Stemming The Tide Of Aboriginal Incarceration, Miriam Kelly, Hilde Tubex Jan 2015

Stemming The Tide Of Aboriginal Incarceration, Miriam Kelly, Hilde Tubex

The University of Notre Dame Australia Law Review

Western Australia’s prison population has the highest rate of Aboriginal over-representation in Australia. Research on the criminogenic effect of imprisonment suggests that the use of imprisonment as a deterrent to future offending is not empirically supported and that imprisonment may in fact contribute to further offending. Consequently, this article explores theoretical debates surrounding penality as a way to inform alternative crime control strategies to imprisonment. It will be argued that any strategy to reduce Aboriginal imprisonment rates could benefit from a perspective that views Aboriginal imprisonment as a manifestation of Aboriginal resistance to settler colonial dominance.

Attachment, Anxiety, And Depression: A Study Of Women In Residential Treatment With Their Children At The Susan B. Anthony Recovery Center (Sbarc) (1995-2010), Gary Miles Forrest Jan 2015

Attachment, Anxiety, And Depression: A Study Of Women In Residential Treatment With Their Children At The Susan B. Anthony Recovery Center (Sbarc) (1995-2010), Gary Miles Forrest

Department of Family Therapy Dissertations and Applied Clinical Projects

The Susan B. Anthony Recovery Center (SBARC) in Pembroke Pines, Florida is a residential center where women live with their children while receiving treatment for a variety of co-occurring substance abuse and mental health issues and while participating in mandatory parenting classes. Unlike most women's residential treatment centers, which address only the woman and her problems, SBARC treats the mother-infant/child dyad. I designed and created a database to examine the data previously available only in the paper client records of over 800 women who received treatment at SBARC from 1995 through 2010 in a previous project. This nonexperimental, retrospective explanatory …

Constructing Crimmigration: Latino Subordination In A “Post-Racial” World, Yolanda Vazquez Jan 2015

Constructing Crimmigration: Latino Subordination In A “Post-Racial” World, Yolanda Vazquez

Faculty Articles and Other Publications

Over the last forty years, the concern over the relationship between noncitizens and criminality has reached epic proportions. Laws, policies, procedures, and rules have been developed, the immigration and criminal justice system have been employed, and billions of dollars have been spent towards detecting, detaining, prosecuting, and removing those who are targeted as posing “the greatest threat to the nation.” As a result, a “new” phenomenon emerged, crimmigration, that not only redesigned the criminal and immigration systems, but also brought about a cultural transformation in the United State —restructuring social categories, diminishing economic and political power, and perpetuating the marginalization …

DLPP Reading Guides

What happens to a man when he is stripped of his freedom? What happens to a person when they are told they aren’t deserving of a fair chance? These are questions that, thankfully, very few people ever have to answer. Most are lucky to be born into a world where they are treated equally by those around them. Wilbert Rideau was not so lucky; he was born into a world that said he didn't matter. Trapped inside Jim Crow society with very few opportunities, Rideau would eventually make the choice to commit a terrible crime. In the aftermath of his …

Sentencing Rules And Standards: How We Decide Criminal Punishment, Jacob Schuman Jan 2015

Sentencing Rules And Standards: How We Decide Criminal Punishment, Jacob Schuman

Tennessee Law Review

Over the past 300 years, American sentencing policy has alternated between "determinate" and "indeterminate" systems of deciding punishment. Debates over sentence determinacy have so far focused on three main questions: Who should decide punishment? What makes punishment fair? Why should we punish wrongdoers at all?

In this Article, I ask a new, fourth question: How should we decide punishment? First, I demonstrate that determinate sentencing uses rules to decide sentences, while indeterminate sentencing relies on standards. Next, I show how the trigger-based nature of rules-in contrast to the qualitative character of standards-makes them vulnerable to four different kinds of substantive …

Assessing Income Eligibility By Statewide Assistance: Staying Off The Cliff's Edge, 2015, Kevin M. Fitzpatrick

Poverty

In 2013, the United States Census Bureau reported over 45 million people were living in poverty. This number is calculated by the government based on the minimum income a family needs to cover the basic necessities of life. Poverty is often interpreted by the thresholds and levels determined on a yearly basis; thresholds are an exact dollar amount that indicates whether a family’s combined income is considered to be exceedingly poor. The Federal Poverty Level (FPL) is another way the federal government measures poverty in the United States. The FPL helps guide the development of financial eligibility for federally funded …

Buffalo Soldier, Deserter, Criminal: The Remarkably Complicated Life Of Charles Ringo, Cicero Fain

History Faculty Research

This case study chronicles the remarkably complicated life of Charles Ringo who served nearly two enlistments as a Buffalo Soldier before deserting and embarking on a life of petty crime. It details his military service, his nomadic occupational life, his marriage, his acquittal of two sets of murders--one of his stepsons in West Virginia, the other of a white married couple in Illinois, and the assistance of white authorities who intervened to save and protect Ringo from the predations of angry mobs and racist courts. It situates Ringo’s exploits within the oppositional/alternative nature of African American working-class life, the failure …

The Gravely House: A Case Study In Twentieth Century Archaeology And Material Culture, Jessica L. Clark Jan 2015

The Gravely House: A Case Study In Twentieth Century Archaeology And Material Culture, Jessica L. Clark

Theses & Honors Papers

Material culture is the domain of the archaeologist. Like any science, the methods used and the answers sought in archaeology have changed, and continue to change, constantly adapting to the world in which they operate. Every century has its own legacy to be uncovered. The twentieth and twenty-first centuries are no exception to this, but their archaeological resources are only just beginning to be investigated. Through this research I sought to examine and represent the home of the Gravely family as a case study in archaeology of the early twentieth century. I first studied the historical record of the family …
