The Prioritization Of Criminal Over Civil Counsel And The Discounted Danger Of Private Power, Kathryn A. Sabbeth
The Prioritization Of Criminal Over Civil Counsel And The Discounted Danger Of Private Power, Kathryn A. Sabbeth
Florida State University Law Review
This Article seeks to make two contributions to the literature on the role of counsel. First, it brings together civil Gideon research and recent studies of collateral consequences. Like criminal convictions, civil judgments result in far-reaching collateral consequences, and these should be included in any evaluation of the private interests that civil lawyers protect. Second, this Article argues that the prioritization of criminal defense counsel over civil counsel reflects a mistaken view of lawyers’ primary role as a shield against government power. Lawyers also serve a vital role in checking the power of private actors. As private actors increasingly take …
The Lancaster County Juvenile Reentry Project - Follow-Up Report, Anne M. Hobbs, Sommer Fousek
The Lancaster County Juvenile Reentry Project - Follow-Up Report, Anne M. Hobbs, Sommer Fousek
Reports
In 2011, Lancaster County received a planning grant under the Second Chance Act administered by the Office of Juvenile Justice and Delinquency Prevention. Using these funds, a team of stakeholders examined the limited reentry services available to juveniles who return to Lancaster County after a stay in a Nebraska Youth Rehabilitation and Treatment Center (YRTC).
The following year, Lancaster County officials brought together multiple agencies to develop a systematic juvenile reentry approach, which subsequently became known as the Lancaster County Juvenile Reentry Project. From January 1, 2013 to June 30, 2015, a total of 126 youth were served under the …

Becoming "Smart" About Relationship Building: Foster Care Youth And The Use Of Technology, Ramona Denby Brinson, Efren Gomez, Keith A. Alford
Lincy Institute Reports and Briefs
Key Findings:
Youth participants reported satisfaction with services and positive feelings about the smartphone.
The youth participants felt that the smartphone gave them a “voice” and control over the people with whom they wanted to talk.
Certain phone restrictions developed by project leadership were unenforceable.
Youth had certain expectations about the phone and its use but when the phone did not work or was “locked” (e.g., for data overuse) it created friction between the youth and their service provider.
Service-providers report that the phones help to create a sense of normalcy for the youth. Youth “were able to be normal …

To ensure that the Thirteenth Amendment has modern application in a manner consistent with these important constitutional considerations and these cases, the Amendment should no longer be interpreted to prohibit the “badges and incidents” of slavery, a non-textual category of harms that is virtually limitless in scope and is therefore virtually limitless as a source of congressional action. Instead, drawing from the Amendment’s textual prohibitions against “slavery” and “involuntary servitude,” direct or functional limitations on physical mobility should be the touchstone for the enforcement power moving forward. To justify this proposal, this Article summarizes the Supreme Court’s Thirteenth Amendment jurisprudence, …

Psychology Faculty Research and Scholarship
Early interventions are a preferred method for addressing behavioral problems in high-risk children, but often have only modest effects. Identifying sources of variation in intervention effects can suggest means to improve efficiency. One potential source of such variation is the genome. We conducted a genetic analysis of the Fast Track randomized control trial, a 10-year-long intervention to prevent high-risk kindergarteners from developing adult externalizing problems including substance abuse and antisocial behavior. We tested whether variants of the glucocorticoid receptor gene NR3C1 were associated with differences in response to the Fast Track intervention. We found that in European-American children, a variant …
Don't Call Me Crazy: A Survey Of America's Mental Health System, Justin L. Joffe
Don't Call Me Crazy: A Survey Of America's Mental Health System, Justin L. Joffe
Chicago-Kent Law Review
Unfortunately, the typical exposure to mental illness for most Americans comes via tragic mass shootings or highly publicized celebrity mental breakdowns. However, the vast majority of mentally ill individuals are not violent murderers or hyper-tweeting celebrities. Rather, they are the ordinary, everyday people that make up the tens of millions of American adults suffering from some form of mental illness. The American mental health system has a lamentable history. The initial policy of locking up mentally ill individuals in jails transitioned to a system of confinement in asylums that quickly became notorious for their poor living conditions and treatment. The …

Does Work Law Have A Future If The Labor Market Does Not?, Noah D. Zatz
Does Work Law Have A Future If The Labor Market Does Not?, Noah D. Zatz
Chicago-Kent Law Review
This Essay is based on the 37th Annual Kenneth M. Piper Lecture. It offers a new perspective on the much-discussed “future of work.” That discussion typically highlights changes within the labor market that undermine the employment relationship’s role as the bedrock for work regulation. But might something even deeper be afoot, namely the disintegration of “the labor market” itself? Several recent developments challenge the legal construction of employment as occurring wholly inside a distinctive, and distinctively economic, market sphere. This Essay considers Uber and the relationship between work and “sharing,” Hobby Lobby and the relationship between work and religion, the …

Dna Storage Banks: The Importance Of Preserving Dna Evidence To Allow For Transparency And The Preservation Of Justice, Cristina Martin
Chicago-Kent Law Review
What is the duty to preserve information in today’s society? In order for humanity to evolve, change and flourish in the future, society needs to preserve its information from the past. In the criminal justice field, preservation of evidence has special significance. DNA evidence in particular has become a helpful aid for innocent defendants who have been improperly imprisoned. Over the past twenty years, the number of exonerations of imprisoned criminal defendants has increased dramatically. With the advancement of technology, old, previously untestable or improperly tested DNA evidence will need to be retested. However, most states do not have proper …

Not Treble Damages: Cartel Recoveries Are Mostly Less Than Single Damages, John M. Connor, Robert H. Lande

Antitrust law provides treble damages for victims of antitrust violations, but the vast majority of private cases settle. The average or median size of these settlements relative to the overcharges involved has, until now, been only the subject of anecdotes or speculation. To ascertain what we term "Recovery Ratios," we assembled a sample consisting of every completed private U.S. cartel case discovered from 1990 to mid-2014 for which we could find the necessary information. For each of these 71 cases we collected, we assembled neutral scholarly estimates of affected commerce and overcharges. We compared these to the damages secured in …

The Right To Work In Argentina : Job Policy And Economic Rights In A Worker Cooperative, Patricia Kent
Latin American Studies ETDs
This thesis provides an exploration of an empresa recuperada por sus trabajadores (worker recovered enterprise, ERT) case study in Argentina in an effort to understand their impact to employment retention during economic crisis. Part of the larger social upheaval resulting from failed economic liberalization during the 1990s, ERTs attempt to implement an alternative economic development strategy through self-management of previously private enterprises. This thesis explores one ERT located in Florencio Varela, Argentina, in an effort to understand the impact the ERTs have in local communities in terms of employment retention and social capital production. Lastly, the analysis examines the role …

The present research paper aims to shed light on the immensely traumatic experience of an acid attack victim – right from the difficulty in getting medical aid, to obtaining adequate compensation, to getting justice. In spite of the fact that these victims are victims of one of the most gruesome forms of assault, the Government and Judiciary have remained largely apathetic to their plight. However, in recent times, there has bun a marked change in both the legislative and judicial approach. The paper seeks to focus on this shift. highlighting both the negative and positive aspects involved In Laxmi v. …
