Financing Ohio Supreme Court Elections 1992-2002: Campaign Finance And Judicial Selection, Nancy Marion, Rick Farmer, Todd Moore
Financing Ohio Supreme Court Elections 1992-2002: Campaign Finance And Judicial Selection, Nancy Marion, Rick Farmer, Todd Moore
Akron Law Review
The 2000 Ohio Supreme Court election renewed interest in judicial selection reform. The election was noted for interest group issue advocacy and undisclosed campaign spending. Advocacy groups spent millions attempting to unseat incumbent Justice Alice Robie Resnick, leaving the impression that Ohio justice is controlled by special interests and trial lawyers. The uses of negative campaigning and issue advocacy seemed to confirm suspicions that the Ohio Supreme Court had become dependent on campaign contributions from those with cases before the court. After the election, legal academics and public interest organizations began discussing changes to Ohio’s semi-partisan system. Legal scholarship focused …

The Wisdom And Morality Of Present-Day Criminal Sentencing, Joshua Dressler
The Wisdom And Morality Of Present-Day Criminal Sentencing, Joshua Dressler
Akron Law Review
This lecture was delivered at the University of Akron School of Law on April 1, 2004...Today I want to talk about criminal sentencing and its connection, or I fear lack of connection, to basic principles of punishment that are supposed to make our system rational and morally just. Let’s keep in mind that, everyday, in courts all over the country, judges are sentencing persons to prison. They are doing that in our name. Punishment— sentencing people to prison—involves intentionally inflicting pain on persons by denying them liberty, which we all value, and separating them from their community. Certainly, we need …
Analyzing U.S. Commitment To Socioeconomic Human Rights, Philip C. Aka
Analyzing U.S. Commitment To Socioeconomic Human Rights, Philip C. Aka
Akron Law Review
This Article critiques the U.S. government’s approach to human rights. In particular, it assesses U.S. commitment to socioeconomic human rights. These guarantees encompass, among others, the right to work, including the securement of favorable conditions of work through participation in trade union activities, the right to social security, the right to food, the right to education, the right to adequate health care, and the right to housing, along with the general right to be free from extreme poverty. These rights were inspired by the Universal Declaration, and elaborated by the International Covenant on Economic, Social and Cultural Rights (ICESCR). This …

Chief Justice William Rehnquist: His Law-And-Order Legacy And Impact On Criminal Justice, Madhavi M. Mccall, Michael A. Mccall
Akron Law Review
In this article, we explore Chief Justice Rehnquist’s criminal justice decisions through an empirical analysis of the Court’s decision-making tendencies for the most recent natural court and a review of selected criminal justice decisions written by Justice Rehnquist throughout his career. To start, we limit the analysis, with only two exceptions, to decisions actually written by Justice Rehnquist. Although Chief Justice Rehnquist, in that position, had an important role in leading other justices to agree with him by assigning cases, we gleaned a substantial amount of information regarding his decisional patterns and policy preferences by analyzing the opinions he personally …
Implicit Bias And Capital Decision-Making: Using Narrative To Counter Prejudicial Psychiatric Labels, Sean O'Brien, Kathleen Wayland
Implicit Bias And Capital Decision-Making: Using Narrative To Counter Prejudicial Psychiatric Labels, Sean O'Brien, Kathleen Wayland
Faculty Works
Overreliance on psychiatric diagnostic labels in the defense of death penalty cases risks triggering prejudicial associations in the minds of decision-makers. This article emphasizes the importance of developing a mitigating counter-narrative of the defendant’s life story, based on an extensive longitudinal and developmental investigation of the defendant and his family’s life trajectory. It is the client’s life story, not diagnostic labels, that reveals his humanity. Cognitive psychology provides a useful framework for explaining human perceptions, and how implicit or explicit biases can interfere with the objective interpretation of data in ways that affect judgment and behavior.

Professional Women Silenced By Men-Made Norms, Maritza I. Reyes
Professional Women Silenced By Men-Made Norms, Maritza I. Reyes
Akron Law Review
This Article proceeds in eight Parts. Part I narrates my path to “academic feminism” and the legal academy. In the tradition of feminist scholars before me, I set forth the personal to provide the background for the socio-legal-political views that inform this Article...Part II explains the need for broader perspectives and approaches to legal scholarship. It is important for the legal academy to recognize that, just like the legal market is calling for changes, we have to stop silencing the development of scholarship andperspectives that can bring forth the change we need. The academy has already benefited from the work …
A Dean For All Seasons, Steven H. Goldberg
A Dean For All Seasons, Steven H. Goldberg
Pace Law Review
The average tenure of a law school dean in the United States is three years, in large part because the task is both eclectic and difficult. Michelle Simon, the longest tenured Dean at our law school, was able to surpass that average because she was a dean for all seasons: Leadership and care of faculty; attention to student concerns; financial acumen; curricular relevance; keeping the day-to-day operation of a multi-faceted institution on track; maintaining a close but arms-length relationship with the university; and managing external relations on all fronts.

Ratios, (Ir)Rationality & Civil Rights Punitive Awards, Caprice L. Roberts
Akron Law Review
This article will focus on the effect of the Court’s tightening of the ratio prong on federal civil rights cases. In particular, it addresses whether federal appellate courts feel constrained by State Farm’s stated preference for single-digit ratios, or instead, jettison the ratio strictures in favor of other prongs...The problems are two-fold in civil rights line of cases: (1) some federal circuit courts bar punitive damages if there are no compensatory damages; and (2) courts reviewing a punitive award where compensatory damages exist may feel compelled to apply rigidly a single-digit ratio to comport with State Farm. Barring or severely …
Obama, The Fourteenth Amendment, And The Drug War, Martin D. Carcieri
Obama, The Fourteenth Amendment, And The Drug War, Martin D. Carcieri
Akron Law Review
This article is written to help clarify the full range of understanding Obama would bring to a second term.
Specifically, I defend two related, contested theses. My core thesis, to which this article is primarily devoted, is a jurisprudential claim: contrary to state and lower federal court rulings, marijuana prohibition is subject to strict judicial scrutiny under leading relevant U.S. Supreme Court jurisprudence. I support this thesis primarily by showing that under the Fourteenth Amendment, bodily autonomy—i.e., the control over the borders and contents of one’s body burdened by laws like marijuana prohibition—is a fundamental right, and that the Court …
Corporal Punishment And Child Development, Jason Fuller
Corporal Punishment And Child Development, Jason Fuller
Akron Law Review
Growing academic, political, and media pressure has persuaded twenty countries to ban physical discipline—that is, to take children from their families because of spanking...However, if youth violence and dysfunction is increasing at the same time that corporal punishment is decreasing, we should be open enough to consider whether the two trends are related. Maybe there is no connection. But maybe lawmakers and child welfare workers should pay more attention to the research suggesting that physical discipline can be helpful in certain contexts...To function in society, people must learn to control themselves enough to not break the law or harm other …

Chimeras: Double The Dna-Double The Fun For Crime Scene Investigators, Prosecutors, And Defense Attorneys?, Catherine Arcabascio
Akron Law Review
This article first explores the mythological origins of the term “chimera.” It then explores the causes and scientific explanations of chimerism and the various conditions covered by the term chimera in the area of genetics. Although this article will discuss the various chimeric conditions that are thought to exist, its primary focus is on chimerism that is the result of the fusing of embryos in utero. Next, the article will discuss recent cases of chimerism – and of alleged chimerism – and how the genetic differences between chimeras and the general population came to light. It also will discuss the …
Refusing To Remove An Obstacle To The Remedy: The Supreme Court's Decision In Town Of Castle Rock V. Gonzales Continues To Deny Domestic Violence Victims Meaningful Recourse, Nicole M. Quester
Akron Law Review
The Supreme Court’s opinion in Castle Rock illustrates that more conscious efforts must be made by every branch of the legal system to eradicate domestic abuse. The entire legal system must work together to raise the curtain on domestic violence. Legislatures must continue to promote social change in the area of domestic violence, and courts must enforce legislation without questioning the legislature’s policy determinations. Police departments must enforce strict policies aimed at protecting the abused, while being held accountable when failing to provide any measure of protection. The legal system must heed a woman’s pleas for help and prevent court …
Two Wrongs Don't Make A Fourth Amendment Right: Samson Court Errs In Choosing Proper Analytical Framework, Errs In Result, Parolees Lose Fourth Amendment Protection, Rachael A. Lynch
Akron Law Review
This Note will follow the Fourth Amendment from its origins to its modern application to parolee rights, as evidenced by the Samson Court. Part II focuses on the Fourth Amendment, from the circumstances surrounding its adoption to modern court cases that have applied its tenets to prisoners, probationers, and, finally, parolees. Part III details the Supreme Court’s decision in Samson v. California, including a thorough discussion of the facts that gave rise to the case and lower court decisions. Part IV explores the problems with the Court’s framework and suggests other possible frameworks the Court could have used to come …

Empirical Assessment Of Lifestyle-Routine Activity And Social Learning Theory On Cybercrime Offending, Elizabeth Phillips
Master’s Theses and Projects
The Internet and its overwhelming possibilities and applications have changed the way individuals carry out many routine activities such as going to work or school, or socializing. Social networking sites such as Facebook are ideal settings for interacting with others, and unfortunately, are also ideal settings for committing cybercrimes. The purpose of this study is to investigate the occurrence of online offending against individuals, specifically harassment, stalking, impersonation, and sexting. Self-report surveys collected from a sample of 274 college students were examined using a negative binomial statistical analysis to determine possible relationships between risky online and offline lifestyles as well …
