Causation's Due Process Dimensions, Cassandra Burke Robertson, Charles W. "Rocky" Rhodes

For decades, courts have grappled with the tension between compensating victims of mass harms and maintaining fairness to defendants when causation is difficult to prove. This Article argues that the Supreme Court’s due process jurisprudence provides a relevant framework for navigating this tension. We contend that the Court over the last three decades has established a consistent Fourteenth Amendment due process approach in punitive damages and personal jurisdiction cases, which is rooted in antecedents tracing to the nineteenth century and relies on a nexus of interests that balances individual rights, state interests, and federalism concerns. Data show an increasing number of Catholic schools from elementary to tertiary levels in developing countries, especially countries in Sub-Saharan Africa. These new Catholic schools seem to follow the industrial-era school design trajectories. However, the exigencies of the 21st century require a paradigm shift, ensuring that Catholic schools move away from the industrial method of education that did not attend to the specific educational needs of the student to a kind of education that further enriches the holistic education offered by the Catholic school. In order to evaluate claims arising under the California Racial Justice Act (RJA), judges and attorneys need to learn how to draw inferences about racial disparity from data—and, equally importantly, to learn how to avoid drawing inaccurate inferences from data. The key questions in many RJA claims are, first, how to determine what constitutes “defendant[s] who have engaged in similar conduct and are similarly situated” and, second, what might supply race-neutral reasons for those disparities. February of 2021 marked the beginning of Minnesota clearly establishing that groundwater qualifies as a Class 1 water in a legal battle involving United States Steel, the Minnesota Pollution Control Agency, WaterLegacy, Fond du Lac Band of Lake Superior Chippewa, the Minnesota Court of Appeals, and eventually the Minnesota Supreme Court (MNSC). Minnesota has a water classification system, as required by the federal Clean Water Act, with 7 classes of use. Class 1 waters are waters used for domestic consumption (MPCA 4, n.d.). Roadside wetlands provide valuable habitat to countless aquatic invertebrates, which can provide insight into the health of the wetland system due to their diversity. Walleye Sander vitreus and Sauger Sander canadensis exist in most river and lake systems across the state of Minnesota and have historically been a highly sought-after species. Variable water temperatures play a significant role in the growth of cold-blooded organisms such as walleye and sauger. The Centers for Disease Control and Prevention (2021) reported an increase in the prevalence of persons with disabilities affecting one in four people in the United States. Disability awareness and inclusion describe how a combination of understanding, acknowledgment, compassion, and acceptance can allow persons with disability the same opportunities as those without disabilities. This can be seen with the increase in persons with a disability graduating from postsecondary institutions, about 14% from 2012 to 2022 of persons over 25. Overconsumption of meat negatively impacts human and environmental health, and these challenges are expected to worsen due to global population growth and increasing meat consumption. Many consumers appear unwilling to reduce their meat intake, and this resistance to dietary change is more common among adult men than women. However, data about meat-eating attitudes and behaviors are lacking for younger generational cohorts. Generation Z (i.e., those born between 1995 and 2010; Gen Z) is a growing consumer group whose dietary decisions will have environmental and human health consequences. Background: Vitamin D, a fat-soluble nutrient essential for bone health and calcium homeostasis, has also been implicated in cardiovascular health outcomes. Despite extensive observational studies suggesting an inverse association between vitamin D deficiency and cardiovascular diseases (CVD), randomized controlled trials (RCTs) have yielded inconsistent findings regarding the efficacy of vitamin D supplementation in reducing cardiovascular risk.

Objective: This study investigated the association between reported vitamin D supplement intake and cardiovascular health biomarkers, specifically focusing on non-HDL cholesterol, among U.S. adults using NHANES 2021-2023 data.

Bowel dysfunction, is a prevalent and life-impacting comorbidity of spinal cord injury (SCI) with no long-term treatment available. SCI-induced colon changes including motility and fibrosis are understudied as are strategies to address SCI bowel dysfunction. This need remains partly due to the lack of a mouse model that recapitulates the human condition. We hypothesized that a high thoracic spinal transection in mice would trigger bowel dysfunction with coincident colon pathology similar to humans and rats after SCI. We observed bowel dysfunction as increased fecal pellet numbers within the colon, smaller pellet size, and decreased motility. Fecal pellets numbers in the …

This study investigated the influence of leadership on adopting Artificial Intelligence (AI) in corporate communication within two civil society organizations (CSOs)—the Kenya Human Rights Commission (KHRC) and Transparency International-Kenya (TI-Kenya). The study used a qualitative method to identify AI tools in corporate communication, examine leadership approaches that influence AI adoption, scrutinize employee perceptions of leadership influence on AI use, and identify the motivators and barriers to adopting AI. Data collected through interviews and Focus Group Discussions (FGDs) revealed that 23 AI tools were employed across various corporate communication functions to enhance efficiency and productivity. Multiple, convergent risk factors place Latina youth at disproportionate risk for mental

and sexual health issues. Yet, their firsthand perspectives and experiential knowledge of

how to navigate mental and sexual health challenges is rarely the subject of scholarly

inquiry. This article presents a multi-modal content analysis of themes and messages

conveyed by two digital zines created by Latina young adults for Latina teens through an

arts-based research project. In this arts-based research, zines functioned as both data and

method, capturing Latina youth’s nuanced perspectives and lived experiences of mental

Toxoplasma gondii is an extremely ubiquitous parasite that can be found in most terrestrial species, with the potential to infect marine species as well. T. gondii has been found to encyst in bivalve species across the world, with some cases finding market oysters testing positive. This study tested 22 oysters, 11 from 2 different farms in the Humboldt Bay, for Toxoplasma gondii utilizing Polymerase Chain Reaction and Gel Electrophoresis.

Objectives: This study examined geographical patterns of HIV risk among adults aged 60 and older.

Methods: The 2019 Behavioral Risk Factor Surveillance System (BRFSS) weighted data was used to analyze self-reported participation in HIV risk behaviors among older adults (n = 62,852). Logistic regression models were used on a dichotomous HIV risk variable to map the distribution of HIV risk behaviors across both census regions and divisions.

Results: The weighted model revealed significance across regions. Across all regions, identifying as female, identifying as Hispanic, and reporting not having depression were protective from participating in HIV risk behaviors.

This research aimed to investigate the effects of hydroponically cultivated vetiver grass (Vetiveria zizanioides) on the treatment of tannery wastewater for chromium (Cr) removal in Bangladesh. The field experiment involved 9 containers, which were separated into 3 groups: tannery wastewater with hydroponically planted vetiver, tannery wastewater without vetiver (control), and a group with vetiver grown in tap water. The tap water group was used solely for plant growth assessment, whereas only the control and hydroponic vetiver groups were evaluated for Cr and water quality parameters. Managing waste with grease traps poses a challenge because of the potential environmental issues associated with its disposal. In this study, two approaches were investigated to increase the biodegradability of grease trap waste: 1) converting raw grease trap waste into soap and 2) supplementing grease trap soap as inoculum with calcium material. The preparation of grease trap soap was optimized to attain a soap yield of 103% by utilizing a water-to-ethanol ratio of 9:1 at 80 °C for a processing time of 3 hours. A comparison of the composting results revealed higher nitrate yields with increased ratios of grease trap …
