Enriching Course Development: The Use Of An International Faculty Development Experience, Anna K. Lee, Naomi M. Hall
Pedagogy and the Human Sciences
This paper discusses the use of an international faculty development experience in the development of an Introduction to Black Psychology course. Faculty attended an 11-day seminar in South Africa to learn about the country’s history and transformation into a multiracial, multicultural society. The seminar included lectures and site visits designed to provide faculty with an intercultural experience that could be used to enhance curricula and increase students’ global understanding of social issues. A highlight of the training pertains to the parallel made between the historical similarities in the Black South African and Black American experience. Transformative learning forms the theoretical …
Signal Vs. Noise: Some Comments On Professor Stein's Theory Of Evidential Efficiency, Emily Spottswood
Signal Vs. Noise: Some Comments On Professor Stein's Theory Of Evidential Efficiency, Emily Spottswood
Scholarly Publications
In this Essay, I examine Professor Stein's intriguing new theory of evidential efficiency, which posits that judges should admit evidence whenever it has a sufficiently high "signal-to-noise ratio." I explore a slightly different definition of the concepts of "signal" and "noise" than Stein, based upon likelihood ratio values rather than the underlying probabilities of events, and I explain why these altered concepts may be analytically superior. Additionally, I call into question the strength of the connection between the signal-to-noise ratio of a piece of evidence and the costs of admitting it at trial. Nevertheless, Stein's project is worthy of great …

To the great relief of many, states are now rethinking their draconian criminal justice policies of the past several decades. In addition to shrinking prison and jail populations, reforms are underway to expand opportunities for relief from the collateral consequences of conviction, such as the loss of the right to vote, serve as a juror, or work in certain occupations, which can impede the ability of ex-offenders to successfully reintegrate into society. In coming years, as states seek to reduce their high recidivism rates, such relief efforts will likely continue to grow in number; as they do, we should expect …

Latinos And The Colorline, Clara E. Rodriguez, Nancy Lopez, Grigoris Argeros
Sociology Faculty Publications
This essay reviews the issues and current literature on how “race,” skin color, and/or phenotype operate as stratifying agents among Latinos in the United States. We review the trends and emerging issues in this area with regard to health, housing and segregation, and socioeconomic status (SES), including education and criminal justice. We do so in the context of the Census Bureau’s release of its 2010 Alternative Questionnaire Experiment (AQE) study. This 5-year study focuses on how to best ask the race question. One of the key findings of the study was that including “Hispanic/Latinos” as a race in the combined questionnaire …

Oil And Water: How Legal Education's Doctrine And Skills Divide Reproduces Toxic Hierarchies, Lucille A. Jewel

The longstanding categorical distinction that elevates doctrinal teaching over skills teaching continues to harm the profession of law. In this Article, I consider two distinct effects produced by the doctrine/skills dichotomy. First, the dichotomy is responsible for reinforcing class, gender, and race segmentation in legal education, which limits the quality of instruction that law schools can provide and abets the reproduction of existing power relations in the legal profession and society at large.
Second, the antipodal positioning of doctrine and theory over skills and practice harms law schools’ ability to prepare a new generation of law students to engage in …

Legal models of adolescent autonomy and responsibility in various domains of law span a spectrum from categorical prohibitions of certain behaviors to recognitions of total adolescent autonomy. The piecemeal approach to the limited decision-making capacity of adolescents lacks an empirical foundation in the differences between adolescent and adult decision-making, leading to counterintuitive and inconsistent legal outcomes. The law limits adolescent autonomy with respect to some decisions that adolescents are perfectly competent to make, and in other areas, the law attributes adult responsibility and imposes adult punishments on adolescents for making decisions that implicate their unique volitional vulnerabilities. As developmental neuroscientists …

Comprehensive coordinated specialty care programs for first-episode psychosis have been widely implemented in other countries but not in the United States. The National Institute of Mental Health's Recovery After an Initial Schizophrenia Episode (RAISE) initiative focused on the development and evaluation of first-episode treatment programs designed for the U.S. health care system. This article describes the background, rationale, and nature of the intervention developed by the RAISE Early Treatment Program project-known as the NAVIGATE program-with a particular focus on its psychosocial components. NAVIGATE is a team-based, multicomponent treatment program designed to be implemented in routine mental health treatment settings and …

Creating Activating Events For Transformative Learning In A Prison Classroom, Cheryl H. Keen, Robert Woods
Walden Faculty and Staff Publications
In this article, we interpreted, in light of Mezirow’s theory of transformative learning, interviews with 13 educators regarding their work with marginalized adult learners in prisons in the northeastern United States. Transformative learning may have been aided by the educators’ response to unplanned activating events, humor, and respect, and assumed roles of role model, and counselor. Teachers presented activating events they perceived supported resistant learners to alter their meaning schemes and revise their frames of reference. Administrators of educational programs for marginalized adult learners can help prison educators develop these pedagogical practices. Practitioners and researchers may wish to explore humor …
