Ai Regulation In Health Care: How Washington State Can Conquer The New Territory Of Ai Regulation, Natalie Shen
Ai Regulation In Health Care: How Washington State Can Conquer The New Territory Of Ai Regulation, Natalie Shen
Seattle Journal of Technology, Environmental, & Innovation Law
- The use of artificial intelligence both generally and in the health care field has exploded over the last decade. AI is now used in the health care field in areas like disease diagnostics, patient engagement, and administrative tasks. In disease diagnostics specifically, AI is being used to make life-altering diagnoses. This technology, however, does not come without its risks. Specifically, inherent bias is deeply rooted in the AI algorithms. This is because humans are inherently bias, and humans are the people creating the AI algorithms. The problem is, however, is that there are no federal regulations to mitigate the risks …

On New Year’s Eve night, 2019, sixteen-year-old Selena Shelley Faye Not Afraid attended a party in Billings, Montana, about fifty miles west of her home in Hardin, Montana, near the Crow Reservation. A junior at the local high school, she was active in her community. The party carried over until the next day, and she caught a ride back toward home with friends in a van the following afternoon. When the van stopped at an interstate rest stop, Selena got out but never made it back to the van. The friends reported her missing to the police and indicated they …
Outcome Sensitivity And The Constitutional Law Of Criminal Procedure, Lee Kovarsky
Outcome Sensitivity And The Constitutional Law Of Criminal Procedure, Lee Kovarsky
Indiana Law Journal
Iconic criminal procedure doctrines that perform the same function go by different names. When constitutionally disfavored conduct taints a criminal proceeding, courts must determine how much the taint affected an outcome—and whether the damage requires judicial relief. These doctrinal constructs calibrate judicial responses to, among other things, deficient defense lawyering (prejudice), wrongful State suppression (materiality), unlawful policing (attenuation), and an assortment of trial-court mistakes (harmless error). I refer to these constructs, which tightly orbit the constitutional law of criminal procedure, as rules of “outcome sensitivity.” Formal differences in sensitivity rules remain enduring puzzles subject to only the most superficial inspection. …
The Proactive Model: How To Better Protect The Right To Special Education For Incarcerated Youth, John Bignotti
The Proactive Model: How To Better Protect The Right To Special Education For Incarcerated Youth, John Bignotti
Indiana Law Journal
The Individuals with Disabilities Education Act (IDEA) guarantees access to a specialized, appropriate public education for youth with disabilities in the United States. While progress has been made and this right to education extends to incarcerated youth as well as those outside the juvenile justice system, there is nonetheless a fundamental limitation on how this federal requirement is imposed in the carceral context: it is enforced through primarily reactive mechanisms. Lawsuits, state compliance regimes, and consent decrees can hold states and juvenile facilities accountable after systemic failures to comply with the IDEA; however, the inherent inconsistency and slow pace of …
On Warrants & Waiting: Electronic Warrants & The Fourth Amendment, Tracy Hresko Pearl
On Warrants & Waiting: Electronic Warrants & The Fourth Amendment, Tracy Hresko Pearl
Indiana Law Journal
Police use of electronic warrant (“e-warrant”) technology has increased significantly in recent years. E-warrant technology allows law enforcement to submit, and magistrate judges to review and approve, warrant applications on computers, smartphones, and tablets, often without any direct communication. Police officers report that they favor e-warrants over their traditional, paper counterparts because they save officers a significant amount of time in applying for warrants by eliminating the need to appear in-person before a magistrate. Legal scholars have almost uniformly praised e-warrant technology as well, arguing that use of these systems will increase the number of warrants issued throughout the United …

Trauma-Informed (As A Matter Of) Course, Natalie Netzel
Faculty Scholarship
Law students are impacted by trauma and law professors are in a position to help by adopting a trauma-informed approach as a matter of universal precaution. The 2021 Survey of Law Student Well-Being (“SLSWB”) revealed that over twenty percent of responding law students meet criteria that indicate they should be evaluated for post-traumatic stress disorder (“PTSD”). The study also revealed that almost fifty percent of responding students reported an important motivation for attending law school was experiencing a trauma or injustice. Put differently, law schools are full of law students who have experienced trauma, many of whom are actively struggling …

A New Life For The Read Scale: Calibrating A Time And Effort Measure For Patron Interactions, Bettina Peacemaker, Megan Hodge
A New Life For The Read Scale: Calibrating A Time And Effort Measure For Patron Interactions, Bettina Peacemaker, Megan Hodge
VCU Libraries Faculty and Staff Publications
Why did you do this activity, project, or research?
Patron interaction statistics tell compelling stories. However, rich interactions are often reduced to a single number. The READ (Reference Effort Assessment Data) Scale adds a welcome qualitative dimension. Academic libraries embraced the scale to measure the effort and knowledge provided by those staffing information and research service points. The 6-point scale is relatively simple and easy to implement, with interactions involving no specialized knowledge and effort at one end with those requiring the most on the other end. Developed by Gerlich and Berardt in 2003, it is still widely used in …
The Essentials For Leaders To Motivate Volunteers And Workers, Angelique Burris
The Essentials For Leaders To Motivate Volunteers And Workers, Angelique Burris
Doctor of Education Dissertations
Most organizations were created because there was a need for a service, product, or mission that would assist others in need. When considering what compels volunteers and workers to be consistent in organizations, motivation is imperative. The behavior of leadership, especially the ability to influence, has affected the volunteers and workers of the company in a positive or negative way. Leaders have played a chief role in drawing and retaining workers and volunteers. The purpose of this study was to show that our motivations are already inside of us, and this was key for leaders to realize the importance of …
A Content Analysis Of State-Level Restorative Justice Statutes, Mason Karlyn Myers
A Content Analysis Of State-Level Restorative Justice Statutes, Mason Karlyn Myers
Electronic Theses and Dissertations
Restorative justice programs have garnered attention as a potential policy solution to address critical issues within the criminal justice system, such as mass incarceration, re-victimization, and costliness. However, effective implementation of these programs faces various challenges, including communication gaps, inadequate program design, and implementation issues. These challenges may be further exacerbated by the lack of consistent policies at the state level guiding restorative justice practices. Surprisingly, limited research has been conducted to examine restorative justice statutes at the state level. In response to this gap in the literature, this study analyzes the restorative justice policies of all fifty states, including …

A Review Of Mental Health Intake Assessments In Mississippi Jails, Sierra Molina
Electronic Theses and Dissertations
Over 64 percent of jail inmates report mental health concerns in the United States. Limited research, however, has explored the guidelines provided by jail facilities for screening and assessing mental illness. To address this gap in the literature, this study used a qualitative design to examine the intake policy guidelines for mental health screening in Mississippi jails. Furthermore, it explored the following questions to discover themes relating to correctional mental health: how many facilities have policies relating to screening for mental health symptoms; how are these guidelines defined by correctional officials; is there variation across location and facility; and are …

Lockdowns During The Covid-19 Pandemic And Domestic Violence Among Virginians, Kenneth G. Gordon
Lockdowns During The Covid-19 Pandemic And Domestic Violence Among Virginians, Kenneth G. Gordon
Walden Dissertations and Doctoral Studies
AbstractThe domestic violence (DV) dilemma spans millennia and has devastated individuals, families, and societies. DV prevalence rose between 20% and 50% worldwide and over 5% among Virginians since early 2020 during COVID-19. Abuse victims’ vulnerability increased during the lockdown periods due to the extended time spent with perpetrators. DV victims visited emergency departments for their nonfatal physical injuries. The purpose of the study was to examine COVID-19-related lockdown effects on DV prevalence, perpetrator characteristics, and hospitalizations among Virginians. Bronfenbrenner’s socioecological model served as the theoretical foundation. Descriptive analyses showed that DV prevalence among Virginians rose from 37.5% in 2019 to …

Louisiana Survey 2023, Lsu Reilly Center For Media & Public Affairs
Reilly Center Louisiana Surveys
The 2023 Louisiana Survey is the twenty-first in an annual series of statewide surveys beginning in 2003 and sponsored by the Reilly Center for Media & Public Affairs at Louisiana State University’s Manship School of Mass Communication.
Reflecting the continuing evolution of survey research, we used two approaches for this year’s survey. First, we used our traditional probability-sampling approach to draw landline and cell phone numbers for a live-interview telephone survey. Second, in partnership with the research firm YouGov, we administered an online survey to a nonprobability sample of Louisiana residents who participate in the YouGov panel. We use statistical …

A Cyclically Adjusted Spatio-Temporal Kernel Density Estimation Method For Predictive Crime Hotspot Analysis, Ya Han, Yujie Hu, Haojie Zhu, Fahui Wang
Faculty Publications
This paper presents a new method for predictive crime hotspot analysis that further improves the kernel density estimation (KDE) method and the spatio-temporal kernel density estimation (STKDE) method by accounting for temporal crime cycles and is therefore termed the ‘cyclically adjusted STKDE (cSTKDE) method’. The case study on robbery incidents in Baton Rouge, Louisiana, shows a temporal cycle with a 6-month period of statistical significance from January 2010 to May 2018. This identified period is incorporated into the temporal kernel function of the new cSTKDE method. For validation, the Forecast Accuracy Index (FAI) and Forecast Precision Index (FPI) are used …
Adolescent Health And Maladaptive Coping: Assessing The Relationship Between Poor Physical Health And Underage Drinking, Shelby Gilbreath
Adolescent Health And Maladaptive Coping: Assessing The Relationship Between Poor Physical Health And Underage Drinking, Shelby Gilbreath
Electronic Theses and Dissertations
Adolescents endure various stressors throughout their lives, making them one of the most vulnerable populations in the United States. Among those life stressors are physical health issues, including physical illness and disabilities. Physical health challenges may serve as a strain that fosters deviant behavior, such as underage drinking. However, prior research has failed to investigate this relationship. The current study uses publicly available data from the National Study of Adolescent to Adult Health (Add Health) to examine the impact of physical health challenges on underage drinking.
Assessing The Relationship Between School Disengagement And Violence Involvement, Senneca Evans
Assessing The Relationship Between School Disengagement And Violence Involvement, Senneca Evans
Electronic Theses and Dissertations
Social control theory suggests that having strong social bonds to a society prevents individuals from engaging in delinquent acts. Consistent with the main assumption of this theoretical framework, the current study assesses whether having a weak bond to school, specifically, school disengagement, impacts violent behavior among adolescents. The current study also assesses whether gender and race/ethnicity moderate the relationship between school disengagement and violence involvement. Data used in this study were obtained from the National Longitudinal Study of Adolescents to Adult Health public-use data (N = 6,045). Results show that school disengagement is a significant predictor of violent behavior among …
Whitewashing The Fourth Amendment, Daniel S. Harawa
Whitewashing The Fourth Amendment, Daniel S. Harawa
Faculty Articles
A conventional critical race critique of the Supreme Court and its Fourth Amendment jurisprudence is that it erases race. Scholars argue that by erasing race, the Court has crafted doctrine that is oblivious to people of color’s lived experiences with policing in America. This Article complicates this critique by asking whether it is solely the Court that is doing the erasing. It explores how race was — or more accurately, was not — litigated in seminal Fourth Amendment cases scholars have targeted for attack: Florida v. Bostick, Illinois v. Wardlow, and United States v. Drayton. As the Article shows, race …

Battle For Our Souls: A Psychological Justification For Corporate And Individual Liability For Organizational Misconduct, Jennifer H. Arlen, Lewis A. Kornhauser
Faculty Articles
In this Article, we undertake the first analysis of optimal individual and corporate liability for organizational misconduct that incorporates crucial insights from psychology about people’s motivations, their decision-making processes, and how laws and organizations affect people’s behavior. Specifically, we develop an evidence-based deterrence theory predicated on empirical evidence from psychology that people have other- regarding preferences, the law can deter by expressing social condemnation as well as through sanctions, people rely on intuitive decision-making processes to make most decisions, and organizations influence deterrence by shaping employees’ decision-making environment. Our theory improves on both classical deterrence theory and expressive law theory. …
It’S Just A Way Of Life: A Symbolic-Interactionist Approach To Inequalities In The Contemporary American South, Angela Rankin
It’S Just A Way Of Life: A Symbolic-Interactionist Approach To Inequalities In The Contemporary American South, Angela Rankin
Electronic Theses and Dissertations
The contemporary American South is characterized by significant inequalities that are deeply- embedded into the social fabric of the region. These inequalities are dictated by cultural and social dynamics that have shaped the Southern region over time; however, they are reinforced daily through the individual agency of Southern social actors. This thesis aims to analyze Southern inequalities through a symbolic-interactionist focused lens and data collected from semi-structured, qualitative interviews conducted with over 70 White Southerners in two places within the American South- Oxford, MS, and Memphis, TN. In this thesis, I argue that White Southern actors actively use their individual …

Alcohol use disorder is a chronic, relapsing brain condition that affects 29.5 million Americans. The disease is characterized by loss of control over drinking, continued use of alcohol in the face of negative consequences, and the experience of withdrawal symptoms. While there are several forms of treatment available for alcohol use disorder, 95% of patients experience at least one relapse during recovery. Currently, the high tendency to relapse remains the major challenge standing in the way of successful treatment for alcohol use disorder. Research is continuing to be conducted into the behavioral and neural mechanisms underlying relapse into alcohol use, …
