A few days after the Supreme Court’s decision in Dobbs v. Jackson Women’s Health, the Biden administration issued guidance seeking to reassure doctors and patients that the federal HIPAA Privacy Rule would allow women to feel confident that they could still seek reproductive healthcare without worrying that the information in their medical records would end up in the hands of police. As scholars focused respectively on the criminalization of poverty and reproductive conduct (Wendy Bach) and health policy and privacy (Nicolas Terry), we were less than reassured. We write this essay to emphasize how, rather than revealing the strength of …

This issue of the Temple Journal of International and Comparative Law hosts a symposium about Randle DeFalco's cutting-edge book, Invisible Atrocities: The Aesthetic Biases of International Criminal Justice. In it, DeFalco glances at glimpses of the metastasis of mass atrocity. He sees these metastatic processes-these movements-as simultaneously fast and slow. By fast, he refers to obvious and instantly horrific acts of physical violence. These are massacres, attacks, pogroms, and wanton destruction. But DeFalco also discerns that mass violence implicates slower movements and less directly causal harms: these are famine, starvation, corruption, impoverishment, mental anguish, and aid interference.' The movements …

A Law & Macroeconomics Critique Of San Antonio Independent School District V. Rodriguez, Steven A. Ramirez
A Law & Macroeconomics Critique Of San Antonio Independent School District V. Rodriguez, Steven A. Ramirez
Loyola University Chicago Law Journal
Fifty years ago, the Supreme Court decided, in San Antonio Independent School District v. Rodriguez, to permit states to provide dramatically disparate funding for childhood education from district to district, thereby concretizing and propagating racial and economic inequality indefinitely. This Article shows that this decision entails staggering macroeconomic costs, undermines human development in the United States, and has hindered the government from promoting general welfare, domestic tranquility, and common defense. The opinion pursued the political objectives of the Southern Strategy and does not rest upon a legitimate exercise of judicial power. Rodriguez furthers the replication of our nation’s racial …
Advanced Practice Registered Nurses And Healthcare Disparities: Understanding The Impact Of Implicit Bias, Marla Lepley-Starr
Advanced Practice Registered Nurses And Healthcare Disparities: Understanding The Impact Of Implicit Bias, Marla Lepley-Starr
Doctor of Nursing Practice Projects
Introduction: Disparities in healthcare have long been a challenge for physicians, advanced practice providers, nurses, and other interdisciplinary team members. More recently, population health-focused efforts have been implemented to manage everincreasing rates of diabetes, hypertension, and obesity, as well as lack of transportation, limited access to care, and poverty (North Carolina Department of Health and Human Services [NCDHHS], 2019). Racism, sexism, ageism, sizeism, etc., are present in the healthcare setting and manifests in implicit bias during care delivery. This can manifest as beliefs, behaviors/practices, and emotions of the provider (Paradies et al., 2014). Research is limited related to the …

The Racial Discipline Gap In Education: A Master's Thesis, Emily Mychal Stripe
The Racial Discipline Gap In Education: A Master's Thesis, Emily Mychal Stripe
All Electronic Theses and Dissertations
Racial inequities persist throughout the United States’ educational system despite the increased attention on reducing exclusionary discipline. These inequities, conceptualized as educational and disciplinary gaps between Black and White students, produce negative outcomes for students of color including decreased graduation rates and an increased risk of entering the criminal justice system. In this review, I analyzed current literature in order to identify multiple factors that impact the racial discipline gap at the familial, organizational, and individual levels. Based on the literature reviewed and analyzed here, closing the racial discipline gap requires educational stakeholders to implement a framework of principles, policies, …

Understanding Leadership's Role In Recognizing And Navigating Secondary Trauma Exposure To Create A Positive, Supportive, And Healthy Workplace, Amanda Mace
M.S. in Leadership
Professionals in social services agencies play an essential role in assisting trauma victims. However, research shows that secondary exposure to trauma can have lasting effects on the professionals helping the victims. As a result, this exposure may result in negative psychological responses, including secondary traumatic stress (STS), vicarious trauma (VT), burnout, and compassion fatigue. A systematic search was used across relevant research databases (Granite State College Library, Google Scholar, PubMed) for studies regarding secondary trauma exposure in social services professions. In addition, a survey was distributed to fourteen leaders. The research and survey aimed to explore the prevalence and risk …
Democracy's Other Boundary Problem: The Law Of Disqualification, Tom Ginsburg, Aziz Z. Huq, David Landau
Democracy's Other Boundary Problem: The Law Of Disqualification, Tom Ginsburg, Aziz Z. Huq, David Landau
Scholarly Publications
Almost all national constitutions contain one or more ways to disqualify specific individuals from political office. Indeed, the U.S. Constitution incorporates at least four overlapping pathways toward disqualification. This power of disqualifying specific individuals or groups stands at the heart of the complex project of maintaining democratic rule. In practice, disqualification can work both as an instrument for preserving democratic rule and also as a knife against it. This Article is the first to systematically analyze the complex positive and normative questions raised by disqualification. We offer both a positive account of the function that disqualification plays in constitutional ordering …
