Razing & Rebuilding Delinquency Courts: Demolishing The Flawed Philosophical Foundation Of Parens Patriae, Eduardo R. Ferrer
Razing & Rebuilding Delinquency Courts: Demolishing The Flawed Philosophical Foundation Of Parens Patriae, Eduardo R. Ferrer
Loyola University Chicago Law Journal
Professor Eduardo R. Ferrer of Georgetown University explores the history and background of the juvenile delinquent system in the United States. Professor Ferrer argues that the philosophical underpinnings of our legal youth systems, under the concept of parens patriae, have led to failure with regard to how states care for children that come under their control—and ultimately need to be abandoned in favor of a more effective and just system.

Nonjudicial Punishment, Frank Rosenblatt
Nonjudicial Punishment, Frank Rosenblatt
Journal Articles
In the civilian world, the dispensation of punishment is reserved for judicial tribunals. Not so in the military justice systems of the United States and other nations. There, nonlawyer military leaders administer so-called “nonjudicial punishment” to address minor offenses in the ranks. Nonjudicial punishment, despite a long and sometimes bloody history, has survived efforts to modernize military justice. In fact, it has flourished: today it is the predominant form of military justice in the United States, outnumbering courts-martial nearly twenty to one. This Article analyzes the features and purposes of this unique punishment regime. The Article argues that nonjudicial punishment …

Social Identity As A Factor In Bystander Responses To Bias-Based Verbal Aggression Among College Students, Shveta Kumaria, David S. Byers, Katherine M. Mccarthy, Carmen Moedano
Graduate School of Social Work and Social Research Faculty Research and Scholarship
Bias-based bullying is a significant problem in the United States, including aggression targeting college students with minoritized social identities. Bystander responsiveness can help to buffer the effects, but social identity factors may influence how students respond to bias-based aggression among peers. We conducted a cross-sectional analysis of a subsample (N = 7,291) of the 2018–2019 Healthy Minds Study to test correlations between racial, sexual, and gender identities and self-reported and hypothetical peer interventions. Students who identify with minoritized sexual and gender identities, across racial identities, are most likely to report past or intended interventions while students who identify as …

Crossing The Goalline: Identifying The Success Of Black Football Players At A Predominantly White Institution, Mark Blackburn
Dissertations and Theses
The presence of Black football players in predominantly white institutions in athletic programs often highlights the racial disparities in college athletics. It is important to understand the dynamic discrepancies in the resources, support, and opportunities provided to Black football players to obtain success. This research examines the lived experiences of Black football players at a PWI located in the Midwest. Data was coded and analyzed into categories. There are six themes that emerged. 1. The attention to have academic focus. 2. The ability to maintain a connection and support from family and other important figures. 3. Constantly navigating microaggressions from …

Gender Violence As A Penalty Of Poverty, Deborah M. Weissman
Faculty Publications
The matter of gender violence, including intimate partner violence (IPV), has long been categorized as a particularly egregious crime. The consequences of IPV are profound and affect all members of the household, family members near and far, and the communities where they live. Gender violence impacts the national economy. Costs accrue to workplaces, health care institutions, and encumber local and state coffers. Survivors are deprived of income, property, and economic stability: conditions that often endure beyond periods of physical injuries. Offenders also experience economic hardship as a result of involvement with the legal system. They often face significant obstacles when …

The United States is the only country that elects its local prosecutors. In theory, these local elections could facilitate local control of criminal justice policy. But the academic literature assumes that, in practice, prosecutor elections fail to live up to that promise. This Article complicates that conventional wisdom with a new, national study of campaign contributions in prosecutor elections. The study offers a more complete empirical account of prosecutor accountability by analyzing contributions to local candidates as well as their election results. It details the amount of money in local prosecutor elections, including from interest groups, and the relationship between …

Policing The College Campus: History, Race, And Law, Vanessa Miller, Katheryn Russell-Brown
Washington and Lee Journal of Civil Rights and Social Justice
The structure, impact, and historical roots of campus policing on the American college campus receives little academic attention. In fact, campus policing is often overlooked in legal analyses and research studies, including its relationship to race. Campus policing and race deserves a critical assessment from legal scholars because race is fixed to the ways the criminal-legal system presents itself on campus. The racialized implications of policing on campus are rooted in historical social and legal contexts that still exist today. However, the lack of research on campus policing is not surprising. American colleges and universities have successfully marketed themselves as …

High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg
Washington and Lee Journal of Civil Rights and Social Justice
Conspicuously absent from the United States’ ongoing discourse about its racist history is a more honest discussion about the individual and personal stressors that are evoked in people when they talk about racism. What if they got it wrong? The fear of being cancelled -- the public shaming for remarks that are deemed racist -- has had a chilling effect on having meaningful conversations about racism. What lost opportunities!
This paper moves this discussion into the law school context. How might law schools rethink their law school curricula to more accurately represent the role systemic racism has played in shaping …

Behind The Screen: Examining The Human Consequences And Constitutional Ramifications Of The Virtual Criminal Defendant, Mallory Kostroff
Washington and Lee Journal of Civil Rights and Social Justice
Defendants are waiting behind a screen to learn their fate in their criminal proceedings. This Note sounds the alarm that having incarcerated defendants appear virtually for their criminal proceedings will lead the criminal justice system further down a path of mass incarceration and destruction. This Note demonstrates and argues that there are no benefits for having an incarcerated defendant appear virtually because there are no real benefits to the defendant themselves. Courts further try to argue that video appearances are efficient as they save time and money but as this Note shows those arguments are misleading and miss the point …

The Perils Of Privatization: Exploring The Side Effects Of Privatized Correctional Health Care In Favor Of A Public Delivery Model, Peyton Holahan
Washington and Lee Journal of Civil Rights and Social Justice
On July 16, 2020, Judge Roslyn Silver of the U.S. District Court for the District of Arizona set a trial between Arizona’s Department of Corrections and a class of Arizona’s prisoners alleging grossly inadequate health care in the state’s prison system. Arizona, like more than half of the states in the U.S., has outsourced prison health care to private correctional healthcare providers. While correctional healthcare providers win states over with promises of cost-effective care and limited liability, ever since the emergence of the correctional healthcare industry in the 1970s, problems with privatized health care in jails and prisons have persisted, …

Critical Theory & Commercial Law In The Sunshine, Christopher D. Hampson
Critical Theory & Commercial Law In The Sunshine, Christopher D. Hampson

In recent years, Florida and other states have attempted to expel critical legal theory, critical race theory, and all things “woke” from their institutions of higher education. At a time of professional cautiousness and chilled speech, this Essay aims to bring these ideas into the sunshine. I provide a rough background on critical theory and how it helps make sense of commercial law, including Contracts and Bankruptcy, two courses I teach at the University of Florida. Critical theory can help students learn how to navigate complex systems of laws, analyze the policy implications of legal rules, and represent their future …

The concept of the judgment-proof or collection-proof debtor is fundamental to our understanding of civil law and of what distinguishes it from criminal law. But when civil creditors can threaten unduly harsh or cruel debt collection measures (whether legally or not), they extend their reach into the pockets of those whom this Article calls “redeemers,” third parties with a familial or quasi-familial relationship to civil debtors who have reason to pay on their behalf. This Article examines four such measures—imprisonment, homelessness, destitution, and deportation—remedies that sound like they come from another time and place, but which are threatened by some …

Absolute constitutional rights are rare—even the venerable rights of free speech and freedom of religion are not absolute. In criminal prosecutions, the Sixth Amendment’s right to counsel has been described as the most important of all rights because it affects a defendant’s ability to assert his or her other rights. But the right to counsel is not unlimited.
Yet one right is absolute. A criminal defendant has an absolute right not to testify in his own criminal trial. The text of the Self-Incrimination Clause of the Fifth Amendment—“no person . . . shall be compelled in any criminal case to …

This article reviews the legal frameworks of diminished criminal responsibility in eighteen civil law jurisdictions across the globe—Brazil, Chile, China, the Czech Republic, Finland, France, Germany, Greece, Italy, Japan, Luxembourg, Poland, Portugal, Russia, Spain, Switzerland, Taiwan, and Turkey. Specifically, it reports the legal standards and main features of partial responsibility, associated penalty reductions, and potential dispositions following a partial responsibility finding. It also surveys empirical data on the prevalence of diminished responsibility as compared to criminal nonresponsibility. This article, which reflects contemporary penal codes and draws from both English and non-English sources, is the only known existing source to compile …
