study, far less attention has been given to how other donors shift their strategies to adjust. This thesis asks a simple but rather consequential question: does the US change how it gives aid in Africa in response to China’s ever-growing footprint?

BACKGROUND: There is a scarcity of information regarding the distribution of the diseases leading to kidney failure (KF) in children living in the emerging world. We used registry data to provide a global overview of the underlying disease spectrum in children commencing kidney replacement therapy (KRT).

In 1776, Thomas Jefferson argued that judges are “mere machines.” This statement captures founding generation’s conception of the judicial task. From Edward Coke to Montesquieu to William Blackstone to Alexander Hamilton to John Marshall, the founding era’s governing legal tradition taught that judges do no more than mechanically apply the law to reach a case’s correct answer. Judges find the law, the Founders consistently emphasized, they do not choose it.

This study explored the relationship between informal learning behaviors and leadership emergence in workplace settings while also looking at the moderating roles of occupational self-efficacy and learning climate. Using a correlational, cross-sectional design, data was collected from 361 working professionals through an online survey with 341 being the final sample size. Participants completed validated self-report measures assessing informal learning behaviors, occupational self-efficacy, learning climate, and leadership emergence. Correlational and moderation analyses were performed to test the study hypotheses. Results showed that informal learning behaviors was positively and significantly related to leadership emergence. This thesis applies the Responsibility to Protect (R2P) framework to examine the evolving relationship between state sovereignty and humanitarian intervention in the modern international system. It develops the concept of “responsible sovereignty” to show how sovereignty has shifted from an absolute principle of non-interference toward a socially constructed and conditional norm increasingly linked to a state’s responsibility to protect its population. By tracing the transition from Westphalian sovereignty to contemporary understandings of sovereignty as responsibility, the study highlights how international norms reshape expectations of state behavior while also generating persistent tensions in practice. This paper examines the temporal nature of libidinal control in the totalitarian systems represented in George Orwell’s Nineteen Eighty-Four and Aldous Huxley’s Brave New World. Arguing that the most enduring forms of domination operate through the reorganization of desire, the essay explores how regimes intervene in familial, romantic, and social attachments to redirect affective energy towards the state. Orwell depicts a primitive, reactive phase of control in which attachments are violently ruptured, whereas Huxley imagines an advanced system that operates through preemption, never allowing attachments to form. Early explorers to what is now America, beginning with Hernando DeSoto in 1530, stole the dignity and the lands of the Indigenous peoples of America, of whom the Cherokees are only one nation. Two of the things that could not be taken was the Cherokees’ rich cultural tradition and oral histories. Stories passed orally from generation to generation to ensure that histories were preserved. They were largely preserved by the women of the tribe.

Through critical analysis of media: literary works, performance, and television, this thesis explores the prejudices, silencing, dehumanizing, sexualization, and marginalization of Black women, their bodies, identity, and trauma inflicted by White-authored texts, specifically the American canon. I analyze the works of Black women authors, scholars, and activists, who counter the false representation of the patriarchy. Their literary works refute, deconstruct, and redefine the canon’s distorted, racial and gendered stereotypes, later to be named controlling images.  While narrating the Black woman’s authentic self, experience, body, and womanhood they reclaim space, authenticity, and agency.

His contemporary, Sigmund Freud, was developing psychoanalytic theory in a growing field of psychological study, which serves as a prominent ancestor to modern psychiatry and current psychoanalytical literary studies. Fiction writers of the 1900s absorbed the zeitgeist of melded chronology and consciousness, interweaving themes of time and trauma in their works. This thesis develops a modeling framework that integrates discrete-event simulation with a Leslie-type matrix model to study transportation–demography interactions.Simulation outputs are aggregated to construct a transition matrix describing changes in transportation states. This thesis analyzed whether Christian faith-based curricula and toolkits regarding firearm safety and violence prevention align with established best practices in public health, social work, and education research. Previous research has explored the prevalence and impact of gun violence, best practices regarding gun violence and safety interventions, the effectiveness of churches as public health initiative partners, and the relationship between Christianity and views on firearms. Research on political violence demonstrates how certain aspects of masculinity are linked to asserting ideological authority and reinforcing exclusionary social identities through physical aggression, such as assaults, homicides, and gender-based violence. However, little research analyzes the use of violent threats as masculinity performances to achieve these same ends. To address this gap, this study analyzes messages from qualitative interviews with 26 election officials who experienced violent threats, examining performances of a distinct form of masculinity – patriotic masculinity – which fuses hegemonic masculine norms with patriotic values.
