The correlation of legal safeguards and human psychology amplifying prejudice within the courtroom creates a perpetual challenge for those tasked with ensuring fairness in judicial proceedings. This paper focuses on the limitations of court mechanisms such as objections, jury instructions, and subsequent curative instructions in mitigating the effects of prejudicial evidence. Through case law coupled with cinematic examples and psychological theories, this paper highlights the battle between coexisting human psychology and prejudicial influences on jury decision-making. The proposed remedies within the text include enhanced jury education, pre-trial intervention, and post-trial juror reviews, all to minimize the prejudicial impact.

This Note analyzes the role of religious exemptions in federal and state child welfare statutes in facilitating abuse within the Troubled Teen Industry (TTI), a loosely defined network of residential treatment programs, wilderness camps, and therapeutic boarding schools. Although religious exemptions were originally intended to safeguard religious liberty and parental rights, their statutory design has produced significant regulatory gaps that permit certain faith-affiliated institutions to operate with minimal oversight. ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

สิทธิและเสรีภาพของพระภิกษุในระบบกฎหมายไทยถูกจำกัดหลายประการด้วยกัน ในรัฐธรรมนูญแห่งราชอาณาจักรไทยทุกฉบับที่ผ่านมามีบทบัญญัติว่าพระภิกษุเป็นผู้ไม่มีสิทธิเลือกตั้งมาโดยตลอด ทำให้พระภิกษุไม่มีสิทธิประเภทอื่น ๆ ตามมา เช่น สิทธิในการลงประชามติ สิทธิในการเข้าชื่อเสนอร่างกฎหมายหรือแก้กฎหมาย ไม่เพียงเท่านี้ ยังมีพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 มาตรา 29 กำหนดให้เจ้าหน้าที่ราชอาณาจักร คือ พนักงานสอบสวนมีอำนาจสละสมณเพศพระภิกษุผู้ถูกกล่าวหาในคดีอาญาได้ และกำหนด ให้องค์กรคณะสงฆ์ คือ “มหาเถรสมาคม” ออกกฎ คำสั่ง มติ ระเบียบต่าง ๆ มาบังคับใช้กับพระภิกษุ ทำให้เกิดการจำกัดสิทธิภายในคณะสงฆ์มากขึ้นเรื่อย ๆ ปรากฏว่ากฎหมายเหล่านั้นบางฉบับไม่สอดคล้องกับหลักสากลว่าด้วยสิทธิมนุษยชน บางฉบับไม่สอดคล้องกับหลักการการจำกัดสิทธิและเสรีภาพตามรัฐธรรมนูญ และบางฉบับไม่สอดคล้องกับหลักพระธรรมวินัยของสงฆ์ บทความนี้จึงมุ่งพิจารณาว่ากฎหมายที่ตราขึ้นมาเพื่อจำกัดสิทธิและเสรีภาพนั้นเป็นไปสอดคล้องตามหลักสิทธิมนุษยชน รัฐธรรมนูญ กฎหมายบ้านเมือง และหลักพระธรรมวินัย มีผลสัมพันธ์กันหรือไม่ และได้ศึกษาเปรียบเทียบกับพระภิกษุในประเทศพม่า และประเทศศรีลังกา ซึ่งเป็นพุทธศาสนาเถรวาทเช่นเดียวกับพระภิกษุในประเทศไทย เพื่อแก้ไขกฎหมายให้เหมาะสมกับพระภิกษุในสังคมไทยต่อไป

We conceptualize this specific systemic phenomenon as a new type of IE—NIS-catalysed IE—whose sustainable growth is said to be constantly hindered by dependent yet opposing tensions. High-tech entrepreneurship plays a central role in shaping regional innovation ecosystems, yet the mechanisms through which it affects innovation in incumbent firms remain underexplored. Using firm-level data from the Zhongguancun Science Park (2005–2015), this study investigates the impact of high-tech entrepreneurship on incumbent firms’ innovation. The results reveal that high-tech entrepreneurship significantly enhances innovation among incumbent firms, primarily through R&D investment and human capital. Moreover, this effect is stronger in the electronic information industry and during the development stage. This paper examines the dynamic impact of geopolitical risk on short-term capital flows using a time-varying parameter vector autoregression (TVP-VAR) model and analyzes the transmission mechanism through interest rate differentials and exchange rate expectations. The findings indicate that geopolitical risk is a significant driver of short-term capital flows in China, with increased geopolitical risk leading to short-term cross-border capital outflows. Impulse response analysis across different time points indicates that financial opening-up policies affect short-term capital flows, yet gradual financial opening-up has not significantly amplified the impact of geopolitical risk. The main objective of this work is to obtain exact soliton solutions for a nonlinear time-fractional equation model describing wave profiles arising in various physical systems. To derive different wave structures associated with the considered model, two analytical techniques are employed: the extended G'\G^2-expansion method and the modified auxiliary equation (MAE) approach. A wave transformation is applied to reduce the nonlinear time-fractional equation to a nonlinear ordinary differential equation (NLODE) by means of the M-truncated and Atangana-Baleanu (AB) fractional operators. Objective. Several novel methods, including magnetogenetics and magnetoelectric stimulation, use high frequency alternating magnetic fields to precisely manipulate neural activity. To quantify the behavioral effects of such interventions in a freely moving mouse, we developed a dual-channel magnetic chamber, specifically designed for rate-sensitive magnetothermal-genetic stimulation, and adaptable for other uses of alternating magnetic fields.

This paper develops the algorithmic and dynamical foundations of recursive ensemble learning driven by Fibonacci-type update flows. In contrast with classical boosting Freund and Schapire (1997); Friedman (2001), where the ensemble evolves through first-order additive updates, we study second-order recursive architectures in which each predictor depends on its two immediate predecessors. These Fibonacci flows induce a learning dynamic with memory, allowing ensembles to integrate past structure while adapting to new residual information. We introduce a general family of recursive weight-update algorithms encompassing Fibonacci, tribonacci, and higher-order recursions, together with continuous-time limits that yield systems of differential equations governing ensemble evolution. …

The article deals with the determination of initial conditions in a mixed problem for a two-dimensional hyperbolic equation. First, the uniqueness of the solution to the corresponding initial–boundary value problem is established. Then, by imposing certain restrictions on the given data, the existence of a solution to this problem is demonstrated. Furthermore, existence and uniqueness theorems are proved for the associated inverse problem of determining the initial conditions.

This environmental history of the North Portland Peninsula is a critical case study of a landscape in transition, where new "natures" have been constructed through shifting projects of reclamation and restoration. The Port of Portland, who controlled the Peninsula, transformed the marshy bottomlands near the confluence of the Columbia and Willamette Rivers to accommodate greater networks of industrial infrastructure and expand their capacity for global trade. It has often been suggested that similar quantum particles may be a counterexample to the principle of the Identity of Indiscernibles. In this article, I discuss the status of indiscernibility in a perspectival approach to quantum mechanics. I argue that adopting an internal physical perspective can have the effect of making entities discernible even if they are not discernible relative to external reference frames, and thus perspectivalism offers a new way to understand the physical meaning of weak discernibility. Turkish Hearths played an important role in the institutionalisation of Turkish nationalism in the final years of the Ottoman Empire and the early years of the Republic. The process began with the establishment of the Turkish Association in 1908, the Turkish Homeland Society in 1911, and the Turkish Power Society in 1913, and was strengthened with the establishment of the Turkish Ocağı. The mechanical properties of brake pad composites produced from powdered Pentaclethra macrophylla pod reinforced with gum Arabic resin were investigated. The pods were cleaned, air-dried, oven-dried at 110 °C to constant weight, pulverized, and sieved, after which a portion was carbonized at 950 °C. Composite formulation was carried out using a pre-impregnation technique, with the reinforcement content varied from 10 to 50 wt% at 10 wt% intervals, while other constituents were maintained constant. Organic soils exhibit highly variable geotechnical behavior due to differences in the type, content, and decomposition state of organic matter, which are often inadequately distinguished in engineering practice. This study investigates the influence of organic matter origin on soil behavior through a comparative analysis of sapric organic soils and sewage sludge soil tested under identical one-dimensional consolidation conditions. Laboratory tests included physical characterization, standard consolidation tests under vertical stresses of 200 kPa and 800 kPa, post-consolidation organic matter measurements, and microstructural analyses using SEM–EDS and XRD.
