Punitive Compensation, Cortney E. Lollar
Punitive Compensation, Cortney E. Lollar
Law Faculty Scholarly Articles
Criminal restitution is a core component of punishment. In its current form, this remedy rarely serves restitution's traditional aim of disgorging a defendant's ill-gotten gains. Instead, courts use this monetary award not only to compensate crime victims for intangible losses, but also to punish the defendant for the moral blameworthiness of her criminal action. Because the remedy does not fit into the definition of what most consider "restitution," this Article advocates for the adoption of a new, additional designation for this prototypically punitive remedy: punitive compensation. Unlike with restitution, courts measure punitive compensation by a victim's losses, not a defendant's …

“Best Culinary Destination.” “Best City for Night Owls.” “Best NFL City to Party In.“ “Best City for Girlfriend Getaways.” “Top National Halloween Destination.” “Best Destination in the US and World for Nightlife.” “America's Favorite City.” And on. And on. The list of tourist destination rankings and accolades have mounted in the 10 years since Hurricane Katrina threatened to decimate New Orleans's tourism industry and, quite possibly—as some predicted and others hoped for—New Orleans itself. Things are different now. Recently, the New York Times proclaimed that New Orleans was “resilient and renewed, a decade after Katrina.” Listing New Orleans as one …

Genetic Influences On Peer And Family Relationships Across Adolescent Development: Introduction To The Special Issue, Lisabeth Fisher Dilalla, Paula Y. Mullineaux
Articles
Nearly all aspects of human development are influenced by genetic and environmental factors, which conjointly shape development through several gene-environment interplay mechanisms. More recently, researchers have begun to examine the influence of genetic factors on peer and family relationships across the pre-adolescent and adolescent time periods. This article introduces the special issue by providing a critical overview of behavior genetic methodology and existing research demonstrating gene-environment processes operating on the link between peer and family relationships and adolescent adjustment. The overview is followed by a summary of new research studies, which use genetically informed samples to examine how peer and …

Governing New Jersey: Reflections On The Publication Of A Revised And Expanded Edition Of 'The Governors Of New Jersey', Michael J. Birkner
History Faculty Publications
New Jersey’s chief executive enjoys more authority than any but a handful of governors in the United States. Historically speaking, however, New Jersey’s governors exercised less influence than met the eye. In the colonial period few proprietary or royal governors were able to make policy in the face of combative assemblies. The Revolutionary generation’s hostility to executive power contributed to a weak governor system that carried over into the 19th and 20th centuries, until the Constitution was thoroughly revised in 1947. Before that date a handful of governors, by dint of their ideas and personalities, affected the polity in meaningful …

I Did My Time: The Transformation Of Indiana’S Expungement Law, Joseph C. Dugan
Indiana Law Journal
This Note evaluates the transformation of Indiana’s expungement law. Part I addresses the socioeconomic impacts of a criminal record. Part II presents normative arguments both for and against expungement, concluding that the balance tips in favor of forgiveness. Parts III–IV discuss Indiana’s original expungement provisions, the 2013 statute, and the 2014 amendments. Part V explores the reaction to the new law. Finally, Part VI offers recommendations to improve the statute so that its second-chance promise is equitable, accessible, and robust.
