Policing In The Shadow Of Legality: Pretext, Leveraging, And Investigation Cascades, Terry Skolnik
Osgoode Hall Law Journal
Police officers often exercise their authority at the boundary of legality. Two of policing’s features contribute to this tendency: first, the scope of certain police powers is unclear; second, officers enjoy broad discretion to initiate proactive police encounters. This article argues that these interrelated features of policing result in three law enforcement phenomena: pretext, leveraging, and investigation cascades. Pretext denotes that police officers invoke lawful justifications to pursue unlawful aims. Leveraging implies that officers exploit individuals’ psychological vulnerabilities to secure compliance or to receive consent to engage in more intrusive investigatory tactics. Investigation cascades occur when officers gather information through …

The COVID-19 pandemic presented numerous challenges for nurses working in intensive care units (ICUs), leading to a significant impact on their mental and psychological well-being. Despite these challenges, resilience is recognized as a protective factor for ICU nurses that can enhance the well-being of healthcare professionals and enable them to cope effectively with stressors and challenges. But there is a gap in the literature about the experiences, unique needs, and resilience strategies used by ICU nurses in the United States (U.S.).

The United States criminal justice system’s (CJS) primary purpose is for the rehabilitation of the individuals within it, which calls for a comprehensive evaluation and critique of its effectiveness. Though there are many variables of the CJS that can be evaluated, for those who are battling a substance or opioid use disorder, accessing treatment is particularly difficult. Further, upon release from the jail/prison system, such persons are often expected to maintain certain parameters such as holding a job. The World Health Organization (WHO) recognizes childhood sexual abuse (CSA) as a global health issue. CSA is a human violation that affects both female and male children and has a stronger detrimental impact on mental health than other traumatic childhood experiences. Despite a growing awareness of male survivors of CSA, male survivors are a marginalized group as most CSA research focuses on females. In addition, masculine norms can keep male adults from disclosing further, which can delay support and increase mental health issues. In 2019 Collier Library hosted an exhibit, Ghosts Over the Boiler, as part of the University of North Alabama’s common read program. This exhibit, developed by English professor Dr. Katie Owens-Murphy and curated by librarian Jennifer Pate, led to the development of both a physical Alabama Death Row Archive and a digital archive housed in the library’s institutional repository, the Repository of Open Access Research (RoOAR). In 2019, the House of Commons Standing Committee on Justice and Human Rights published its study on the criminalization of HIV non-disclosure in Canada. The report recommended removing HIV non-disclosure from sexual assault laws in Canada. This constituted a welcome development for many HIV advocates. Yet other recommendations proved more controversial. In order to counter the exceptional targeting of HIV, the Committee proposed an offence for the non disclosure of all infectious diseases. This article uses the proposal to develop three arguments. First, the idea of creating an offence for all infectious diseases finds its origins in criminal laws dating …

State and local open records laws play a vital role in our democracy. They shed light on the darkest places, exposing corruption and holding the powerful accountable. Yet lawmakers are continually chipping away at the public’s right to know by limiting the information available under open records laws. Exemptions have been passed to bolster special interests, in response to investigative journalism, and to shield lawmakers. Is A Psychotic Anthropology Possible? Or How To Have Inclusive Anthropologies Of Subjectivity And Personhood, John Marlovits, Matthew J. Wolf-Meyer

Dominant anthropological theories of mind, cognition, and consciousness reify particular ways of being in the world as "normal," which marginalizes the experiences of people who do not meet normative expectations of personhood or exhibit nonnormative subjectivities. By focusing on atypical forms of communication and self-representation in the ethnographic record, which draws from work in the anthropology of disability and psychological anthropology, we argue for the need to attend to interactions and behavior as the necessary basis for anthropological studies of personhood and subjectivity. This dissertation examines self-represented litigants subjected to limitations under the Vexatious Litigant statute (F.S. 68.093) and related case law. It draws data from official records, surveys, interviews with judges, and a thematic analysis of court orders. The present research consists of two studies: Study I focuses on the application of Florida's Vexatious Litigant statute and similar sanctions, and Study II explores judges' decision-making in cases involving challenging self-represented litigants. Restrictions on litigants' court access raise concerns about due process rights, and an assessment of the use of these sanctions and litigants' practices is vital for understanding their application. Grand juries in the United States were originally intended to protect people from unwarranted criminal prosecution by the government; however, criticism of federal grand juries in the U.S. throughout the past five decades demonstrates that these deliberative bodies protect prosecutors at the expense of the people subjected to their investigations. Worse still, federal grand jury proceedings circumvent fundamental constitutional rights, direct judicial oversight, and many of the procedural protections of criminal trials; they enable prosecutors to strip unaccused individuals subpoenaed solely for witness testimony of their safety, rights, and liberty. In restorative practices, harmed parties have the opportunity to tell those responsible how they have been affected. Those responsible can gain empathy and understanding — not only for those directly affected, but for family, friends, co-workers and others. Then, the responsible parties have a chance to make amends and shed the "offender" label, hopefully breaking the cycle of violence, misbehavior and/or disruption.
