Damon Landor v. Louisiana Department of Corrections and Public Safety
Appeal from the United States District Court for the Middle District of Louisiana, No. 3:21-cv-733 The Honorable Shelly D. Dick, Chief Judge
From the Summary of the Argument
The Fifth Circuit should rehear en banc the panel decision in this case because it presents a “question of exceptional importance” under Fed. R. App. P. 35: whether the Religious Land Use and Institutionalized Persons Act (RLUIPA) authorizes monetary damages. This issue is exceptionally important for two reasons.

ETSU News
When the state of Tennessee called upon its institutions to offer a certificate program to train more child welfare advocates, East Tennessee State University answered.
Across the state, there is a critical need for more people trained to recognize and intervene when children are being maltreated or abused at all levels of intervention – from the Department of Children’s Services and the court system to police officers and educators.
“This program is designed so people can learn to work together for the best interests of the child and their family, and also to train people how to appropriately intervene,” said …

Mitigation Reports In Capital Cases: Legal And Ethical Issues, Russell Stetler, W. Bradley Wendel
St. Mary's Journal on Legal Malpractice & Ethics
The mitigation investigation that is essential in every capital case requires a multidisciplinary team. The duty to conduct this investigation is clearly established federal law, as well as an ethical obligation of counsel. The mitigation evidence that is uncovered is of vital importance to the rights of the individual accused of a capital offense, but also to reliable outcomes since all decisionmakers—including prosecutors, jurors, and judges—need the most complete and accurate picture of the person facing the punishment of last resort. This Article discusses some of the unique legal and ethical issues affecting the documentation of this investigation. The Authors …

First responders disproportionately experience occupational stress when compared to the general population, and COVID-19 has exacerbated this stress. The nature of their duties as law enforcement officers, firefighters, and medics exposes them to repeated trauma, increasing their risk of developing a broad array of mental health issues, including post-traumatic stress disorder (PTSD), substance use disorder (SUD), and compassion fatigue. This paper describes the need for resources for frontline workers and provides a framework for creating and implementing resources. A team of interdisciplinary subject matter experts developed two major resources. The first resource was a 24/7 helpline to support first responders …

The Effect Of Psychopathy Trait Descriptions On Mock Juror Decision-Making, Bailey A. Hall
The Effect Of Psychopathy Trait Descriptions On Mock Juror Decision-Making, Bailey A. Hall
USF Tampa Graduate Theses and Dissertations
Layperson misconceptions and stigma surrounding mental illness can have devastating consequences in criminal trials, especially capital (death penalty) cases. Psychopathy is a particularly stigmatizing disorder often used as an aggravating factor in capital cases. The present experimental study examined how case vignettes that included descriptions of psychopathic traits (i.e., criterion effects) differentially influenced juror decision-making. Specifically, undergraduate participants read case facts about a convicted defendant and were randomly assigned to read one of five expert witness testimony conditions describing the defendant using: interpersonal-affective psychopathy traits (e.g., superficially charming, manipulative), antisocial-lifestyle traits (e.g., reckless, aggressive), combined interpersonal-affective and antisocial-lifestyle traits, or …
Latino Voter Participation In The 2018 And 2022 Midterm Elections, Laird W. Bergad
Latino Voter Participation In The 2018 And 2022 Midterm Elections, Laird W. Bergad
Center for Latin American, Caribbean, and Latino Studies
Introduction
This study analyzes Latino voting participation, comparing the US midterm elections of the years 2018 and 2022.
Method
The study is a descriptive and comparative analysis using data from the 2022 Voting and Registration Data from the US Census Bureau.
Discussion
The study found that nationally, only 37.9% of eligible Latino voters took part in the 2022 midterms, compared to 40.4% in the 2018 midterms. Despite this decline in the percentage of registered voters casting ballots in 2022, the percentage of Latinos registered to vote rose from 53.7% in 2018 to 57.8% in 2022.
The Incompatibility Of Democracy And Equal Freedom, Samantha Koreman
The Incompatibility Of Democracy And Equal Freedom, Samantha Koreman
International Journal of Undergraduate Research and Creative Activities
It is commonly believed that democracies are freedom preserving. In a limited, consequentialist sense, this presumption may be correct. However, if someone were to look critically at an application of liberal democracy, she would discover that democracy is not as consistent with freedom as it appears to be. This paper argues that democracy is incompatible with equal freedom as realistic applications of democracy undermine liberty on both a practical and structural level. To accomplish this task, this paper discusses the role of group agents in a democratic political system. While voting allows citizens to express their opinions, voting cannot—in practical …
Preliminary-Hearing Waivers And The Contract To Negotiate, Michael D. Cicchini
Preliminary-Hearing Waivers And The Contract To Negotiate, Michael D. Cicchini
Pepperdine Law Review
Plea bargaining often begins very early in a criminal case—sometimes before the preliminary hearing, or “prelim,” is held. Be-cause of the time, effort, and risk involved in holding a prelim, the prosecutor may make the defendant a prelim waiver offer. That is, if the defendant agrees to waive the prelim, the prosecutor will hold a particular plea offer open for the defendant’s future consideration. Such prelim waiver offers may be skeletal, at best, but will often include the promise of “future negotiations” to fill in the details. When the prosecutor obtains the defendant’s prelim waiver for the promise of future …

Title: The Truth Behind A Guardian Ad Litem, Klarissa Stovall
Master of Arts in Criminal Justice Leadership
The role of a guardian ad litem is at the forefront when acknowledging the significance of the role in its entirety when considering the safety and wellbeing of a child who is a victim of abuse or neglect. Also focusing on the supportive topics including adequate training, effective communication, and safety is equally important when discussing the role of a guardian ad litem. Furthermore, being able to acknowledge the role of a guardian ad litem is extremely helpful when remembering how vital they are to the future of a child, specifically when involved in child protective services or family law. …

Reviving Old Mosul: 3d Modeling Aids Safe Clearance In Iraq, Erin Atkinson, Marc Dennehy, Craig Locke
The Journal of Conventional Weapons Destruction
Under the 2014–2017 Islamic State of Iraq and Syria (ISIS) occupation, the Old City of Mosul, Iraq, served as a headquarters for the self-proclaimed caliphate. ISIS produced, stored, and transited money, modern munitions, weapons, and improvised explosive devices (IEDs) through the city's ancient stone streets. To approach the immense and technically challenging task of clearing the Old City efficiently, effectively, and safely—without compromising the city's rich cultural history—Tetra Tech created a 3D model using aerial photogrammetry to quantify and visualize the scope and scale of the project.

It’S Not About Success. It’S About The Message. Elite Messaging And Xenophobic Hate Crimes In The Eu, Annemarie Ackerman
Claremont-UC Undergraduate Research Conference on the European Union
Through the past decade, far-right political parties have skyrocketed in popularity and electoral success across the globe, with an especially pronounced effect seen in Europe. One critical component of far-right political movements is nationalist sentiment, often expressed via racist or xenophobic policies and rhetoric. This paper seeks to investigate how electoral success of far-right political parties and elite messaging via policy stances of these parties impacts rates of xenophobic violence in a country. Using data from the Chapel Hill Expert Survey (CHES) and hate crime statistics from the Organization for Security and Cooperation in Europe (OSCE), it is shown that …

Defending Against Projects Of Faction: Reforming The Congressional Investigation Process, John Sullivan
Defending Against Projects Of Faction: Reforming The Congressional Investigation Process, John Sullivan
Catholic University Law Review
Throughout American history, the power to investigate has been one of key powers of the U.S. Congress. This power, shaped by the Congress itself and the courts, has evolved into a critical tool used to hold parties accountable and to promote effective legislation for the American people. Yet as much as it can be used to further the interests of all Americans, so too can it be used to further a party’s own political agenda. Today, the congressional investigation process has become overly-politicized, misused for fundraising purposes, and overseen by members of Congress who are not investigators by trade.

Keeping Fair Chance Laws Fair: Implications For Employers And Employees Given The Expansion And Variety Of Fair Chance Laws In The United States, Caitlin T. Gaines
Catholic University Law Review
Jurisdictions around the United States have adopted, and are considering adopting, fair chance laws, also known as “ban the box” laws, to improve access to employment opportunities for those with criminal histories. For years, individuals with criminal records – approximately one in four U.S. adults – have been disadvantaged when employers heavily rely upon criminal background checks during the hiring process. Now, with the proliferation of fair chance laws which require employers to avoid considering criminal history in hiring decisions, public and private employers are faced with implementation concerns as they adapt their hiring practices to ensure compliance with the …

America’S Two Pastimes: Baseball And Constitutional Law; Review Of Adrian Vermeule, Common Good Constitutionalism, Paul J. Larkin
Catholic University Law Review
For the last 50 years, the two prevailing constitutional interpretation methodologies have been Originalism and Living Constitutionalism. The former treats the Constitution almost like a contract and demands that interpreters focus on the ordinary contemporary understanding its terms would have received when they became law. The latter treats the Constitution as a charter for the structure of a new government that would survive and mature as needed to protect both the nation and its people as new threats to government and civil liberties arise. Professor Adrian Vermeule’s book Common Good Constitutionalism offers a new approach to constitutional interpretation, one that …
