[A]ny change in sentencing practices is likely to be an improvement. Judge Marvin Frankel in 1973 1
Fifty years ago, Marvin E. Frankel published an elegant, timely, and extraordinarily influential book, Criminal Sentences: Law Without Order. Four years after this book called for the appellate review of sentences and for greatly limiting the discretion of both sentencing judges and parole boards, California became the first state to limit sharply judicial sentencing discretion and abolish parole.2
Twenty other states joined the reform movement before Congress embraced the move from individualized to wholesale sentencing in 1984.3 The Sentencing Reform Act …
Perceived Barriers To And Comfort Levels With Hypothetical Intimate Partner Violence Help-Seeking Among Arab Americans, Jana Mostafa
Perceived Barriers To And Comfort Levels With Hypothetical Intimate Partner Violence Help-Seeking Among Arab Americans, Jana Mostafa
Electronic Theses and Dissertations, 2020-2023
Members of the Arab American community experiencing intimate partner violence (IPV) face unique barriers to help-seeking and have different comfort levels with using formal and informal resources. This thesis surveyed Arab-Americans to identify perceived barriers and comfort levels with IPV help-seeking. A culturally informed and centered approach was taken to examine connections between individual level factors, perceived barriers and comfort levels in using resources. To do so, I gathered data via an online survey with 82 Arab American participants. Findings suggest that participants perceived the greatest barriers to seeking help for IPV are related to how others view and understand …
Guilty Of Probable Cause: Public Arrest Records And Dignity In The Information Age, Nicholas Thompson
Guilty Of Probable Cause: Public Arrest Records And Dignity In The Information Age, Nicholas Thompson
Indiana Journal of Global Legal Studies
The United States is exceptional among Western nations in its treatment of criminal records. Today, an estimated one-third of Americans1 bear the “modern equivalent of branding”: the publicly-accessible criminal record.2 Far from remaining locked in digital limbo, these records serve a variety of purposes, from legitimate law enforcement use to extortion against arrestees seeking to scrub their mugshots from a Google search.3 It would be natural to assume that such records result from an individual’s commission of a crime, for which the individual is duly convicted and then marked with the brand of the state for the transgression. But the …

Religiosity As A Moderator Of Infidelity In Dark Triad Women, Sophie M. Domanik
Religiosity As A Moderator Of Infidelity In Dark Triad Women, Sophie M. Domanik
Undergraduate Honors Thesis Projects
Personality is a major determinant of behavior. The Dark Triad is a cluster of personality traits-- psychopathy, narcissism, and Machiavellianism-- commonly associated with callousness, manipulation, and anti-social behavior. In the realm of relationships, Dark Triad traits have been shown to predict a host of destabilizing behaviors, including infidelity. Infidelity has negative psychological impacts on those involved, with research citing infidelity as a precursor to major depressive episodes for some individuals. High levels of religiosity, on the other hand, predict negative attitudes toward infidelity and fewer instances of cheating overall. The present study investigated whether levels of religiosity moderate infidelity intentions …
An Examination Of Chronic Homelessness From The Perspective Of Counseling Professionals In Southeast Florida, Tonia Jackson
An Examination Of Chronic Homelessness From The Perspective Of Counseling Professionals In Southeast Florida, Tonia Jackson
Walden Dissertations and Doctoral Studies
Homelessness continues to be a serious social problem in the United States. Despite the public and private resources expended to address homelessness, the crisis still exists. This phenomenological study was framed in Maslow’s human needs approach. Maslow created a list of basic five human needs to gain a better understanding of human behavior and motivation. The human behavior theory can also be applied to homelessness to provide a deeper understanding of the phenomenon. The research question addressed the strongest factors that counseling professionals consider to be related with chronic homelessness in Southeast Florida. Data were collected through semi-structured interviews of …

Climate Choice Architecture, Felix Mormann
Climate Choice Architecture, Felix Mormann
Faculty Scholarship
Personal choices drive global warming nearly as much as institutional decisions. Yet, policymakers overwhelmingly target large-scale industrial facilities for reductions in carbon emissions, with individual and household emissions a mere afterthought. Recent advances in behavioral economics, cognitive psychology, and related fields have produced a veritable behavior change revolution. Subtle changes to the choice environment, or nudges, have improved stake-holder decision-making in a wide range of contexts, from healthier food choices to better retirement planning. But the vast potential of choice architecture remains largely untapped for purposes of climate policy and action. This Article explores that untapped potential and makes the …
Opening The Virtual Window: How On-Line Processes Could Increase Access To Justice In The Criminal Legal System, Cynthia Alkon, Amy Schmitz
Opening The Virtual Window: How On-Line Processes Could Increase Access To Justice In The Criminal Legal System, Cynthia Alkon, Amy Schmitz
Faculty Scholarship
This article explores the potential of technology to improve access to justice (A2J) in criminal courts, specifically for nonviolent misdemeanor cases. Despite a push for innovation in courts, criminal courts have been slow to embrace change and technological innovation due to factors like constitutional constraints and funding limitations. This article argues that criminal courts need "virtual windows" alongside traditional "brick and mortar doors" to enhance A2J. It proposes a problem-solving approach focusing on misdemeanor cases, a high-volume category where technology can have a significant impact. The paper highlights the importance of ensuring defendants make "knowing and intelligent" pleas despite the …
The Continuing Application Of Gladue Principles In The Professional Discipline Of Indigenous Lawyers: A Comment On Law Society Of Ontario V Mccullough, Andrew Martin
Articles, Book Chapters, & Popular Press
While Gladue principles have previously been applied in the professional discipline of Indigenous lawyers, the recent decision of the Law Society Tribunal in Law Society of Ontario v McCullough affirms and applies those precedents in new and powerful ways. In this case comment, I explain the ways in which McCullough is important in its application of Gladue principles and consider what questions remain to be settled in future decisions.
Bail And Mental Illness, Samuel Wiseman
Bail And Mental Illness, Samuel Wiseman
Faculty Scholarship
In many parts of the United States, the bail system is strikingly unfair, imposing burdensome, and often unmeetable, financial conditions on pretrial liberty even for low-risk defendants. Reforms that reduce or eliminate cash bail and lower pretrial detention rates have made progress in recent years, but now face growing opposition even in generally progressive jurisdictions such as San Francisco and New York City. One source of this opposition is rising concern about crime—particularly crime associated with the unhoused, who disproportionately suffer from mental illness, including substance abuse disorder. This is not a coincidence, as one effect of a cash-bail system, …
Sexed Propensities And Gendered Penalties?: An Analysis Of The Economic Outcomes Of Transgender People, Jiwon Chung
Sexed Propensities And Gendered Penalties?: An Analysis Of The Economic Outcomes Of Transgender People, Jiwon Chung
CMC Senior Theses
Recent research has indicated the adverse economic outcomes of transgender people. The titular question of this paper refers to the effect on gendered economic outcomes that differences related to sex assigned at birth has for a sample of transgender individuals that is plausibly correlated with being at an early stage of their gender affirmation processes (e.g. social or medical transition). For this group of plausibly early-in-transition transgender individuals, I hypothesize and test a theory that draws the following account: assigned female at birth (AFAB) transgender individuals encounter significant economic penalties as a result of labour market decisions (i.e. industry sorting) …
Guns And Fatal Police Shootings: Accuracy Of Firearm Prevalence Proxies In A Panel Data Analysis, Corin Elmore
Guns And Fatal Police Shootings: Accuracy Of Firearm Prevalence Proxies In A Panel Data Analysis, Corin Elmore
CMC Senior Theses
This paper explores the relationship between gun prevalence and fatal police shootings in the United States. Specifically, the study assesses the validity of using FSS (Firearm Suicides Per Total Suicides) as a proxy for gun prevalence. It examines whether FBI background check data can be a more reliable alternative. Through a panel data analysis, the study provides moderate evidence that FBI background check data performs better than FSS as a proxy for gun prevalence and that the relationship between firearm prevalence and fatal police shootings is positive. Additionally, the study finds that instrumenting FSS with background check data to account …
Justice That Heals: Transforming Discipline In Schools Through Restorative Practices, Sophia Diomande
Justice That Heals: Transforming Discipline In Schools Through Restorative Practices, Sophia Diomande
CMC Senior Theses
Discipline is not simply a tool but a weapon — one that American educators have wielded for generations to regulate children and enforce habits of self-control and accountability. In a world where institutionalized forms of discrimination continue to plague judicial and educational systems alike, vis-à-vis the school-to-prison pipeline, the question must be asked: When does discipline stray beyond its intended purpose and into the realm of punishment? This thesis discusses the historical and contemporary implications of punitive discipline and its effects on students, particularly students of color and disabled students. Retributive policies such as suspensions, expulsions, physical restraint, and seclusions …
The Effects Of Gender Stereotypes And Types Of Crime On Perceptions Of Responsibility, Sentencing Severity, And Likelihood Of Recidivism, Spencer Hagenbuch
The Effects Of Gender Stereotypes And Types Of Crime On Perceptions Of Responsibility, Sentencing Severity, And Likelihood Of Recidivism, Spencer Hagenbuch
CMC Senior Theses
Past research has produced mixed findings regarding the roles of gender stereotypes in criminal sentencing. Usually, women receive preferential treatment; however, studies have shown that women receive harsher sentencing than men under certain circumstances. In light of these findings, we argued that the Chivalry and Paternalism thesis shows how women are exempted from harsh punishment when their crimes align with negative gender stereotypes, resulting in lenient treatment most of the time. Additionally, we argued that women receive harsher sentencing when their crimes violate positive gender stereotypes while men receive harsher sentencing when their crimes 1) violate positive gender stereotypes or …
Identifying The Main Causes For Support Of Crime Control Theater Forms, And Understanding How To Correct The Public’S Perception, Erisjames M. Elliott
Identifying The Main Causes For Support Of Crime Control Theater Forms, And Understanding How To Correct The Public’S Perception, Erisjames M. Elliott
CMC Senior Theses
Much research has been completed on the forms of crime control theater (CCT), and the impact that the existence of CCT laws have on society. Research on CCT laws has shown that they are definitively unsuccessful in providing the safety they were created to provide. This thesis will utilize completed research to explain the main psychological phenomena holding people back from decreasing their support for CCT laws. It will also describe proven methods of correcting misinformation in order to change the perceptions of people who support crime control theater laws, and provide suggestions for how research should be continued.

Appraising The Devos Tix Rule: Due Process In Campus Adjudication Processes, Athulya Nath
CMC Senior Theses
The increasing awareness and desire to fight sexual violence on college campuses have led to focusing campus adjudication processes on achieving justice. This thesis will analyze Betsy DeVos’s Title IX changes and explore whether she achieves due process protections in the new policy. This thesis will detail DeVos’s various changes – increased evidentiary standard, live hearing and cross-examination, narrowed definitions, reduction of responsible employees, and presumption of innocence for accused students – and how these changes are beneficial or detrimental to due process as a whole. This thesis will also explore the presence of rape culture on college campuses, the …
Pressing The Verdict: The Social Influence Of Pretrial Publicity On Juror Biases, Kara Cato
Pressing The Verdict: The Social Influence Of Pretrial Publicity On Juror Biases, Kara Cato
CMC Senior Theses
Past psychological research has indicated that pretrial publicity has a significant impact on jury decision-making (Shniderman, 2013). This current review aims to expand on past research by investigating the social influence of pretrial publicity on juror biases. The effects of pretrial publicity on juror biases are examined through three mechanisms of social influence: story model, predecisional distortion, and conformity prejudice. This research inspects the relationship between media and the law by reviewing the pervasiveness of the media's depiction of criminal cases, the changing nature of media, and the biasing effects of media exposure. In addition, it explores the different forms …
Critical Pathways To Disability Decarceration: Reading Liat Ben-Moshe And Linda Steele, Sheila Wildeman
Critical Pathways To Disability Decarceration: Reading Liat Ben-Moshe And Linda Steele, Sheila Wildeman
Articles, Book Chapters, & Popular Press
I consider how Liat Ben-Moshe’s Decarcerating Disability and Linda Steele’s Disability, Criminal Justice and Law: Reconsidering Court Diversion contribute to emerging conversations between critical disability studies and anti-carceral studies, and between disability deinstitutionalization and prison abolitionism. I ask: what if any role might law, or specifically rights-based litigation, play in resisting carceral state strategies and redirecting material and conceptual resources toward supports for diverse forms of flourishing? I centre my remarks on the special relevance of Ben-Moshe’s and Steele’s books to social movement activism in Atlantic Canada and critical reappraisal of Canada’s solitary confinement litigation.
