Incremental Improvement Of The Patentability Standard Of Nonobviousness, Kayla Siletti Brown Mar 2024

Incremental Improvement Of The Patentability Standard Of Nonobviousness, Kayla Siletti Brown

Fordham Law Review

Patents incentivize innovation, but the face of innovation has changed over the past several decades. Patent law is adapting to the radical growth of the pharmaceutical and biotechnological industries, which produce drugs and biologics respectively. Research and development in these fields is largely incremental—new products are often derived from existing products. However, patents do not protect “obvious” improvements, those that anyone skilled in the relevant scientific field could have discovered through predictable, routine work. The line between incremental R&D and routine, obvious improvements is difficult to draw. The U.S. Court of Appeals for the Federal Circuit and the Patent Trial …

Persons living in long-term care facilities (LTCFs) were disproportionately affected by COVID-19. We used wastewater surveillance to detect SARS-CoV-2 infection in this setting by collecting and testing 24-hour compos- ite wastewater samples 2–4 times weekly at 6 LTCFs in Kentucky, USA, during March 2021–February 2022. The LTCFs routinely tested staff and symptomatic and exposed residents for SARS-CoV-2 using rapid antigen tests. Of 780 wastewater samples analyzed, 22% (n = 173) had detectable SARS-CoV-2 RNA. The LTCFs reported 161 positive (of 16,905) SARS-CoV-2 clinical tests. The wastewater SARS-CoV-2 signal showed vari- able correlation with clinical test data; we observed the strongest …

Fabrication And Characterization Of Quad-Component Bioinspired Hydrogels To Model Elevated Fibrin Levels In Central Nervous Tissue Scaffolds, Jennifer Steele, Dany J. Munoz-Pinto

Engineering Faculty Research

Multicomponent interpenetrating polymer network (mIPN) hydrogels are promising tissue-engineering scaffolds that could closely resemble key characteristics of native tissues. The mechanical and biochemical properties of mIPNs can be finely controlled to mimic key features of target cellular microenvironments, regulating cell-matrix interactions. In this work, we fabricated hydrogels made of collagen type I (Col I), fibrin, hyaluronic acid (HA), and poly (ethylene glycol) diacrylate (PEGDA) using a network-by-network fabrication approach. With these mIPNs, we aimed to develop a biomaterial platform that supports the in vitro culture of human astrocytes and potentially serves to assess the effects of the abnormal deposition of …

Faculty Authors and Creators Reception

Soil and water loss represent a significant environmental challenge in purple soil cropland in China. However, the quantity and mechanism of nutrient loss from purple soil remain unclear. To understand water and soil conservation and address nitrogen (N) and phosphorus (P) mitigation in Camellia oleifera forest stands on purple soil slope farmland, this study aimed to explore the resistance control effect of forest stands on N and P loss in such agricultural landscapes. In the study, a runoff plot experiment was conducted in purple soil slope farmland. The experiment included three distinct treatments: intercropping of oil tea (Camellia oleifera) and …

Faculty Research 2024

Mycobacterium tuberculosis (M.tb.) infection leads to over 1.5 million deaths annually, despite widespread vaccination with BCG at birth. Causes for the ongoing tuberculosis endemic are complex and include the failure of BCG to protect many against progressive pulmonary disease. Host genetics is one of the known factors implicated in susceptibility to primary tuberculosis, but less is known about the role that host genetics plays in controlling host responses to vaccination against M.tb. Here, we addressed this gap by utilizing Diversity Outbred (DO) mice as a small animal model to query genetic drivers of vaccine-induced protection against M.tb. DO mice are …

3d Convolutional Neural Networks Predict Cellular Metabolic Pathway Use From Fluorescence Lifetime Decay Data., Linghao Hu, Daniela De Hoyos, Yuanjiu Lei, A Phillip West, Alex J Walsh

Faculty Research 2024

Fluorescence lifetime imaging of the co-enzyme reduced nicotinamide adenine dinucleotide (NADH) offers a label-free approach for detect- ing cellular metabolic perturbations. However, the relationships between variations in NADH lifetime and metabolic pathway changes are complex, preventing robust interpretation of NADH lifetime data relative to metabolic phenotypes. Here, a three-dimensional convolutional neural network (3D CNN) trained at the cell level with 3D NAD(P)H lifetime decay images (two spatial dimensions and one time dimension) was developed to identify metabolic pathway usage by cancer cells. NADH fluorescence lifetime images of MCF7 breast cancer cells with three isolated metabolic pathways, glycolysis, oxidative phosphorylation, and …

Publications and Research

This chapter describes the work of three linguists working in communication departments at two community colleges in the City University of New York system (CUNY) to counter deficit approaches toward dialectal variation in the field of communication studies (and beyond). The authors’ approach includes professional presentations, curricular redesign, identifying linguistic discrimination in textbooks, and conducting professional development workshops and seminars. They believe that the things they are doing are easily reproducible, so they are shared in this chapter in the hopes that more people will get actively involved in reducing/eliminating such harmful classroom pedagogies that involve deficit views of dialectal …

Winter Field Report, December 2023–February 2024, W. Ross Silcock

Nebraska Bird Review

As was the case for winter 2022–2023, the big general story was the large number of reports of tardy fall migrants and unexpectedly northerly occurrences in midwinter, an apparent residue of relatively mild early winter temperatures. These reports involved at least 50 species, many of them waterbirds and native sparrows, but including several other passerines as well. Notable were about 12 waterfowl species, five grebe species, an interesting late Dec peak in each of the last three years of Sandhill Cranes, record late Whooping Cranes, a 4th winter record of Dunlin, high numbers of Double-crested Cormorants, a wintering Rock Wren, …

2023–2024 Christmas Bird Counts, Don Paseka

Nebraska Bird Review

With the resurrection of the Kearney count, twenty CBCs [Christmas Bird Counts] were run in the 2023–2024 season. This is four more than last year and one more than the previous high number of nineteen from 2021. Although the Crawford, Harrison, and Scottsbluff counts were postponed because of snow, the weather on count days was mild with an average high of 43°F and an average low of 27°F, resulting in mostly open water. Rain and mud eliminated access to several normally productive areas of the Harlan County count which still produced the highest number of species (94). Lake McConaughy produced …

Environmental Science and Management Faculty Publications and Presentations

Streams systems draining upland landscapes provide valuable ecosystem services, but they are vulnerable to incision and channelization caused by anthropogenic disturbance. Restoring a degraded stream to its pre-disturbance condition by reconnecting the channel to its historical floodplain aims to recover lost hydro-morphological processes and functions. Seeking evidence to indicate whether that aim is met in practice, we examined diatoms and the stream macroinvertebrate trophic structures in three reaches of Whychus Creek, Oregon, United States. Two reaches were reconnected to their pre-disturbance floodplains in 2012 and 2016. The third, control reach, was not restored and was selected to represent the degraded …

The Supreme Court, The First Amendment, And The Erosion Of Public Employer Managerial Authority, Anne Marie Lofaso, Martin H. Malin

Denver Law Review

For nearly two centuries, public sector employment in the United States was governed by the privilege doctrine, also known as the right-privilege distinction, which stripped public employees of their citizenship rights by denying them protection against adverse employment actions retaliating against their exercise of those rights. In 1967, in Garrity v. New Jersey, the U.S. Supreme Court reversed course and found, in the context of a government investigation of state police officers who allegedly fixed traffic tickets, that the state could not coerce those officers to waive their constitutional right to remain silent during the investigation by threatening to fire …

Parents In Fact, Douglas Nejaime

University of Chicago Law Review

The Restatement of Children and the Law, protects a child’s relationship with a T“de facto parent”—a person who has “established a bonded and dependent relationship with the child that is parental in nature.” De facto parent doctrines are part of a broader category of functional parent doctrines that extend parental rights to an individual who has developed a parent-child relationship and acted as a parent to the child. Application of the de facto parent doctrine depends on a conclusion that the person formed a parental relationship, and yet debate remains over whether the person is a parent or merely a …

Cross-Sectional Association Between Blood Cholesterol And Calcium Levels In Genetically Diverse Strains Of Mice., Cody M Cousineau, Kaelin Loftus, Gary Churchill, Dave Bridges

Faculty Research 2024

Genetically diverse outbred mice allow for the study of genetic variation in the context of high dietary and environmental control. Using a machine learning approach, we investigated clinical and morphometric factors that associate with serum cholesterol levels in 840 genetically unique Diversity Outbred mice of both sexes (n = 417 male and 423 female), and on both a control chow (% kcals in diet: protein 22%, carbohydrate 62%, fat 16%, no cholesterol) and high fat high sucrose (% kcals in diet: protein 15%, carbohydrate 41%, fat 45%, 0.05% cholesterol). We find expected elevations of cholesterol in male mice, as well …

We describe humans with rare biallelic loss-of-function PTCRA variants impairing pre–a T cell receptor (pre-TCRa) expression. Low circulating naive ab T cell counts at birth persisted over time, with normal memory ab and high gd T cell counts. Their TCRa repertoire was biased, which suggests that noncanonical thymic differentiation pathways can rescue ab T cell development. Only a minority of these individuals were sick, with infection, lymphoproliferation, and/or autoimmunity. We also report that 1 in 4000 individuals from the Middle East and South Asia are homozygous for a common hypomorphic PTCRA variant. They had normal circulating naive ab T cell …

Infection with Lassa virus (LASV) can cause Lassa fever, a haemorrhagic illness with an estimated fatality rate of 29.7%, but causes no or mild symptoms in many individuals. Here, to investigate whether human genetic variation underlies the heterogeneity of LASV infection, we carried out genome-wide association studies (GWAS) as well as seroprevalence surveys, human leukocyte antigen typing and high-throughput variant functional characterization assays. We analysed Lassa fever susceptibility and fatal outcomes in 533 cases of Lassa fever and 1,986 population controls recruited over a 7 year period in Nigeria and Sierra Leone. We detected genome-wide significant variant associations with Lassa …

Development Of Mass Spectrometric Glycan Characterization Tags Using Acid-Base Chemistry And/Or Free Radical Chemistry, Rayan Murtada, Shane Finn, Jinshan Gao

Department of Chemistry and Biochemistry Faculty Scholarship and Creative Works

Despite recent advances in glycomics, glycan characterization still remains an analytical challenge. Accordingly, numerous glycan-tagging reagents with different chemistries were developed, including those involving acid-base chemistry and/or free radical chemistry. Acid-base chemistry excels at dissociating glycans into their constituent components in a systematic and predictable manner to generate cleavages at glycosidic bonds. Glycans are also highly susceptible to depolymerization by free radical processes, which is supported by results observed from electron-activated dissociation techniques. Therefore, the free radical activated glycan sequencing (FRAGS) reagent was developed so as to possess the characteristics of both acid-base and free radical chemistry, thus generating information-rich …

“No Matter How Hot It Is, You Just Have To Do The Work”: Examining Farmworkers’ Experiences With Heat And Climate Change In Idaho, Carly Hyland, Delmy Flores, Grace Augusto, Irene Ruiz, Marielena Vega, Rulon Wood

Public and Population Health Faculty Publications and Presentations

Introduction: Farmworkers are one of the populations most vulnerable to climate change. In addition to disproportionate exposure to climate-intensified hazards such as extreme heat and wildfire smoke, many farmworkers face situational and psychosocial stressors that also impact their health.

Methods: We conducted open-ended interviews with 16 farmworkers in Southcentral Idaho during June-August 2023 as part of a digital storytelling project in partnership with the Idaho Organization of Resource Councils (IORC). Interviews assessed participants’ experiences with climate change, perceived impacts on their health, and strategies and barriers to protecting themselves. Bilingual (English/Spanish) study staff translated and transcribed all video recordings verbatim, …
